Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* Due to strong storms over the past 18 months, damage has occurred at the site. The owner maintained a good stand of grass along the banks with no issues for several years. Unfortunately, repeated high flows were able to undermine the grass and strip some vegetation from the banks. The stream has been disconnected from its floodplain in some areas resulting in vertical banks. High voltage powerline runs along side the stream on the south side of the property. Open area with grass and short trees (<15') exist on either side of the stream due to powerline. Outside of that area are wooded areas between homes. 4b. Explain the purpose of the proposed project:* The purpose of this project is to stabilize the stream banks to withstand high water flows during future large storm events. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* This project will create a flood bank bench where not prohibited by bedrock. The stream has already begun to establish several small benches, which will be enhanced and expanded. Both sides of the stream will be addressed resulting in about 275 feet of bank restoration. A 4:1 to 3:1 side -slopes will be installed where possible. Some areas where bedrock exists and permanent planting beds are located, steeper slopes may be required. Slopes have been maximized where possible. Additionally, woody vegetation will be installed on the bench, bank side -slopes, and top bank areas. Dense vegetation is planned for all areas where flooding is expected. 4j. Please upload project drawings for the proposed project 5. Jurisdictional Determinations 5a. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Equipment will be kept out of the stream and will not be crossing the stream to access work areas. Equipment will be inspected for leaks and maintained daily. Refueling will not occur within the work area. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: All disturbed areas will be seeded and covered with biodegradable matting as soon as possible. Additionally, various types of woody vegetation will also be installed. Silt fence will be installed around soil stock piles. As soil is spread up gradient, the areas will be reseeded and covered with straw. All disturbed areas will be stabilized as soon as possible. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. Does the project require Compensatory Mitigation for impacts to Waters of the U.S. or Waters of the State? r Yes f• No 2b. If this project DOES NOT require Compensatory Mitigation, explain why: There are no wetlands previously identified in the area. Map attached. F. Stormwater Management and Diffuse Flow Plan (required by DWR) 1. Diffuse Flow Plan 1a. Does the project include or is it adjacent to protected riparian buffers identified within one of the NC Riparian Buffer Protection Rules? r Yes r No If no, explain why: Project is not in targeted watershed for riparian buffers. 2. Stormwater Management Plan 2a. Is this a NCDOT project subject to compliance with NCDOT's Individual NPDES permit NCS000250?* r Yes r No 2b. Does this project meet the requirements for low density projects as defined in 15A NCAC 02H .1003(2)? r Yes r No Comments: Henderson County Erosion and Control Department oversees stormwater issues for the county. This project does not require a stormwater management plan because less than an acre Will be disturbed and is located in a development established prior to 2009. No changes to impermeable areas will occur. G. Supplementary Information 1. Environmental Documentation 1a. Does the project involve an expenditure of public (federal/state/local) funds or the use of public (federal/state) land?* r Yes r No u 1b. If you answered "yes" to the above, does the project require preparation of an environmental document pursuant to the requirements of the National or State (North Carolina) Environmental Policy Act (NEPA/SEPA)? * r Yes r No Comments:* Owner will receive cost share money for a portion of the project costs through the CCAP program supported by the NC Soil & Water Conservation Division. Projects must be completed as defined by the standards for the conservation practice before cost share funds are paid. Owner must pay all costs up front and is paid by the cost share program based on receipts for the project are submitted. 2. Violations (DWR Requirement) 2a. Is the site in violation of DWR Water Quality Certification Rules (15A NCAC 2H .0500), Isolated Wetland Rules (15A NCAC 21-1.1300), or DWR Surface Water or Wetland Standards or Riparian Buffer Rules (15A NCAC 2B .0200)?* r Yes r No 3. Cumulative Impacts (DWR Requirement) 3a. Will this project result in additional development, which could impact nearby downstream water quality?* r Yes r No 3b. If you answered "no," provide a short narrative description. The stabilization of the site will reduce the volume of sediment entering the stream system. This should reduce the sediment impacts downstream. 4. Sewage Disposal (DWR Requirement) 4a. Is sewage disposal required by DWR for this project?* r Yes r Nor WA 5.
