APPROVAL of 401 Water Quality Certification with Additional Condition
Dear Mr. Sheffield:
You have our approval, in accordance with the attached conditions, to usurp 1.8 acres of Estuarine Waters of the
Trent River in order to expand an existing marina at 100 Middle Street in New Bern, Craven County, as described in your
application received by the Division of Water Quality on May 30, 2003. After reviewing your application, we have
determined that this fill is covered by General Water Quality Certification Number 3400, which can be downloaded from our
web site at htti)://h2o.enr.state.nc.us/ncwetiands . This Certification allows you to use your CAMA Permit when issued by
the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go
ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply
Watershed and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires
unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us a new application for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC.2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and the additional conditions listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in
the 401 Certification has been completed;
2. The relocated fuel dock and dispensing apparatus must be compliant with the Environmental Protection
Agency's Spill Prevention Control and Countermeasure Program.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,
N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

Dear Mr. Huggett:
Reference the application of Trent-Neuse Hotels, LLC, for a Department of the Army
(DA) permit to expand an existing marina, located at the New Bern Sheraton Grand Hotel,
at 100 Middle Street, adjacent to the Trent River, in the City of New Bern, Craven County,
North Carolina.
The Federal agencies have completed review of the proposal as presented by the application
and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
permit plans, which are a part of this permit.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized,
or if, in the opinion of the Secretary of the Army or his authorized representative, said structure
or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate,
or alter the structural work or obstructions caused thereby, without expense to the United States.
No claim shall be made against the United States on account of any such removal or alteration.
3. This permit does not authorize the interference with any existing or proposed Federal
project, and the permittee will not be entitled to compensation for damage or injury to the
authorized structure or work, which may be caused from existing or future operations undertaken
by the United States in the public interest.

4. No attempt will be made by the permittee to prevent the full and free use by the public
of all navigable waters at or adjacent to the authorized work. Use of the permitted activity
must not interfere with the public's right to free navigation on all navigable waters of the United
States.
5. If the display of lights and signals on the authorized structure is not otherwise provided
for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed
and maintained by and at the expense of the permittee.
6. The permittee will maintain the authorized work in good condition and in conformance
with the terms and conditions of this permit. The permittee is not relieved of this requirement
if he abandons the permitted activity without having it transferred to a third party.
7. The activity will be conducted in such a manner as to prevent a significant increase
in turbidity outside the area of construction or construction-related discharge. Increases
such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout
waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's
or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout
waters, are not considered significant.

I see no problems with this project, (Trent Neuse Hotels LLQ, the water is too deep to impact SAV,
probably make a lot of cover for bait fish..... striper season is coming up... Issue w/ condition that relocated
fuel dock and dispensing apparatus is compliant with EPA/SPCC measures.

9. NARRATIVE DESCRIPTION:
Project Setting
The Division of Coastal Management permitted the New Bern Sheraton Hotel complex
back in 1985 through CAMA Major Permit #74-85. Numerous modifications, extensions
and additional permits have authorized the structures that exist today. CAMA Major Permit
#106-97 authorized the construction of two more docks with 71 additional slips. The permit
expired without the project being constructed. This is a proposal to construct those same two
docks.
A hotel, inn and full service marina exist on the site. The entire shoreline is
bulkheaded and there are numerous amenities and structures associated with the complex.
The marina has four docks with 128 slips, a fuel dock with 5 slips and a wave attenuator
with room for 14 slips -- for a total of 147 slips. A marine pumpout is located at the fuel
docks.
The Norfolk Southern Corporation abuts the upstream side of the property where the
Norfolk & Southern Railroad trestle crosses over the Trent River. The railroad trestle is
currently approximately 235' from "B" dock. The New Bern Convention Center abuts the
property on the downstream side. The wave attenuator essentially delineates the marina
basin to the east while the railroad trestle forms a limiting boundary to the west. The wave
attenuator according to the plat establishes a pierhead line established in 1985 and revised in
1988. The narrowest restriction of the Trent at this site is approximately 1185' in width.
According to the applicant, water depths average around -6' MLW around dock "F" and -
8' around proposed docks "E" and "A". This section of the Trent River is classified as SB
Sw NSW and is closed to shellfishing. There appear to be no SAVs in the area.
Project Description
The applicant proposes an expansion of the existing marina by installing two
additional floating docks and 71 additional slips. Dock "A" would be 7' wide and 630' long
and would create 54 slips involving 30 forty-foot slips, 13 thirty five-foot slips, and 11
thirty-foot slips. Dock "E" would be 7' wide and 218' long and would create another 17
slips involving 16 fifty-foot slips and one 35-foot slip. Dock "F" would make permanent an
existing 7' X 90' temporary floating dock. Forty 4' wide finger piers would provide access
to the slips. The applicant also proposes to place one "No Wake" sign at the end of the "A"
dock, however no formal "No Wake Zone" of the Public Trust Areas is being proposed.
Anticipated Impacts
The project as proposed would usurp approximately 78,573 ft2 of Public Trust Waters
within the existing "basin-area" as delineated by the existing wave attenuator. Of that total
amount of impact area, 12,853 ft2 would be shaded. The project would squeeze in another
dock between "B" dock and the railroad trestle and would affect navigation in that
