This application was complete on October 23, 2003 when we received notification that you had paid for the Public Notice for this project. This approval is only valid for the purpose and design that your described in your application. If you change your project, you must notify us and send a new application upon request. If the property is sold or transferred to a new owner, the new owner must be given a copy of this approval. If wetland fills (now or in the future) exceed one acre, then compensatory mitigation may be required. For this approval to be valid, you must follow the conditions listed below. 1. Appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of two manuals, either the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DEHNR Regional or Central Offices). The control practices shall be utilized to prevent exceedances of the appropriate turbidity water quality standard; 2. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural grade restored after the Division of Land Resources has released the project; 3. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 4. Measures shall be taken to ensure that the hydrology of any remaining wetland or isolated classified surface waters is not affected by the discharge. N. C. Any additional impact to isolated wetlands beyond the one-tenth of an acre approved herein must be accompanied with a revised site plan which will minimize the impact on the larger isolated wetland area. As noted in our October 20, 2003 approval, a plan which reconfigures the lot layout and open space layout would be needed for this additional approval. 6. All conditions of the October 20, 2003 401 Water Quality Certification and Neuse River Buffer Rules approval from DWQ are hereby incorporated by reference and must be complied with. Violations of any condition herein set forth may result in revocation of this approval and may result in criminal and/or civil penalties. If you do not accept any of the conditions of this approval, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. It is my understanding that has been a suggestion made by your office that a few of the lots located in Phase II, that back up to the large pond, be moved to the "open space" across the street in order to remove them out of an area that DWQ designated as wetlands and classify this area as "open space" instead. The original project layout was designed to meet both the Durham Zoning and Subdivision Ordinance design standards. Specifically the project was designed to satisfy open space standards for location, usability and function. In reference to The City of Durham Zoning Ordinance Section 4.B. 1.9.2.b, a minimum of 50% of "open space" must be outside of the "wet" areas, which the current layout conforms to. Moving the lots will actually be creating more "wet" open space and less usable open space. The development is already preserving a large portion of its site as open space, however very little of it is outside of the floodplain, wetland, pond, and creek areas. This area is set aside for active recreation. That is why having a centrally located space abutting the lots is required and is highly desirable. The Durham Subdivision Ordinance Section 5M requires that all projects make provisions for both active and passive recreation areas, including parks, greenways, and open space. All such land must satisfy applicable City/County site suitability standards with respect to location, accessibility, size configuration, slope, etc. The areas of this site that are located in environmental sensitive and regulated areas were not deemed acceptable to meet the standard for active recreational area. The only portion of the (over) Good Things Are Happening In Durham project that would satisfy the minimum standard is the area currently called out as common area/central open space located outside of environmentally sensitive areas. Any change to this area would seriously compromise the acceptability of this area to satisfy the active recreational space standards. Furthermore, the City of Durham Zoning Ordinance reference 15.3.4.1 and Section 17.8 states any change of this plan will require a rezoning and site plan resubmittal through the Durham Planning Department. This site as currently laid out was approved through rezoning with a "Development Plan" and received approvals from the Durham City Council. Revising the approved layout will require the "Development Plan" to be resubmitted and re-reviewed through the rezoning process with Durham Planning and approval by the Durham City Council. Keeping the lots out of the central open space is certainly the preferred layout. Craig Morrison 2330 Operations Drive Durham, NC 27705 Subject Property: Panther Creek subdivision APPROVAL of 401 Water Quality Certification and Neuse River Buffer Rules Dear Mr. Morrison: You have our approval, in accordance with the attached conditions, to impact less than one- tenth of an acre of isolated wetlands, 0.03 acres of non-isolated wetlands, 188 linear feet (117 feet of permanent impacts) of streams and 0.47 acres of protected stream buffers or waters for the purpose of constructing a road crossing and utility crossings at the proposed Panther Creek Parkway as you described in your application dated June 20, 2003 with revisions sent on July 11, 2003 and July 29, 2003 . After reviewing your application we have decided, this fill is covered by General Water Quality Certification Number 3402. This Certification allows you to use Nationwide Permit Number 39 when the Corps of Engineers issues it. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and those listed below. Conditions of Certification: 1.) No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, installation and operation and maintenance of such Best Management Practices: a. The erosion and sediment. control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. 3. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade ``restored within six months of the date that the Division of Land Resources has released the project. 4. Stormwater Management Plan (Phase I - No Further Approval Needed) The final, written stormwater management plans dated June 12, 2003, must be implemented and the stormwater management facilities shall be constructed and operational before any permanent building is occupied at the. subject site. The structural stormwater practices as approved by this Office as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. 5. Diffuse Flow (Review Phases II, and III) An additional condition is that all constructed stormwater conveyance outlets shall be directed to flow in a diffuse manner at non-erosive velocities through the entire protected stream buffers without re- concentrating. If this is not possible it may be necessary to provide stormwater facilities that are considered to remove nitrogen. Additionally, a stormwater management plan for this project shall be provided to this Office before any development activities begin in Phase II and I I I are conducted. The plan shall specify all stormwater discharge points, plan details, and calculations to indicate that diffuse flow through the protected buffers or nitrogen removal as described above will be achieved. 6. Culvert Installation: The culverts required for this project shall be installed in such a manner that the original stream profiles are not altered. Existing stream dimensions (including the cross section dimensions, pattern, and longitudinal profile) are to be maintained above and below locations of each culvert. The culverts shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re- established or, if the pipes installed in a perched manner, the pipes shall be removed and re-installed correctly. The culvert(s) shall not be installed in such a manner that will cause aggradation or erosion of the stream up or down stream of'the culvert(s). Existing stream dimensions (including the cross section dimensions, pattern and longitudinal profile) are to be maintained above and below locations of each culvert. As such, it is required that you provide the plans with adequate details that indicate that the current stability of the stream will be maintained or enhanced. You must receive written approval from this Office for the above plans before the culvert(s) is installed. The culvert(s) must be installed according to the approved plans. The establishment of native, woody vegetation and other soft stream bank stabilization techniques must be used where practicable instead of rip rap or other bank hardening methods; If rip-rap is necessary, it shall not be placed in the stream bed, unless specifically approved by the Division of Water Quality. Installation of culverts in wetlands must ensure continuity of water movement and be designed to adequately accommodate high water or flood conditions. 7. Isolated Wetlands: Additional written approval is required from DWQ for any additional impact to isolated wetlands beyond those needed for this road crossing. The applicant is hereby notified that DWQ may not approve any impact to isolated wetlands beyond the one-tenth acre for deemed permitted activities for this project. Therefore, reconfiguration of the lot layout and open space layout may be needed for this subdivision if minimization of the impact on the isolated wetland is needed. The impact on these isolated wetlands for this road crossing is "deemed permitted" since the impact is less than one-tenth of an acre. Therefore the following conditions must be met for this impact to continue to be considered as "deemed permitted: a. Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or coastal Area Management Act Permit. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. The structural stormwater practices as approved by this Office as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. $$) Diffuse Flow (Review Phases II and III) An additional condition is that all constructed stormwater conveyance outlets shall be directed to flow in a diffuse manner at non-erosive velocities through the entire protected stream buffers without re-concentrating. If this is not possible it may be necessary to provide stormwater facilities that are considered to remove nitrogen. Additionally, a stormwater management plan for this project shall be provided to this Office before any development activities begin in each Phase, II and III, are conducted. The plan shall specify all stormwater discharge points, plan details, and calculations to indicate that diffuse flow through the protected buffers or nitrogen removal as described above will be achieved. $$) Culvert Installation The culverts required for this project shall be installed in such a manner that the original stream profiles are not altered. The culverts shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re-established or, if the pipes installed in a perched manner, the pipes shall be removed and re-installed correctly. The culvert(s) shall not be installed in such a manner that will cause aggradation or erosion of the stream up or down stream of the culvert(s). Please refer to the attached USGS map, which displays the location of the proposed project. S&EC conducted a detailed wetland delineation and Neuse River Buffer evaluation on January 26, 2003. Mr. Todd Tugwell of the USACE made a site visit to verify the delineation on February 11, 2003. Mr. Steve Mitchell of the NC-DWQ made a site visit and confirmed the buffers on February 10, 2003. On June 11, 2003 Mr. Bob Zarzecki of the NC-DWQ revisited the site and determined that an isolated pond/wetland is not subject to the buffer rules. A copy of his letter is attached. The applicant requested a detailed wetland delineation and buffer evaluation on the property prior to site plan development in order to avoid jurisdictional features and riparian buffers to the maximum extent practicable. Temporary impacts include 71 linear feet of perennial channel and 7,421 sq. & of riparian buffer due to the installation of water and sewer lines. Construction of the proposed sewer outfall and water line will proceed in accordance with all general conditions stated within Nationwide Permit 12. For this reason, and because the stream crossing is perpendicular and the construction corridor is less than 40 ft., this project does not require written concurrence from the NC-DWQ (condition 1 of state general certification for NWP 12). The proposed roadway will impact approximately 0.03 acres of jurisdictional wetlands 138 linear feet of perennial stream channel and 50 linear feet of intermittent channel. We are also requesting approval to fin 0.43 acres of isolated wetlands in order to comply with the City of Durham open space requirements and for the construction of an access road. These impacts are elaborated upon within the attached PCN form and are shown on the attached inset impact maps. The proposed road crossing is necessary to gain access from the southern portion of the property from Burton Road to the northern portion of the property. Although the road crossing will impact a segment of intermittent channel as well as perennial channel, the road alignment was constrained due to the presence of wetlands and a pond to the east. The applicant has minimized impacts through the use of headwalls at the proposed crossing. Following construction, the applicant will maintain 50-foot riparian buffers on the pond and 100-foot buffers on the stream channels as well as employ BMP devices to preserve water quality. Stormwater will be treated or released as sheet flow (i.e. diffuse) before entering the buffers. Moreover, because this site is located within a watersupply watershed, Durham regulations will not allow >24% impervious within the site. In fact, the overall percent impervious is 10.2%. Please note that the stormwater plans have not been finalized for Phases II and III. We would like to request that DWQ issue the permit with the condition that construction for Phases II and III will not begin until the stormwater plan has been approved by DWQ for these phases. The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the requirements for notification (0.10 acre). The proposed road is necessary to access the entire property. Because the applicant has minimized impacts to the maximum extent practicable and will maintain riparian buffers as per the Neuse Buffer Rules, S&EC believes further compensatory mitigation should not be required by the USACE. NC-DWQ's current policy requires written concurrence for stream impacts of greater or equal to 150 linear feet of stream length per project. We request written concurrence that the project complies with the 401 Water Quality Certification associated with Nationwide Permit 39. NC-DWQ's current policy does not require wetland or stream mitigation for perennial stream channel impacts below 1 acre and 150 linear feet per project. Because the total permanent impacts to perennial channels is less than 150 feet and a total of 0.03 acres of permanent impacts to wetlands are proposed, we do not believe that wetland nor stream mitigation should be required by NC-DWQ. Mr. Steve Mitchell of the NC-DWQ made a site visit and confirmed the buffers on February 10, 2003. A copy of Mr. Mitchell's letter is attached. On June 11, 2003 Mr. Bob Zarzecki of the NC-DWQ revisited the site and determined that an isolated pond/wetland is not subject to the buffer rules. V. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. A detailed delineation was conducted in order to develop a site plan that minimized impacts. However, a large pond and a perennial channel bisect the property, necessitating a creek crossing. In order to minimize impacts the applicant has utilized headwalls at the proposed impact area. In an attempt to maintain water quality the applicant will provide 50-foot riparian buffers adjacent to the pond and 100-foot buffers adjacent to the stream channels. In addition the ?!pplicant will utilize BMP devices for water treatment. VII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of Page 5 of 8 aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncNvetlands/stm-igide.hti-nl. 1. Project No. 03-7568 Panther Creek [03-04-02, 27-6-(1), WS-IV (water supply) NSW (nutrient sensitive)] On-Site Determination for Applicability to the Neuse River Riparian Area Protection Rules (15A NCAC 2B .0233) Dear Mr. Preuninger: On June 11, 2003, at your request I conducted an on-site determination to review an "isolated pond" located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The feature is labeled on the attached map initialed by me on June 12, 2003 as "Isolated Pond / Appeal Call". Division of Water Quality (DWQ) Staff from the Raleigh Regional Office (RRO) had previously conducted an on-site determination of the feature as described within their letter to you dated April 1, 2003. You requested an appeal of their determination as provided within 15A NCAC 02B .0233(3)(a). At your request, I conducted an appeal of their determination as stated above. The feature appeared to be an old pond that had been drained years ago based on the fact that trees (approximately 5 inches dbh) were growing within the man-made channel cut through the historic dam. The feature appeared to have a direct connection to the larger stream through the channel cut through the historic dam. The feature contained mostly vegetated wetlands (approximately 75%) and some open water (approximately 25%). 1 was unable to define an "intermittent or perennial stream". I determined the feature to be a "wetland" and not a surface water (e.g., intermittent stream, perennial stream, lake, pond or estuary). Based on my evaluation, the DWQ has determined that the feature labeled as "Isolated Pond / Appeal Call" is a wetland and not subject to the Neuse Buffer Rule. This determination shall replace the determination originally performed by the Regional Office. The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning this property. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the State. Wetlands or other Waters of the U.S. may exist on the property. We also request written concurrence from the North Carolina Division of Water Quality that the project complies with the 401 Water Quality Certifications associated with Nationwide Permit 39. We would also like to request authorization for impacts to isolated wetlands. A Pre- construction Notification Application (PCN) is attached, which includes an agent authorization form. The proposed project consists of impacts from the construction of access roads for a residential housing development. The project is located on the east side of Burton Road (SR 1818) approximately 3000 feet south of the intersection of Gorman Street (SR 1670) and Burton Road. The project boundary is bounded on the south by Panther Creek and is approximately 85 acres in size, and consists primarily of pine and hardwood stands. Mr. Todd Tugwell of the USACE made a site visit to verify the delineation on February 11, 2003. Mr. Steve Mitchell of the NC-DWQ made a site visit and confirmed the buffers on February 10, 2003. On June 11, 2003 Mr. Bob Zarzecki of the NC-DWQ revisited the site and determined that an isolated pond/wetland is not subject to the buffer rules. A copy of his letter is attached. The applicant requested a detailed wetland delineation and buffer evaluation on the property prior to site plan development in order to avoid jurisdictional features and riparian buffers to the maximum extent practicable. The proposed roadway will impact approximately 0.03 acres of jurisdictional wetlands 138 linear feet of perennial stream channel and 50 linear feet of intermittent channel. We are also requesting approval to fill 0.43 acres of isolated wetlands in order to comply with the City of Durham open space requirements and for the construction of an access road. These impacts are elaborated upon within the attached PCN form and are shown on the attached inset impact maps. The proposed road crossing is necessary to gain access from the southern portion of the property from Burton Road to the northern portion of the property. Although the road crossing will impact a segment of intermittent channel as well as perennial channel, the road alignment was constrained due to the presence of wetlands and a pond to the east. The applicant has minimized impacts through the use of headwalls at the proposed crossing. Following construction, the applicant will maintain 50-foot riparian buffers on the pond and 100-foot buffers on the stream channels as well as employ BMP devices to preserve water quality. Stormwater will be treated or released as sheet flow (i.e. diffuse) before entering the buffers. Moreover, because this site is located within a watersupply watershed, Durham regulations will not allow >24% impervious within the site. In fact, the overall percent impervious is 10.2% The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the requirements for notification (0.10 acre). The proposed road is necessary to access the entire property. Because the applicant has minimized impacts to the maximum extent practicable and will maintain riparian buffers as per the Neuse Buffer Rules, S&EC believes further compensatory mitigation should not be required by the USACE. NC-DWQ's current policy requires written concurrence for stream impacts of greater or equal to 150 linear feet of stream length per project. We request written concurrence that the project complies with the 401 Water Quality Certification associated with Nationwide Permit 39. NC-DWQ's current policy does not require wetland or stream mitigation for perennial stream channel impacts below 1 acre and 150 linear feet per project. Because the total permanent impacts to perennial channels is less than 150 feet and a total of 0.03 acres of permanent impacts to wetlands are proposed, we do not believe that wetland nor stream mitigation should be required by NC-DWQ. Please note that following construction the site will contain 10.2% impervious surface. Therefore, we do not believe that this project requires a pre-approved stormwater plan. The DWQ's current policy requires applicants to avoid and minimize isolated wetland impacts to the maximum extent practicable and compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the thresholds for mitigation (1 acre). In addition the applicant will utilize BMP devices for water treatment. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. The feature appeared to be an old pond that had been drained years ago based on the fact that trees (approximately 5 inches dbh) were growing within the man-made channel cut through the historic dam. The feature appeared to have a direct connection to the larger stream through the channel cut through the historic dam. The feature contained mostly vegetated wetlands (approximately 75%) and some open water (approximately 25%). 1 was unable to define an "intermittent or perennial stream". I determined the feature to be a "wetland" and not a surface water (e.g., intermittent stream, perennial stream, lake, pond or estuary). Based on my evaluation, the DWQ has determined that the feature labeled as "Isolated Pond / Appeal Call" is a wetland and not subject to the Neuse Buffer Rule. This determination shall replace the determination originally performed by the Regional Office. The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning this property. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the State. Wetlands or other Waters of the U.S. may exist on the property. You should contact the U.S. Army Corps of Engineers (USACE) to ensure compliance with wetland regulations. in addition, as stated above I believe that the feature is a wetland. You stated the USACE delineated the feature as "isolated". An evaluation of the stream features present on the property was performed on February 10, 2003 to determine whether or not the site would require compliance with the Neuse Buffer Rules. The features represented on the Durham County Soils and the Northeast Durham USGS topographic maps were evaluated to determine their subjectivity to the Rule. It was determined that there are several features present on this property that are subject to the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code. 15A:2B.0233. Panther Creek is the main feature and runs along the southeastern property line, Feature A along 'the northern property line, Feature D, flowing from the north-northwest and forming the large pond prior to connecting with Panther Creek, and a small pond to the north of the large pond were determined to be subject to the Rule and therefore subject to the fifty-foot riparian protection none.
