9. NARRATIVE DESCRIPTION:
Project Setting
The project site is located on the west side of SR1326 at 252 Old Lupton Road in the
community of Whortonsville, Pamlico County and is adjacent to Brown Creek. The site is a 1.58
acre lot approximately 3' above NWL. A gravel drive leads from SR1326 on the east side of the
lot to asingle-family dwelling, which is located in the center of the lot. A garage is located to the
north of the dwelling structure and a small net house is located approximately 20' away from the
shoreline on the southwest side of the property. The lot is 160' wide along Old Lupton Road and
has 350' of shoreline. A manmade boat basin exists on the northern and southern boundaries of
the property. The boat basin at the southern boundary has been stabilized with a wooden
bulkhead and the remaining shoreline up to the northern boat basin is stabilized with rip rap
composed of brick rubble. The boat basin on the northern boundary is not stabilized and is
bordered by a 5'-10' wide marsh fringe. Cun•ently 1% of the area within the Estuarine Shoreline
AEC and 10% of the lot is covered with driveways and structures. The remaining uncovered
areas on the site are vegetated with sod grass, while several large pine and mixed hardwood trees
can be found on the lot. The neighboring lot to the north of the project site has asingle-family
dwelling on it with a dock with one boat slip at the end of the dock. "I'he nei~~hboring lot to the
south has an unoccupied single-family dwelling on it as well as a commercial marina with 46
boat slips and the owner has applied for a LAMA Major Permit to construct 12 condominiums
and fill in the boat basin which is shared with the current applicant's property. The majority of
the surrounding properties in the community are developed with single-family dwellings. The
Pamlico County Land Use Plan categorizes the area of the project as Rural with Services, with all
AEC's classified as Conservation.
The waters of Brown Creek in the vicinity of the project are classified as SA Ili~,h Quality
Waters and Nutrient Sensitive Waters by the EMC. Brown Creek is classified by the Division of
Marine Fisheries as a primary nursery area, but is closed to shellfish harvesting by the Shellfish
Sanitation Section of the Division of Environmental Health. The waters in the project area are in
the -3' to -5' below NLW range, with the channel portion of the creek bein, approximately -6'
below NWL. The channel is 430' offshore from the project site shoreline and Brown Creek is
1,000' wide in the project area. The bottom consists of fine to course sand. No submerged
aquatic vegetation was observed during the site visit. The applicant's consultant conducted a
SAV survey and indicated none was present in the project area.
Project Proposal
The applicants propose to construct asix-boat slip docking facility for their personal use. This
would be accomplished by constructing a 6'wide x 102.5' long pier to a 14'8" x 14'8" vazebo. The
gazebo would extend to a 5' x 109' `T' at the end of the pier. Two 5' x 20' finger piers would be
constructed at each end of the `T' and two 3' x 1~' finger piers would extend oft the 'T' between the
two outside finger piers to create a total of six boat slips. Nine 8" x 30' mooring pilings would be
placed 15' southwest of the finer piers for slips 2 thru 6 to create five 35' long x 14' wide boat
slips. Adjacent to slip number one, one 8" x 30' rnoorina pilings would be placed 1 ~' southwest of
the finger piers and two 8" x 30' mooring pilings would be placed 36' from the southwest of the

finger piers to create a 56' long x 23' wide boat slip. Slip number one would be constructed for the
applicants' 60' motorboat and slips two thru six would be used for their other powerboats which
range between 20' to 36'. The slips would be placed in water depths between -5' to -6' below NWL
and would extend out into Brown Creek for a total distance of 173'. The dock and pilings would be
16' from the adjacent riparian area to the northwest and 17' from the adjacent riparian area to the
southeast, and as proposed, the pier is similar in length to existing piers along this same shoreline.
The applicants also propose to construct a vinyl bulkhead an average of two feet waterward of the
existing normal water level/rip rap between the two boat basin areas, after removing the rip rap.
The bulkhead would then be installed landward of the Coastal and Section 404 Wetlands on the
south side of the boat basin on the northern boundary for a distance of 105' perpendicular to Brown
Creek. The bulkhead would then turn at a ninety degree angle and run parallel with Brown Creek for
a distance of 120' and connect to the existing wooden bulkhead at the boat basin on the southern
boundary of the property.
Anticipated Impacts
The bulkhead would result in 10 cubic yards of sand filling in 240 sq. ft. of shallow water
habitat and disturb 6,750 sq. ft. of high ground for backfill behind the bulkhead. The proposed
development is located outside of any Coastal or Section 404 Wetlands. The impervious surface
within DCM's 75' Estuarine Shoreline AEC would remain the same at approximately l~/o and the
impervious surface for the entire tract would remain unchanged at approximately 10%.
The dock facility would create six new boat slips in Brown Creek and would usurp 5,691 sq.
ft. of estuarine waters, public trust area, and shallow water habitat, of which 1,622 sq. ft would
be shaded. The platform area of the docks would encompass 1,037.5 square feet of the Public
Trust Area AEC along 350' of shoreline. The clocks would not extend beyond the existing piers
along the shoreline or create any navigational hazards. Bottom disturbance during boat slip
usage is not expected due to the existing water depths in the -5' to -6' range below NLW. A
localized and temporary increase in turbidity can be expected during the in-water portions of the
construction of the docks and the bulkhead.

This project entails the construction of a 6-slip dock facility and shoreline stabilization at 252
Old Lupton Road in Pamlico County, North Carolina. The subject property is presently
developed with asingle-family residential structure, garage structure and a s-nall net house. The
property covers a total area of approximately 1.58 acres of land and is located at 252 Old Lupton
Road in Pamlico County, North Carolina. The subject property abuts Browns Creek, a tributary
of Broad Creek and the Neuse River. A manmade basin exists on the northern and southern
sides of the property and will remain. [t is proposed that the existing wood bulkhead located on
the southern manmade basin not be replaced. (t is proposed that a vinyl sheet piling retaining
wall be constructed and connected to this wood retaining wall and extending along the shoreline
of Browns Creek and along one side of the manmade basin located on the north side of the
property. [t is proposed thaC a total of 225 linear feet of vinyl retaining wall be installed. The
existing brick and concrete rubble shoreline stabilization will be removed to the extent practical
without disturbing the bottom. Across section of the proposed shoreline stabilization is included
on the project plans.
It is proposed that a 6-slip docking Facility be constructed on Browns Creek as presented on the
project plans. Hydrographic and physical surveys have been completed on the Browns Creek
area, opposite shoreline, and channel location. Each of these features is identified on the project
plans. The proposed pier has been extended into Browns Creek a sufficient enough distance to
guarantee a five toot minimum water depth to all slips.
The proposed slip arrangei~~ent as depicted on the project plans are intended to provide docking
for the various sized boats owned by the property owners, Joseph C. and Kevin Avolis. The
maximum boat size to be stored at the facility will be 60 foot and the minimum size will be 20
foot.
It is proposed that a small gazebo area be constructed at the end of the pier walkway as presented
on the project plans.
In addition to a hydrographic survey being completed in the area, Coastal Management
Solutions, Inc. completed a Subaquatic Vegetation Stud~~ of the proposed project area. Sampling
was completed in the project area revealin~~ no indications ofsubaquatic vegetation. The full
text of the Coastal Resources Management, Inc. report is included with this project narrative.

Method of Construction
The 6-slip marina will be constructed utilizing conventional marine construction techniques.
Portions of the pilling system and decking material will be installed utilizing pile driving
equipment staged on the upland areas of the site. Where the extent of the project exceeds the ~~
reach of the pile driver from the upland areas of the site, a crane and barge will be utilized to ~ .
drive the piles from the water side of the project. Grading and tillings will occur to backfill the
bulkhead areas. All of this work will occur on upland areas of the site.

The Whortonsville Tract is located off Old Lupton Road fronting on Brown Creek,
tributary to Broad Creek in Pamlico County. The tract is approximately 1.6 acres and
the linear footage of shoreline is 126.7 along Brown Creek with an additional 115 feet
along a dredged upland canal to the east, and an additional 214 feet along a dredged
upland canal to the west. The vicinity and tract detail is shown on the attached plat
dated January 24, 2006
Description
Aerial photography from the Division of Coastal Management (2000) and bottom
substrate mapping from the Division of Marine Fisheries (attached) were reviewed as
base information. The DMF classifies the substrate at the project site as Subtidal Firm
Non-vegetated without Shell.
Methodology
The survey was undertaken on the morning of June 28, 2006. The sampling area
is shown on the attached plat. Transects perpendicular to the shoreline were
established every 12 feet and went to a distance of approximately 80 feet from the
shoreline to a depth of 4.5 to 5 feet. Each transect was walked and samples taken
every 10 feet with a rake, sampling to the right and to the left. As the depths of the
canals was 4-5 feet with a very soft bottom, samples were taken along the bulkhead
every 10 feet.

The shore is lined with bricks, concrete blocks and general debris along the full.-; ,
length. Debris has shifted into the creek for several feet and the bottom out to 10 to15~ ,~',;.
feet is a mixture of debris and firm substrate. In this area shell and shell fragments of
clams, mussels and oysters were observed with only a few live oysters. From 15 to 80 ~~~
feet out the bottom was soft to very soft, gently sloping to 4.5 to 5 feet in depth. No
shellfish or shell fragments were observed in this area.
No SAV vegetation, roots or rhizomes were observed at any sample location
along the transects or along the canal. While widgeon grass (Ruppia maritima) has
been observed in Brown Creek by the author during sampling to the north, none was
observed at this site.
Conclusion
It is the conclusion by this author that in the absence of SAV in the Creek and
canals, that there will be no impact to SAV or to SAV habitat by the construction of a
docking facility or filing of the canal.

Mr. Schecter holds a BS in Biology from East Carolina University, an MA in Biology
from UNC-Greensboro, and a Masters in Environmental Planning from UNC-Chapel
Hill. He has 35 years of experience in public and private sectors, including 21 years
with the Department of Environment and Natural Resources where he served as
Assistant Director of the Division of Planning and Assessment and was Director of the
N. C. Division of Coastal Management for eight years.
