The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the permit plans, which are a part of this permit. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 3. All backfill materials will be obtained from a highground source and confined landward of the permitted bulkhead. 4. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands are not authorized. -2- 5. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 6. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. Box 347 Elizabeth City, NC, 27907 APPROVAL of 401 Water Quality Certification with Additional Condition Dear Mr. Overman: You have our approval, in accordance with the attached conditions, to fill or disturb 0.59 acre of. Public Trust Area/Estuarine Waters and wetlands in order to construct a bulkhead, walkway, sidewalk, drainage line, and to fill and grade a property at the northeast corner of Water Street and Fearing Street on the Pasquotank River, as described in your application received by the Division of Water Quality on June 3, 2003. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3400, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions.. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed; If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. PROJECT SUMMARY: The applicant proposes to construct a bulkhead, a brick shoreline walkway, a brick sidewalk, a drop inlet drainage line, and to fill and grade property located at the northeast corner of Water Street and Fearing Street, on the Pasquotank River. CITY OF ELIZABETH CITY FIELD INVESTIGATION REPORT: PAGE #2 Site Description The proposed development site is a .57 acre vacant waterfront lot located in the heart of Elizabeth City at the corner of Water Street and Fearing Street. The property includes the waterward end of Fearing Street where the street ends at the Pasquotank River. Two concrete slabs remain on the site that were foundations for buildings. The Division of Coastal Management once occupied one of the buildings. Both buildings were removed several years ago. Most of the area of the property is vegetated with grass and is maintained by the City as a park. The property has an elevation that ranges from 5 ft above normal water level (NWL) near Water Street to 2 ft above NWL along the shoreline. The property has approximately 162 ft of shoreline along the Pasquotank River. The shoreline has a relic bulkhead with some relic riprap/demolition material along the waterline. Adjacent property consists of a Condominium Complex with a steel sheet pile bulkhead to the north and a city dock with 15 slips and a 10 ft wide brick shoreline walkway to the south. The city dock known as "Mariners Wharf" has a steel sheet pile bulkhead for shoreline protection. A restaurant and retail shops occupy the next adjacent waterfront building. The waters of the Pasquotank River in this area are classified as SB by the Division of Environmental Management and as closed to shellfishing. The water depths in the project area are -20 ft or better. Development Proposal The City of Elizabeth City recently acquired this property and is proposing to develop the property in a way that is similar to the "Mariners Wharf". The applicant proposes to construct a bulkhead of steel sheet pile that connects at the corner of the existing bulkhead of the City property and runs northerly to the existing bulkhead of the condominiums. The bulkhead will be approximately 10 ft waterward of NWL where it connects to the condominium bulkhead and will average approximately 5.6' waterward of the NWL and will extend a maximum of 10 ft. This alignment is necessary to allow the construction of the bulkhead without the requirement of excavating the old debris along the shoreline. The backfill for the bulkhead will be sloped away from the water and storm water will be drained from the property via a drop inlet. After constructing the bulkhead, the applicant proposes to construct a 10 ft wide shoreline brick walkway to match the existing walkway at "Mariners Wharf". All existing concrete slabs will be removed. The applicant proposes to construct an eight ft wide brick walkway along the northern property line from Water Street to the proposed shoreline walkway. A 20' x 30' brick bandstand is proposed to be connected to the proposed walkway approximately midway on the lot. Five picnic tables with concrete pads 7' x 10' are proposed to be located on the property. CITY OF ELIZABETH CITY FIELD REPORT PAGE #3 Anticipated Impacts The construction of the bulkhead in the proposed alignment will result in approximately 910 sq ft of Public Trust Area and Estuarine Waters Areas of Environmental Concern (AECs) being filled. Approximately 1620 sq ft of Estuarine Shoreline AEC will be covered by the shoreline brick walkway and 360 sq ft of Estuarine Shoreline AEC will be covered by the brick walkway to Water Street. The drop inlet will be located in the Estuarine Shoreline. Approximately 2475 sq ft of impervious material will be removed from the Estuarine Shoreline AEC. It is anticipated that the entire lot will be disturbed and need grading after the development is complete, approximately 25810 sq ft. Temporary water turbidity will occur during construction. The 0.57-acre tract is located between Water Street and the Pasquotank River and is directly north of Mariner's Wharf (a city owned water front open space/dock/park). The site located in the City of Elizabeth City's Central Business District which has no setback limitations. The Parks and Recreation Department is planning to redevelop the site as a public park to become part of Mariner's Wharf. The site has been cleared of existing buildings and only the two concrete building foundations remain. To utilize the site for public access, the waterfront must be stabilized with new bulkhead. The existing wooden bulkhead is approximately 75 years old and had deteriorated severely. The proposed construction includes the demolition of the building pads and some asphalt parking in the southeast corner of the site and construction of approximately 161 linear feet of 50' steel sheet pile bulkhead and brick sidewalks. The steel sheet pile bulkhead is the same as that used directly north and south of this site. Stormwater runoff from Water Street and Mariner's Wharf have historically crossed the existing parking lot on this site and drained directly to the Pasquotank River. Due to the grades along Water Street, it is not feasible to redirect any of this stormwater away from the Pasquotank River. Our design proposes to collect this existing runoff in a new curb inlet constructed along the edge of the parking. The water will discharge from the curb inlet to the river through a pipe through the bulkhead. Stormwater from the site will sheet flow across grassed surfaces to a drop inlet which will be connected to the curb inlet and drain to the river.
