Reduced the permanent stream impacts at Stream E from 66LF to 8LF. Overall permanent impacts have been reduced from 196LF to 138LF and total loss from 119LF to 88LF. I've included an updated impact table within the application attached and also an updated planset showing the proposed impacts. I have completed my initial review of the report and I have determined that it is incomplete. The following information is necessary before I will issue a determination: a. The PCN requests the use of two different Nationwide Permits to construct a residential development. However, the PCN did not clearly describe which impacts would be associated with NWP 29 and which would be with NWP 18. Therefore, please quantity the impacts associated with each NWP requested. b. The majority of impacts are proposed under Nationwide Permit 29 and 66 linear feet of stream impacts are potentially proposed under Nationwide Permit 18. The stream impacts (66 linear feet) are associated with the development of stormwater facility FOR THE RESIDENTIAL DEVELOPMENT. The Corps considers all impacts proposed as associated with the construction of the residential development and would then be permitted under Nationwide Permit 29. Please explain why they stream impacts (66 linear feet) are associated with Nationwide Permit 18 and not included with the other permanent wetland impacts associated with Nationwide Permit 29. c. Avoidance and minimization has not clearly be demonstrated for this project. General Condition 23(a) of Nationwide Permit 29 states "The activity must be designed and constructed to avoid and minimize adverse effects, both temporary and permanent, to waters of the United States to the maximum extent practicable at the project site." The term practicable means available and capable of being done after taking into consideration cost, existing technology, and logistics in light of the overall project purposes (see 40 CFR 230.3(I)). The Corps is concerned that the applicant has not avoided and minimized impacts to waters of the United States to the maximum extent practicable as required by regulation. After further review of the proposed site configuration, it seems the proposed stormwater facility could be reconfigured/resized and/or moved to a new location within the proposed project boundary to allow for a different site configuration which may have less impacts to waters of the United States. The project as proposed has not demonstrated that it will have no more than minimal impacts to the environment. d. Please remove the nomenclature "marginal" on any figures included in the PCN (i.e., Figures 7-8). e. As currently proposed, the cumulative impacts for the proposed project is over 0.5 acres of impacts to waters of the United States. In NWP 29, it states "For residential subdivisions, the aggregate total loss of waters of United States authorized by this NWP cannot exceed 0.5 acre." As currently proposed, this project cannot be verified under the Nationwide Permit Program and would need to be analyzed/issued under a Standard Permit (i.e., Individual Permit). f. Please provide a detailed cross -sectional drawings depicting the embedded riprap proposed for placement in Stream E. If riprap is not embedded and does not provide enhancement function, such sediment deposition, then the linear feet associated with embedded riprap (i.e., 35 linear feet) may be considered a permanent impacts which results in loss of waters of the United States. g. In the PCN it states the proposed project will permanently impact 154 linear feet of stream channel. Of those 154 linear feet, 35 linear feet are proposed as embedded riprap and you are not considering that a loss of waters. In addition, you provided no compensatory mitigation for the remaining 119 linear feet of permanent, loss of water stream impacts. However, the Corps views these permanent impacts cumulatively, and since cumulatively these impacts are over the threshold, the Corps will likely require mitigation for stream impacts. Therefore, the Corps will likely require compensatory mitigation for 119 linear feet of permanent stream impacts. h. In the PCN, the project is proposing to impact 0.237 acres of open waters. In addition, no compensatory mitigation was proposed for these open water impacts. However, if you review photographs and aerial imagery of the open water it shows this area as very swallow, with a mature/growing vegetated buffer (20+ years of vegetated growth), and a large fringe/adjacent wetland system which may act like a freshwater marsh system. If you reference NCWAM, specifically question 21 (Vegetation/Open Water Dispersion) this system (i.e., 0.237 acres of open water and 0.236 acres of fringe wetland) is best described as either an "b" or "c" type. Based on the nature of the system and the proposed impacts on this system, compensatory mitigation is warranted for both the wetlands and open waters. The Corps is willing to consider a reduced ratio for the open water impacts compared to the proposed 2:1 ratio for the wetland impacts. PLEASE NOTE: • Nationwide Permit 29, Regional Condition 4.1.1 states "Discharges in perennial stream, intermittent streams, and wetlands for stormwater management facilities are prohibited under this NWP." The impacts you proposed for Nationwide Permit 18 are related to the development of the subdivision and would not occur if the subdivision was not developed. You cannot circumvent the regional conditions of one Nationwide Permit (i.e., Nationwide Permit 29) by parsing out those impacts not allowed (i.e., 0.1 acre) and trying to permit them under a different Nationwide Permit (i.e., Nationwide Permit 18). All impacts related to the development of a residential community within the proposed project area will be considered under Nationwide Permit 29. Regional conditions are established by the District and approved by the Corps Division, to ensure that the implementation of the nationwide permit program in waters and wetlands of North Carolina are consistent with meeting the program's goals of streamlining the permit process for those activities that have no more than minimal impacts to the environment. General Condition 28 in Nationwide Permit 29 states the use of multiple Nationwide Permits if the loss of waters of the U.S. authorized by those permits does not exceed the acreage limit of the Nationwide Permit with the highest specified acreage limit. However, AND MOST IMPORTANTLY, as previously stated you cannot circumvent the regional condition of one Nationwide Permit by parsing out those impacts not allowed and trying to permit them under a different Nationwide Permit. Refer to NWP 29 Regional Condition 3.2 which states "For stream losses of 150 linear feet or less that require a PCN, the DE may determine, on a case -by -case basis, that compensatory mitigation is required to ensure that the activity results in minimal adverse effects on the aquatic environment. Please provide the information requested above in ONE consolidated response within 30-days of the date of this correspondence.
