This letter is in response to your application request under the Coastal Area Management Act (CAMA) and
state dredge and fill law to excavate an access channel and a 7-slip upland basin; install a boat ramp; construct a
dock around the basin perimeter; install two riprap groins on each side of the entrance channel; install riprap along
the shoreline; and install 16 RV campsites on site your property off SR 1149 adjacent the Pungo River near
Scranton, Hyde County, NC. Processing of the permit application, which was received by the Division of Coastal
Management's Washington office on May 12,2003, is ongoing.
During the multi-agency review of this permit application; the NC Division of Water Quality (DWQ), 401
Wetlands Certification Unit, by way of the attached July 7, 2003, correspondence has determined that additional
information is needed to properly review your proposed project. Please provide this office with a copy of the 401
Certification for this project.
You will be given three working days to respond to this request for additional information from date of
transmittal of an e-mail or fax, or five working days from date of mailing. If you provide the copy of the 401
Certification within the required time, DCM staff will resume processing the application and the processing clock
will not be suspended.

On May 22, 2003, the Division of Water Quality (DWQ) received your application to impact wetlands, waters and
protected riparian buffers to construct the proposed RV campground and boating access facility. The DWQ has
determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ
will require additional information in order to process your application to impact protected wetland, streams and/or buffers
on the subject property. Therefore, unless we receive the additional information requested below, we will have to move
toward denial of your application as required by 15A NCAC 2H .0508 and 2B .0259(8) and will place this projection hold
as incomplete until we receive this additional information. Please provide the following information so that we may
continue to review your project.
Additional Information:
1. Buffer Establishment around Basins
New boat basins (such as the one you are proposing to construct) are considered by the DWQ as a modification of
the existing shoreline. As such, a 50-foot buffer that meets the requirements of Sections (4) and (5) of 15A NCAC -
02B .0259 must be established around the newly created shoreline / basin. All associated upland development (e.g.,
parking areas, septic systems, buildings, camping sites, etc.) and any new impervious surfaces shall not be located
within the newly established buffer or any existing protected buffers. Your do not depict the establishment of these
buffers and show development within 50 feet of the basins. Please establish a buffer around the basin, move all
proposed development greater than 50 feet from the basin and submit new plans to this office for our review. Water
dependent structures (such as the boat launch ramp) and pedestrian access paths may be allowed.
2. Riprap / Stone Groins enclosing Coastal Wetlands
Your plans depict riprap/stone groins enclosing CAMA marsh/coastal wetlands. This is typically not allowed. Please
revise your plans to avoid enclosing the CAMA marsh/coastal wetlands or provide additional justification for the need
and purpose of the riprap/stone groins in this area.
3. Ditches
Your plans depict "6'WIDE Ditch(es)" discharging into the proposed boat basin. The buffer rule requires that a
stormwater shall be directed to flow in a diffuse manner at non-erosive velocities through the entire protected streai
buffers without re-concentrating (15A NCAC 02B .0259(5)). Please provide a stormwater management plan for th

project that specifies all stormwater discharge points, plan details, and calculations to indicate that diffuse flow through
the protected buffers as described above will be achieved.
Please respond within three weeks of the date of this letter by sending this information to me in writing and Tom Steffens
of the DWQ Washington Regional Office. If we do not hear from you within three weeks, we will assume that you no
longer want to pursue this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected
buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.

Reference the application of William B. Keech for a Department of the Army (DA) permit
to excavate an access channel and boat basin, place rock riprap material along the shoreline, and
construct a boatramp, dock, and groins, on property located off State Road 1149, adjacent to the
Pungo River, near Scranton, in Hyde County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the application
and your field investigation report.
We recommend that the following conditions be included in the State authorization:
All work authorized by this permit must be performed in strict compliance with the
permit plans, which are a part of this permit.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized,
or if, in the opinion of the Secretary of the Army or his authorized representative, said structure
or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate,
or alter the structural work or obstructions caused thereby, without expense to the United States.
No claim shall be made against the United States on account of any such removal or alteration.
3. No vegetated wetlands will be excavated or filled.
4. Excavation will not exceed - 3 feet below the elevation of mean low water (MLW).

5. The temporary placement or double handling of excavated or fill materials within
waters or vegetated wetlands are not authorized.
6. The fill material will be clean and free of any pollutants except in trace quantities.
Metal products, organic materials, or unsightly debris will not be used.
7. No attempt will be made by the permittee to prevent the full and free use by the public
of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must
not interfere with the public's right to free navigation on all navigable waters of the United States.
8. The permittee will maintain the authorized work in good condition and in conformance
with the terms and conditions of this permit. The permittee is not relieved of this requirement if
he abandons the permitted activity without having it transferred to a third party.
9. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction-related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.

APPROVAL of 401 Water Quality Certification and AUTHORIZATION CERTIFICATE per the Tar-Pamlico River
Buffer Protection Rules (15A NCAC 2B .0259) with ADDITIONAL CONDITIONS
Dear Mr. & Mrs. Keech:
You have our approval, in accordance with the attached conditions and those listed below, to place fill within or
otherwise impact approximately 0.61 acres of waters and approximately 0.5 acres of protected riparian buffers for the
purpose of installing riprap/stone groins along approximately 2,300 feet of shoreline and dredging an access channel at
the subject property, as described within application including revised plans sealed by Hood L. Richardson, PE on July
22, 2003 and received by the Division of Water Quality (DWQ) on July 28,, 2003. After reviewing your application, we
have decided that the impacts are covered by the N.C. Division of Water Quality (DWQ) General Water Quality
Certification Number(s) 3351 (GC3351). The Certification(s) allows you to use Regional General Permit(s) 1980000291
when issued by the US Army Corps of Engineers (USAGE). This letter shall also act as your approved Authorization
Certificate for impacts to the protected riparian buffers per 15A NCAC 213 .0233. In addition, you should obtain or
otherwise comply with any other required federal, state or local permits before you go ahead with your project including
(but not limited to) Erosion and Sediment Control, Non-discharge, and CAMA regulations. Also, this approval will expire
when the accompanying 404 permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner must
be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If
total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification and any additional conditions listed below.

Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any
subsequent modifications, the applicant is required to return the attached certificate of completion to the
401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal and/or
civil penalties. This Certification shall become null and void unless the above conditions are made conditions of the
Federal 404 and/or coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or
CAMA permit.

If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts),
you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for
a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final
and binding unless you ask for a hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts)
shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in
Articles 3 and 4 of G.S. 1508.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the Tar-
Pamlico riparian buffer protection rule as described within 15A NCAC 213.0233. If you have any questions, please

Bailey marina a very contoversial project, this is an addition to a previous
project we rejectedbecaus eit was too big and impacted PNAs, shellfish, and
others, so they submitted it piecemeal. they broke it up into two separate
projs. I don't have th epaper work, but suggest we HOLD for further review
if there is a way. I think the other agencies may have something to say
(DMF). This is a Basnight special

Project Setting
The project site is a 213 acre tract located on the east side of the Pungo River in
Hyde County off SR 1149, Montgomery Road, near Scranton, North Carolina. The
majority of the tract is row crop farm land. The farm is surrounded by pine plantation
managed and owned by Weyerhaeuser Timber Company. Vehicular access to the site is
down an unimproved dirt path along the northern edge of the ag fields. The ag fields and
associated drainage ditches are oriented in a north south direction parallel to the river
shore. There is a wooded area that buffers the northern half of the ag field adjacent the
river shore. The area of field immediately adjacent the river has suffered more erosion
than adjacent wooded areas as evident from the wider sand beach and the half moon
shaped erosion escarpment. The south side of the tract is border by an area woods and a
gut with associated marsh that transitions to a wooded 404 swamp. The shoreline is a
sandy estuarine beach resulting from the eroding adjacent uplands, ag field and
woodland, with a ± 3' high escarpment. Water depths are generally shallow ranging from
l' to 3'. Observations made from the shoreline did not detect the presence of any
submerged aquatic vegetation.
The Pungo River at this location is classified as SB-NSW by the Environmental
Management Commission and Coastal Waters by the Division of Marine fisheries.
Project Description
The applicant is proposing to. develop the western ag field adjacent the river shore
into a RV camp site with boating access. The proposal includes a 100' wide x 210' long
upland boat basin with a 40' x 150' access channel. A 40'wide x 50'long channel is
proposed in the Pungo River with two 20'wide x..50'long riprap groins proposed as
stabilization leading to a 40'wide x 100'long channel through highground to the proposed
basin. The access channel and boat basin will have a final depth of -3' below the normal
water level (NWL). The access channel and basin in highground are to be stabilized with
a bulkhead. The upland channel and boat basin. are to be excavated landward of an
earthen plug to be left in place until all upland excavation is complete. A 12' x 25' boat
ramp is proposed with two- 2'wide x 50'long launch/finger piers, one on either side of
ramp, in the basin. A 170'long x 100'wide graveled area is proposed to provide boat
trailer parking. The south side of the basin is proposed to have seven slips defined by
mooring piles. A 4'wide x 560'long dock is proposed around the perimeter of the basin
on the landward side of the proposed. bulkhead. The applicant is proposing to stabilize
2,350'of shoreline along the Pungo River with granite riprap averaging 9' waterward of
the NWL with the riprap toe. The applicant is:also proposing 10 - 5' wide x 25' long
riprap groins. The applicant proposes to locate 16 RV campsites adjacent the north side
of the basin inside a ± 30' wide gravel loop road.. The campsites will have access to a
proposed septic system.

Anticipated Impacts
The project as proposed will result in the excavation of 2'000ft2 of Pungo River
bottom. The proposed riprap groins and riprap shoreline stabilization will result in the
filling of 24,400 ftz of Pungo River bottom. There will be some short terns turbidity
during construction. The project will increase boat traffic and their associated impacts in
the immediate area.

This project will consist of the construction of a 100' x 210' boat basin with access channel and
16 camper trailer sites with on-site water and sewer facilities. There will be 2,300 feet of stone
riprap shoreline protection installed with (10) 25-foot groin.
Two fifty foot long by 15-foot wide (at the water line) stone riprap access channel protection
jetties are proposed. The request for jetties to be more than 25 feet long is justified because the
minimum wind driven fetch for this site is 1.5 miles. This condition will generate large waves.
A natural earthen plug will remain in place at the shoreline until construction activities are
complete and water inside the boat basin is clear.
