Project No. 01-6178 Parcel Number(s): 0768872368 & 0768776850 Little Brier Creek [03-04-02, 27-33-4-1, C NSW (nutrient sensitive)] On-Site Determination for Applicability to the Neuse River Riparian Area Protection Rules (15A NCAC 2B .0233) Dear Mr. Clark: On June 11, 2003, at your request I conducted an on-site determination to review two streams located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The streams are labeled on the attached map initialed by me on June 12, 2003 as "D" and "E". Division of Water Quality (DWQ) Staff from the Raleigh Regional Office (RRO) had previously conducted an on-site determination of the streams. You requested an appeal of their determination as provided within 15A NCAC 02B .0233(3)(a). At your request, I conducted an appeal of their determination as stated above. During my review I evaluated the streams using the DWQ Stream Classification Form. The stream labeled as "D" rated at 11 points. The stream labeled as "E" rated at 19.5 points. The form states that if the score is "greater than or equal to 19 points the stream is at least intermittent". Based on my evaluation, the DWQ has determined that the stream labeled as "D" is "ephemeral" and not subject to the Neuse Buffer Rule and that the stream labeled as "E" is at least "Intermittent" and remains subject to the Neuse Buffer Rule. This determination shall replace the determination originally performed by the Regional Office. The owner (or future owners) should notify the DWQ (and other relevant agencies) of this decision in any future correspondences concerning this property. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. Nor does this letter approve any activity within Waters of the United States or Waters of the State. Wetlands or other Waters of the U.S. may exist on the property. You should contact the U.S. Army Corps of Engineers to ensure compliance with wetland regulations. Mr. Mitchell determined that among others, portions of features D and E meet the criteria for buffered streams. The stream did not contain flowing water and only a few areas of pooled water at the time of the evaluation. The stream did not contain a continuous channel through out the drainageway. This determination shall replace the determination originally performed by the Regional Office. It was determined that the features labeled B and C on the attached map are not subject to the Neuse Buffers. It was also determined that feature A is subject to the Neuse Buffers throughout its extent on the property. Features D, E, F, G, and H become subject to the buffers beginning at flags Wz, 05, 07, W4, and 12 respectively. Mr. Mitchell has not yet seat written confirmation of his findings, however should be shortly. S&EC believes that feature G is primarily driven by stormwater off of ACC Boulevard. The feature does not contain a continuous bed and bank and lacks other characteristics of a buffered drainage therefore should not be subject to the Neusc Suffer Rules. S&EC agrees with and accepts all other buffer calls made on the property. Please call if you need further explanation.
