8. PROJECT SUMMARY: The applicants propose to construct stormwater control measures, add an additional
parking lot and gravel drive areas and add a new office building at an existing fishing pier/hotel development.

9. PROJECT DESCRIPTION:
The applicants' properties are located on NCSR 1568, at the site of the existing Sea View Motel and Sea View
Fishing Pier, located adjacent to the Atlantic Ocean and Stump Sound, in North Topsail Beach, Onslow County.
The property is located approximately 1.7 miles from the intersection ofNC Highway 210 and NCSR 1568. The total
project area measures approximately 3.7 acres in size and consists of two separate tracts that were recombined on
April 3, 2001. Tract One is approximately 1.2 acres in size and is owned by William A. Smith and Katie C. Smith
and Seaview Corporation, doing business as the Seaview Motel. Tract Two is approximately 2.5 acres in size and
is owned by Mr. Greg Ludlum (Seaview Fishing Pier, LLC), doing business as Seaview Fishing Pier.
On July 22, 1998, Salty's Fishing Pier, c/o William A. & Katie Smith, was issued CAMA Major Permit No. 95-98
for the construction of a fishing pier, motel and gravel parking area. Development under this permit has been
completed. Permit No. 95-98 expired on December 31, 2001.
In January 2002, it was discovered that construction had begun on additional gravel driveway and parking areas at
the applicants' properties without proper authorization from the Division of Coastal Management. Certain aspects
of this development were also found to be in violation of State Stormwater Permit No. SW8 971115. As a result of
project modifications and property ownership changes, the applicants applied for and received a modified Stormwater
Permit on October 18, 2002. The applicants' current CAMA Major Permit application request is to authorize the
construction of stormwater control measures required by the State Stormwater Permit as well as additional site
development.
The majority of the site is flat and consists primarily of gravel base and clay parking areas. Running along the entire
ocean side of the property is a dune feature averaging approximately 45 feet in width, reaching elevations of between
12 and 16 feet above mean sea level. The first line of stable natural vegetation is located near the landward toe of
the dune on the eastern side of the property and near the crest of the dune on the western side of the property. The
majority of the property is located within the Ocean Erodible Area AEC (280 feet landward of the first line of stable
natural vegetation) and the entire property is located within the High Hazard Flood Area AEC. The long term average
annual erosion rate for this portion of Topsail Island is 2 feet/year. The Ocean Erodible Area Setback for small
structures is 30 times this rate, or 60 feet from the first line of stable natural vegetation.
The North Topsail Beach Land Use Plan classifies the upland areas of the project site as Urban Transition. The
waters of the Atlantic Ocean are classified SB by the Division of Water Quality. The Waters of Stump Sound are
classified SA , are designated as a Primary Nursery Area by the Division of Marine Fisheries and are OPEN to the
harvesting of shellfish.
The applicants are proposing to add additional improvements to the two properties. The improvements would include
the construction of parking areas, stormwater control measures, and an office building. The office building would
be located on Tract 1, and would be directly adjacent to and to the west of the existing Sea view Motel. The Office
building would measure approximately 30 feet wide by approximately 60 feet in length. The new building would
be located an average of approximately 100 feet landward of the first line of stable natural vegetation. Also proposed
are two new gravel parking areas, one located on Tract 1 and one located on Tract 2. The parking area on Tract 1
would consist of 16 parking spaces and would also include a new gravel entrance road from NCSR 1568. This
parking lot would become contiguous with the existing parking area adjacent to the motel. The existing parking lot
on Tract 2 would be shifted/rearranged and added to, creating approximately 9 additional spaces. In order to comply
with the current Stormwater Permit, the applicants are proposing the construction of two stormwater basins. One
basin would be located on Tract 1 adjacent to the new entrance road. This basin would measure approximately 120
feet by 35 feet. On Tract 2, the basin would measure approximately 70 feet by 50 feet and would be located near
NCSR 1568.
10. ANTICIPATED IMPACTS:
The initial grading of the site and the construction of the stormwater basins would result in the disturbance of
approximately 0.78 acres of highground. The construction of the parking areas and office building would create an
additional 13.305 sq. ft. of built-upon area. No development is proposed within the 75' Estuarine Shoreline AEC of
Stump Sound.

The Wilmington Regional Office received a complete Stormwater Management Permit Application for Seaview
Fishing Pier on September 14, 2001. Staff review of the plans and specifications has determined that the project, as
proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding
Permit No. SW8 971115 Modification dated September 20, 2001, for the construction of Seaview Fishing Pier.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions and
limitations as specified therein, and does not supercede any other agency permit that may be required.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must
be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands
are made this permit shall be final and binding.

construction, operation and maintenance of a 25% low density development with designed infiltration basins in
compliance with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules ") and the
approved stormwater management plans and specifications, and other supporting data as attached and on file with
and approved by the Division of Water Quality and considered a part of this permit for Seaview Fishing Pier.
The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following specific
conditions and limitations:
1. DESIGN STANDARDS
This permit covers the construction of 43,385 square feet of built-upon area.
2. The overall tract built-upon area percentage for the project must be maintained at 25%, as required by
Section .1005 of the stormwater rules.
3. Approved plans and specifications for projects covered by this permit are incorporated by reference and are
enforceable parts of the permit.
4. This proj ect has created a "Pocket of High Density". All stormwater runoff from the driveway and parking
areas must be directed into the designed infiltration basins.
4. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with minimum
side slopes of 3:1 (H:V) as defined in the stormwater rules and approved by the Division.
5. No piping is allowed except:
a. That minimum amount necessary to direct runoff beneath an impervious surface such as a road.
b. That minimum amount needed under driveways to provide access.
6. Unless specified elsewhere, permanent seeding requirements for the infiltration basins must follow the
guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual.
7. Roof drains must terminate at least 30' from the Mean High Water line.

Il. SCHEDULE OF COMPLIANCE
1. Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all
impervious areas and surface waters.
?. The permittee is responsible for verifying that the proposed built-upon area does not exceed the allowable
built-upon area.
3. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements ofthe permit. Within the time frame specified in the notice, the permittee shall submit a written
time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall
provide copies of revised plans and certification in writing to the Director that the changes have been made.
4. Prior to the sale of this project, in whole or in part, the following deed restrictions must be recorded with the
Office of the Register of Deeds and submitted to DWQ:
a. "Construction of additional built-upon area in excess of 43,385 square feet will require a permit
modification."
b. "Construction of additional impervious areas such that low density requirements are no longer met
must be submitted to DWQ and a permit modification must be issued prior to construction. An
engineered system will be required to collect and treat the runoff from all built-upon area associated
with the project, including that area permitted under the low density option."
C. "Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with this
development, except for average driveway crossings, is strictly prohibited by any persons."
d. "A minimum of 30' of vegetated buffer area shall be provided between surface waters and all
impervious surfaces."

6. Projects within CAMA's Area of Environmental Concern (AEC) are subject to a reduction of the permitted
amount of built-upon area due to CAMA jurisdiction within the AEC.
7. A copy of the recorded restrictions must be received by this Office within 30 days of the date of sale.
8. The following items will require a modification to the permit. Revised plans, specifications and calculations
must be permitted prior to the permittee beginning construction on the modification:
a. Any revision to the approved plans, regardless of size.
b. Project name change:
C. Transfer of ownership.
d. Redesign or addition to the approved.amount of built-upon area.
e. Further subdivision, acquisition, or sale of the project area. The prof ect area is defined as all property
owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought.
f. Filling in, altering or piping any vegetative conveyance shown on the approved plan.
9. The Director may determine that other revisions to the project should require a modification to the permit.
10. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be operational
for their intended use prior to the construction of any built-upon surface.
11 During construction, erosion shall be kept to a minimum and any eroded areas of the swales or other
vegetated conveyances will be repaired immediately.

12. The permittee shall at all times provide the operation and maintenance necessary to operate the
permitted stormwater management systems at optimum efficiency to include:
a. Inspections
b Sediment removal.
C. Mowing, and revegetating of the side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
13. Within 30 days of completion of the project, the permittee shall certify in writing that the project has been
constructed in accordance with the approved plans.
14. The permittee shall submit all information requested by the Director or his representative within the time
frame specified in the written information request.
III. GENERAL CONDITIONS
Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes
143-215.6A to 143-215.6C.
2. The permit issued shall continue in force and effect until revoked or terminated.
3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a
permit modification, revocation and reissuance, or termination does not stay any permit condition.
4. The issuance of this permit does notprohibit the Director from reopening and modifying the permit, revoking
and reissuing the permit, or terminating the permit as allowed by the laws, rules, and regulations contained
in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and North Carolina General
Statute 143-215.1 et. al.
5. The permit is not transferable to any person except after notice to and approval by the Director. The Director
may require modification or revocation and reissuance ofthe permit to change the name and incorporate such
other requirements as may be necessary. A formal permit request must be submitted to the Division of Water
Quality accompanied by the appropriate fee, documentation from both parties involved, and other supporting
materials as may be appropriate. The approval of this request will be considered on its merits, and may or
may not be approved.
6. The permittee grants permission to DENR Staff to enter the property for the purpose of inspecting all
components of the stormwater management facility.
7. The permittee shall notify the Division of any name, ownership or mailing address changes within 3 0 days.
8. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state and federal)
which have jurisdiction.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions., outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a
table listine4ich lot number, size and the allowable built-upon area for each lot must be provided as an
attachment- *
1. The folloorg covenants are intended to ensure ongoing compliance with state stonnwater management permit
number as issued by the Division of Water Quality. Tliese covenants may
not be changed or deleted without the consent of the State.
2. No more than square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built-upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the
integrity and performance of the system as permitted.

shall include all the applicable items required above, that the covenants will be binding on all parties and
persons claiming under them, that they will run with the land, that the required covenants cannot be changed or

• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross-sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to

NARRATIVE FOR CAMA APPLICATION
Mr. and Mrs. Smith own Seaview Motel and Mr. Greg Ludlum owns
Seaview Fishing Pier. Find enclosed copies of their deeds, Onslow County
Tax records, and agent authorization forms. Mr. and Mrs. Smith are presently
not in compliance with Water Quality, because of failure to construct a
previously approved stormwater plan. The previous Major CAMA Permit for
the project expired in December of 2001. A modified stormwater plan was
required for the project and Water Quality has approved this modified plan.
In order to construct this modified stormwater plan, the Smith's are required
to obtain CAMA approval. Therefore, they are requesting reactivation and
modification of Mr. & Mrs. Smith's previous MAJOR CAMA PERMIT.
This stormwater plan consists of the following modifications of the previous
Major CAMA Plan:
I . Construction of the approved stormwater basins
2. Shifting and Grading of the parking lots
3. Creation of a New Drive along the western property line
4. Construction of an Office Building for the Motel
Upon completion, certification and approval of the installation of the
stormwater plan, and under the guidelines and review of Water Quality, Mr.
& Mrs. Smith and Mr. Ludlum will separate their responsibility for the
stormwater system.
We request this reactivation and modification to be placed in both Mr. &
Mrs. Smith and Mr. Greg Ludlum names.
