8. PROJECT SUMMARY: The applicant has applied to fill 404 wetlands for the placement
of a single-family residence within the ORW Coastal Shoreline Area of Environmental
Concern of Bogue Sound. The applicant has also applied to build a private pier terminating
into Gales Creek.
9. NARRATIVE DESCRIPTION:
Project Setting
Mr. Tommy F. Scott owns a 0.6 acre tract of land at 147 Sound Blvd. accessed off
George Taylor Rd., which runs parallel to Highway 24 within Newport in Carteret County.
The site is adjacent to Gales Creek, however the 575' ORW Coastal Shoreline Area of
Environmental Concern (AEC) encompasses the lot from Bogue Sound. The elevation of the
tract is approximately sixteen feet above mean sea level near Sound Blvd. and falls to 1' above
mean sea level at the water. The lot is currently void of any development. The lot's orientation
is west to east as it approaches Gales Creek and spans 420' from Sound Blvd. to the waters
edge. The vegetation on the tract transitions from lawn grass on top of the ridge to cattails and
other rush species as you move down the hill and finally into coastal marsh including Spartina
patens, Distichlis spicata, Juncos roemerianus, and Spartina alterniflora. The 404-wetland
fringe averages 60' in width while the coastal wetland fringe averages 45' in width across the
subject property. The normal high water level approximates the waterward edge of the coastal
wetland where a small fringe of alterniflora is established. There is little sign of increased or
unexpected erosion along this marsh fringe.
There has been no previous permit action on this tract of land. The land is bordered to
the north by a residential lot containing a house above the federal and coastal wetland line.
The lot to the south has recently been developed with a retaining wall approximating the
wetland line and new single-family residence. This southern lot has recently been permitted a
200' pier from the waterward edge of the coastal wetlands with an associated boatlift and
wetslip. Mr. Scott's lot is located on Gales Creek, which is classified as SA-HQW and is
closed to shellfish harvesting. The area bordering the site is not a primary nursery area
however the waters above the Highway 24 bridge are considered as a primary nursery area.
The permit is necessary because of the tract's orientation to Bogue Sound, classified in this
area as SA-ORW, which extends the AEC 575' up Gales Creek. Bogue Sound is not a primary
nursery area but remains open to shellfish harvesting in the sound outside the mouth of Gales
Creek. The offshore waters in Gales Creek are shallow with no significant depth until you
cross an existing shoal approximately 150 feet offshore. At this distance the water depth at
highwater averages 2.5'-3'.
Project Description
The main focus and reason for the major permit is to fill the 1,776 ft2 area of 404
wetlands on the east side of the lot to develop a single family residence within the ORW
Coastal Shoreline AEC of Bogue Sound. The applicant has decided since his request would be
processed through a CAMA major permit to also propose a pier accessing Gales Creek. The
proposed residence would again require a 1,776 ft2 404-wetland area to be filled waterward
through the installation of a proposed retaining wall. The US Army Corp of Engineers

confirmed this wetland alignment on February 24, 2003. The house construction would require
2,500 ft2 of highground disturbance as well as future landscaping including tree and stump
removal. The dripline of the proposed house would be approximately 2,100 ft2 in footprint.
The proposed access drive would cover an additional 3,400 ft2 of impervious area. The
applicant has also proposed a deck 8' by 40' running east down the southside of the residence.
The proposed deck would terminate into a 15' by 20' platform on the rear of the residence.
The combined impervious coverage within the 575' ORW Coastal Shoreline (AEC) would be
less than 25%. The septic field for the future system would be located near Sound Blvd.
approximately 160' landward of the residence.
The applicant has also applied for the construction of a private pier into Gales Creek.
The pier would originate from the north side of the property within ten feet of the north
riparian corridor as it passes the normal high water level. Mr. Scott has obtained a written
waiver from the north property owner, Marie Staton. The pier would cross a combined area of
coastal wetlands and 404 wetlands totaling 85' by 6'. Of this span, 65' crosses 404 wetlands
while the balance of 20' crosses coastal wetlands at minimum 3' above the wetland substrate.
The pier would extend 77' into Gales Creek accessing a 16' by 20' "L" platform facing south.
Off the end of the "L" platform are 2 proposed mooring pilings positioned 15' further off
shore from the platform creating a single wetslip. The wetslip would be in water
approximately 1.5' deep at normal low water. The substrate at this distance appears be sandy
with no submerged aquatic vegetation, according to the applicant.
Anticipated Impacts
The project will involve the loss of 1,776 ft2 of 404 wetlands within the ORW Coastal
Shoreline (AEC). The associated house construction would disturb 7,623 ft2 of highground of
this roughly 5,500 ft2 would be covered with impervious surfaces and 620 ft'` shaded by the
deck. As proposed the pier would shade 390 ft2 of 404 wetlands and 120 ft2 of coastal
wetlands. The proposed structure would usurp an additional 1,082 ft2 of open water area,
which includes the development of the access, platform, and wetslip. The development of the
pier should not affect the navigation of the Creek as the traditionally used channel is located
approximately 275' east. The development of the retaining wall may help reduce future
sloughing of the existing highground.
