APPROVAL of 401 Water Quality Certification with Additional Condition
Dear Mr. Owens:
You have our approval, in accordance with the attached conditions, to shade 0.08 acre of vegetated and non-vegetated wetlands
in order to construct a walkway, pier and gazebo on the Manteo/Nags Head Causeway in Dare County, as described in your application
received by the Division of Water Quality on June 26, 2003. After reviewing your application, we have determined that this fill is covered

by General Water Quality Certification Number 3400, which can be downloaded from our web site at httr):Hh2o.enr.state.nc.us/ncwetland
. This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should
get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Non-Discharge, Water Supply Watershed and U.S. Coast Guard regulations. Also this approval will expire when the
accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional
conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work Included in the 401
Certification has been completed;
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days
of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

PROJECT SETTING
The applicant's property is located at 7344 and 7340 S. Virginia Dare Trail, on the north side of the
Manteo/Nags Head Causeway (US 64/264), in Nags Head, Dare County. Properties to the east and west of
the project site are vacant. Land uses in the general area are primarily commercial.
The project site consists of two parcels. The western most parcel is 25,840sf and has a retail shop located on
the property. The second parcel is east of the retail shop, consists of 38,783sf, and is the home of RVs
Restaurant. Structures on 7340 S. Virginia Dare Trail include a full service restaurant, a pier and gazebo on
the east side of the property, a pier and platform on the north side, and associated infrastructure. Structures
on 7344 S. Virginia Dare Trail include a retail store and associated infrastructure.
The average elevation of the two properties is 4.5' above normal water level, and is located within an AE
(EL not available) Flood Zone. Wetland vegetation on the property is a mix of salt meadow cord grass
(Spartina patens), smooth cord grass (Spartina alterniora), black needle rush (Juncus roemerianus).
Upland vegetation includes, but is not limited to, poison ivy (Toxicodendron radicans), groundsel bush
(Baccharis hamifolia), wax myrtle (Myrica cerifera), eastern red cedar (Juniperus virginiana) and domestic
yard grasses.
The water bottom along the applicant's property is sandy with a gentle slope. Water depths along the
walkway range from 6" to 1.2' below normal water level (NWL), while the average depth at the proposed
gazebo is 2.5' below NWL. There is no Submerged Aquatic Vegetation within the proposed work area.
The Division of Environmental Management's water quality classification for the waters of the Roanoke
Sound, contiguous to that portion of the Pasquotank River Basin that extend from the North Carolina-
Virginia State Line to the northeast tip of Ocracoke Island, as SA (shell fishing). Review of available
information suggests that there are no known archeological sites or unique geological formations associated
within the immediate area.
PROPOSED DEVELOPMENT
The applicant is proposing a 525' walkway adjacent to and over the water, that will extend the width of the
properties located at 7344 and 7340 S. Virginia Dare Trail. The owner is also proposing toconstruct a pier
with a 400sf gazebo behind the retail shop.

ANTICIPATED IMPACTS
• If permitted the pier will shade 3003 square feet of shallow water bottom and Estuarine and
Public Trust Waters.
• If permitted the pier will shade 289 square feet of Coastal Wetlands fringe.
• If permitted the pier will shade 888 square feet of high ground.
• Temporary localized turbidity will occur during construction of the pier.
• The proposed pier, gazebo and waterward boardwalk make converting the use to a more intense
water based commercial activity attractive, and may result in future increases in non-point
source pollution.
