Description of Activity:
(1) NWP 12 (Action ID. 200330635) - Install sanitary sewer line to serve the above
referenced development. It will be necessary to cross West Fork, Twelvemile Creek and
unnamed tributaries at 8 separate locations. The crossings will be perpendicular and
subaqueous; (2) NWP 39 (Action ID. 200330636) - Construct a road'crossing on'West
.
Fork, Twelvemile Creek, impacting 100 LF of stream channel, for the purpose of,providing
access to the.development. All of the 0.54 acre of wetlands and "% of the remaining stt`eam
channels`on the property will be avoided and preserved.
Applicable Law: X Section 404 (Clean Water Act, 33 U.S_C.1344).

Re: 401 Water Quality Certification-Brookhaven Phase 1-Union County
Mr. Parker:
1 am writing in response to a recent letter sent to our client John Wieland Homes of North
Carolina concerning a 401 Water Quality Certification. Please know that Soil &
Environmental Consultants, PA (S&EC) has performed a wetland delineation on the
project in question. The delineation has been approved by the US Army Corps of
Engineers (USAGE). In addition, a Nationwide Permit 12 was issued by the USACE on
April 29, 2003 for 178 linear feet of temporary stream impact for 8 sewer crossings.
Also, a Nationwide Permit 39 was issued by the USACE on April 29, 2003 for 100 linear
feet of stream impact (permanent) for a road crossing. A copy of the permit is attached
with this letter. Since notification to the NC DWQ is not required for Nationwide Permit
12 if the conditions of the permit are followed and because notification is not required
under Nationwide Permit 39 with less than 150 linear feet of stream impact or less than
0.1 acres wetland impact the NC DWQ was not provided a PCN. No impacts to
vegetated wetlands were proposed for the project. We believe this should satisfy your
request for information related to this project and no further action should be required of
John Wieland Homes. Our client intends to move forward based on the fact that 404/401
conditions have been met in regards to this project.
