For velocities greater than 15 fps, it is strongly recommended that measures be considered which will protect the sewers and
manholes from erosion. For velocities greater than 20 fps, erosion control measures must be specified.

Regidred Items
a. One original and one copy of the completed and appropriately executed application form. If modifications to the form are
required as a result of additional information requests by the Division, the additional information must be transmitted under
the signature of the applicant and the actual modification must be initialed by the NC Professional Engineer.
b. Two (2) sets of detailed plans and specifications signed and sealed by a North Carolina Professional Engineer. The plans must
include a general location map, a plan view of the sewer extension, a profile of the sewer extension, and must show the
proximity of the sewer extension to other utilities and natural features. Specifications may be omitted for delegated
authorities. Each sheet of the plans and the first page of the specifications must be signed and sealed. Two (2) copies of the
existing permit if a modification. The plans and specifications must not contain phrases (such as: FOR REVIEW ONLY,
NOT 1?0R CONSTRUCTION, etc.) that indicate that they are anything other than final plans and specifications. However,
the plans and specifications may contain: FINAL DESIGN - NOT RELEASED FOR CONSTRUCTION.
C. The appropriate permit processing fa, in accordance with 15A NCAC 2H .0205(c)(5). The fee for sewer extensions for
nondelegated municipalities is $400. The fee for sewer extensions for delegated municipalities (applies only to those
governmental jurisdictions that have specific delegation review authority, as granted by the Environmental Management
Commission) is $200. Name changes without other modifications are $100.
d. If the owner/authority of the wastewater treatment facility (WWTF) that will be accepting the wastewater flow from this
project is different from the applicant of the project, then a letter must be provided from the owner/authority of the WWTF
specifying the volume of flow that will be accepted. The letter should be a recent letter and should refer to the project by the
same name as that identified on the application and the plans/specifications.
e. If the application is being submitted in the name of a privately owned public utility, evidence must be submitted from the
Utilities Commission which demonstrates that the utility is authorized to hold the franchise for the area to be served. In the
case of contiguous service areas, evidence must be provided from the Utilities Commission acknowledging these area are
covered under an existing franchise.
L A properly executed Operational Agreement (original and one copy - form provided by DEM) must be submitted if the sewer
extension will be serving single family residences, condominiums, mobile homes, or town houses and if the subject sewer
extension is owned by the individual residents, a homeowners association, or a developer.
g. A cover letter, which briefly describes the project, should be included with each application package. If necessary for clarity,
feel free to include attachments to the application form. Such attachments will be considered as part of the application and
should be numbered to correspond to the section to which they refer.
h. AlI materials and fees submitted in support of this request for a permit become the property of the Division of Environmental
Management; therefore, if the permit is not issued for any reason, the Division will return submitted materials only at its
option.

The Permits and Engineering Unit has completed a preliminary engineering review of the
subject application.
The following items must be addressed before we can complete our review:
1. The submitted application states there will be 25 people per office lot, to
determine the expected wastewater flow for this project. Please provide an
explanation and any documentation on how this number of people was
determined. State regulations are such that the Division must determine if the
proposed flow is reasonable in order to protect the receiving treatment plant
and collection system capacity. The requested explanation should include the
type of businesses expected for these proposed lots and how the number of
employees is estimated.
2. The submitted plans are not stamped by a North Carolina Registered
Professional Engineer, as required by State Regulations. Please provide a P.E.
Stamped set of plans, so that they may be approved upon issuance of a permit.
3. Sheet 2C of the submitted plans shows that some of the PVC sewer line
proposed does not have the required minimum cover near manhole #7. As this
cover is to protect the sewer pipe for long term use, the 3 feet of minimum
cover must be measured from the surface elevation of the final elevation
proposed. Please provide a revised sheet 2C showing your solution to this
problem.

The Permits and Engineering Unit has completed a preliminary engineering review of the
subject application.
The following items must be addressed before we can complete our review:
1. Please find the enclosed Operational Agreement. It is not clear if TWM
Realty Investors, Inc., will be the manager of the subject industrial park or
selling the subject subdivision lots. The Division must ensure that some one
will be responsible for care and maintenance of the the subject sewer
collection system. If the subdivision lots are not to be sold (i.e. TWM
Realty Investors, Inc. will continue to own and manage the sewer system),
then the Operational Agreement is not needed; please provide confirmation
of continued ownership in writing. If the lots are to be sold and TWM
Realty Investors, Inc. will no longer manage the sewer system, then the
attached Operational Agreement needs to be completed and signed and
returned to this Office to complete the permit review process.
Refer to the subject permit application number when providing the requested information.

You have resubmitted an application and revised drawings for the Division's consideration with
reference to the sewer collection facilities designed to serve Pinehurst Heritage Subdivision. I felt it
necessary to respond to you concerning this application and outline to you the Division's problem
associated with the processing of this application. We originally received the application for this project on
August 25, 1994 and on November 30, 1994, the permit was issued authorizing the construction of the
collection facilities. This permit was requested and issued in the name of TWM Realty.
In your letter dated December 5, 1994, and received by this Division on December 7, 1994, you
indicated that you had enclosed a revised application and plans that were to be used for review and
approval and the letter requested that the permit be issued in the name of Moore County Water and Sewer
Authority. At that point in time, the Division's action on this application had finished and the permit
issued. Therefore, we returned this submittal indicating that these changes would now require a formal
submittal with accompanying fee. On January 9, 1995, you have resubmitted this application without the
appropriate fee to the Division for review. Since the review has been concluded on the original application
and the changes were not requested by you until after the permit issued, the Division cannot process this
application. In addition, both submittals (December 5, 1994 and January 9, 1995) exclude permission
from the current permittee to transfer the permit to Moore County. Since a final action has been taken on
this application and TWM Realty obtained the permit, they will have to give Moore County permission to
request and modify the existing permit.
I have enclosed and am hereby returning your application and plans. Without the necessary
information needed to process this application, the Division cannot consider this application complete for
processing. Additionally, please be advised that if the modifications are in fact to be constructed, then a
formal request for permit modification will have to be forwarded to the Division. Any construction of
facilities not in accordance with the stamped set of approved plans and specifications will constitute
construction in violation of the existing permit and is enforceable through the Environmental Management
Commission. If you have any questions regarding this letter or the return of this application, please

On Nov. 30, 1994 a permit was issued for the above job. Since then we have found

construction and operation of approximately 2,255 linear feet of 8 inch gravity sewer to serve 13 office
building lots of the Pinehurst Heritage Subdivision and the discharge of 8,125 GPD of collected domestic
wastewater into the Moore Water & Sewer Authority's existing sewerage system, pursuant to the
application received August 25, 1994, and in conformity with the project plan, specifications, and other
supporting data subsequently filed and approved by the Department of Environment, Health and Natural
Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the
following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes described in the
application and other supporting data.
3. The facilities must be properly maintained and operated at all times.
4. The sewage and wastewater collected by this system shall be treated in the Moore County Regional
Wastewater Treatment Facility prior to being discharged into the receiving stream.
5. This permit is not transferable. In the event there is a desire for the facilities to change ownership,
or there is a name change of the Permittee, a formal permit request must be submitted to the
Division of Environmental Management accompanied by an application fee, documentation from
the parties involved, and other supporting materials as may be appropriate. The approval of this
request will be considered on its merits and may or may not be approved.

6. ' Construction• of the sewers, pump station(s) -and force main shall be scheduled so as not to
interrupt service by the existing utilities nor result in an overflow or bypass discharge of
' wastewater to the surface waters of the State.
7. Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been
installed in accordance with this permit, the approved plans and specifications, and other
supporting materials. Mail the Certification to the Water Quality Permits and Engineering Unit,
P.O. Box 29535, Raleigh, NC 27626-0535.
8. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a
minimum of five years from the date of the completion of construction.
9. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee
to an enforcement action by the Division of Environmental Management, in accordance with North
Carolina General Statute 143-215.6(a) to 143-215.6(c).
10. The issuance of this permit does not preclude the Permittee from complying with any and all
statutes, rules, regulations, or ordinances which may be imposed by other government agencies
(local, state, and federal) which have jurisdiction.
11. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate convective action, including those as may be required
by this Division, such as the construction of additional or replacement wastewater collection
facilities.
12. Noncompliance Notification:
The Permittee shall report by telephone to the Fayetteville Regional Office, telephone number 910/
486-1541 as soon as possible, but in no case more than 24 hours or on the next working day,
following the occurrence or first knowledge of the occurrence of either of the following:
a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable
of adequate wastewater transport, such as mechanical or electrical failures of pumps, line
blockage or breakage, etc.; or
b. Any failure of a pumping station or sewer line resulting in a by-pass directly to receiving
waters without treatment of all or any portion of the influent to such station or facility.
Persons reporting such occurrences by telephone shall also file a written report in letter form within
15 days following first knowledge of the occurrence. This report must outline the actions taken or
proposed to be taken to ensure that the problem does not recur.
13. This permit shall become voidable unless the agreement between Moore Water & Sewer Authority
and TWM Realty Investors, Inc. for the collection and final treatment of wastewater is in full force
and effect.
14. If at any time, the wastewater flow volume made tributary to this wastewater collection system is
found or expected to exceed the value permitted herein, a modification shall be requested for this
permit from the Division of Environmental Management to properly allocate the subject wastewater
flow.

authorities. Each sheet of the plans and the first page of the specifications must be signed and sealed. Two (2) copies of the
existing permit if a modification. The plans and specifications must not contain phrases (such as: FOR REVIEW ONLY,
NOT FOR CONSTRUCTION, etc.) that indicate that they are anything other than final plans and specifications. However,
the plans and specifications may contain: FINAL DESIGN - NOT RELEASED FOR CONSTRUCITON.
C. The appropriate permit processing fee, in accordance with 15A NCAC 2H .0205(c)(5). The fee for sewer extensions for
nondelegated municipalities is $400. The fee for sewer extensions for delegated municipalities (applies only to those
governmental jurisdictions that have specific delegation review authority, as granted by the Environmental Management
Commission) is $200. Name changes without other modifications are $100.
d. If the owner/authority of the wastewater treatment facility (WWTF) that will be accepting the wastewater flow from this
project is different from the applicant of the project, then a letter must be provided from the owner/authority of the WWTF
specifying the volume of flow that will be accepted. The letter should be a recent letter and should refer to the project by the
same name as that identified on the application and the plans/specifications.
e. If the application is being submitted in the name of a privately owned public utility, evidence must be submitted from the
Utilities Commission which demonstrates that the utility is authorized to hold the franchise for the area to be served. In the
case of contiguous service areas, evidence must be provided from the Utilities Commission acknowledging these area are
covered under an existing franchise.
f. A properly executed Operational Agreement (original and one copy - form provided by DEM) must be submitted if the sewer
extension will be serving single family residences, condominiums, mobile homes, or town houses and if the subject sewer
extension is owned by the individual residents, a homeowners association, or a developer.
g. A cover letter, which briefly describes the project, should be included with each application package. If necessary for clarity,
feel free to include attachments to the application form. Such attachments will be considered as part of the application and
should be numbered to correspond to the section to which they refer.
h. All materials and fees submitted in support of this request for a permit become the property of the Division of Environmental
Management; therefore, if the permit is not issued for any reason, the Division will return submitted materials only at its

In accordance with Division policy, the enclosed application package, which was received on
December 16, 1994, is being returned as incomplete.The following checked items are lacking:
-Two sets of plans/specifications signed and sealed by an N.C. Professional Engineer.
-Five sets of plans/specifications signed and sealed by an N.C. Professional Engineer.
-Two copies of all required supporting materials.
-Appropriately completed and signed application form plus one copy.
-Letter from NPDES Permit holder requesting Authorization to Construct.
-Letter from current permit holder requesting name change.
-Letter of flow acceptance (SPECIFYING FLOW) from owner of receiving treatment
facility. This letter must be included in package when re -submitted.
-Operational Agreement for sewers owned by individual residents, a homeowners
association, or a developer.
-Permit application processing fee of $400.
-Subsurface evaluation/soil scientist's report for surface and subsurface waste disposal
permits, including loading rate calculations.
-Waste analyses and Toxicity Characteristic Leachate Procedure (TCLP) Analysis.
-Other Items:

The Moore County Water Pollution Control Facilities hereby agrees
to conditionally accept up to 8,125 gallons per day of wastewater
from the L2terenced project in P--.Jrdance with request of August
19, :133 by Hayter,Reynolds & Jewell.
Upon completion of the referenced project, the applicant's engineer
is to provide this office with the following items:
1. Infiltration in gallons per day.
2. Certification of completion as defined by N.C.
Statutory Requirements #143-215.1; Section 2-H.0220.
After Moore County has received a copy of the certification of completion,
our office will provide a final acceptance statement.
