Box 307 Corolla, INC, 27927 APPROVAL of 401 Water Quality Certification with Additional Condition Dear Mr. Thornton: You have our approval, in accordance with the attached conditions, to place fill in 0.87 acre of vegetated and non-vegetated wetlands in order to fill and pond and stabilize a shoreline in Currituck County, as described in your application received by the Division of Water Quality on May 6, 2003. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3400, which can be downloaded from our web site at http://h2o.enr.state.nc.us/nowetlands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or In the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed; If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. PROJECT SUMMARY: Currituck County is requesting a permit to: 1) place riprap along 570' of unprotected shoreline, redress a 1,620' section of existing riprap and extend it an additional one-foot waterward of the existing alignment, fill 8,712sf of the existing pond (and create high ground), construct a 1,172' bulkhead around the pond (and its proposed high ground area), and partially fill 2,889sf of the remaining pond to reduce water depths to 1.5' below NWL for a waterfowl impoundment. PROJECT SITE The project site is located at the Historic Whalehead Club on the Currituck Outer Banks in Corolla Village, more specifically described as being on the west side of NC 12 (Ocean Trail), adjacent to Whalehead Bay and Currituck Sound, immediately south of the Corolla Lighthouse. Located north of the property is the Corolla Lighthouse and to the south is Corolla Light Planned Unit Development Subdivision. The property is bounded on the west side by Currituck Sound and to the east by NC12 (Ocean Trail). The Whalehead Club property is located on a 38-acre tract that was originally developed as a hunting and fishing club during the early 1920s. Improvements on the property include the main house (or lodge), a swimming pool (removed), a vehicular bridge (removed), a boathouse, a footbridge, a number of out buildings (that have since been removed); a man-made canal and boat basin and a pond on the north east corner of the property. During the 1980s, a pond on the northeast side of the house was filled. In 1986, Advanced Property Concepts began construction on a 36 slip docking facility in the boat basin in 1987 under CAMA Major Permit #141-86, but defaulted on the property soon after the basin was completed. Currituck County purchased the club from the receiving bank, and began renovations that have included reconstruction of the footbridge, repairs to the house, the addition of a public boat ramp and six slips (CAMA Major Permit #148-89), and the placement of riprap) along the shoreline adjacent to the sound for erosion control (CAMA Major Permit #166-96). Existing riprap along the property is approximately 1,620 linear feet and extends from the southern end of the property adjacent to a man-made canal and, Whalehead Bay, in a westerly direction to the end of the peninsula, and around to a marsh fringe of big cord grass. In 1997, Currituck County applied for a third CAMA Major Permit to dredge a channel from the Currituck Sound to the boat basin. The request included placing dredge spoil in a second pond, located on the southwest side of the clubhouse, between the house and Currituck Sound. The Division denied the request based on inconsistencies with state standards, and the Currituck County Land Use Plan. On the southwest side of the main house is the man-made pond excavated in the 1980s. According to the Army Corps of Engineers the pond was excavated in conjunction with restoration requirements resulting from a violation that was issued to a previous owner of the property. The violation issued was for the unauthorized filling of an existing pond that was located on the property prior to 1985, on the north east side of the tract, as noted above. The narrative states that the pond was created at a 1:1 ratio as a part of a mitigation project, but does not explain further. The narrative also states that the pond was to be 27,000sf with an average depth of 2.5ft, but was over dredged by a previous owner (Advance Property Concepts) to an area of approximately 70,920sf and a depth of up to 6ft below NWL. The pond is situated between the main house and the Currituck Sound. The edge of the pond is approximately thirty feet from NWL of the Currituck Sound. Currituck County Field Report Page 3 High ground vegetation on the property includes Live Oak (Quercus virginiana), Loblolly Pine (Pines taeda), Black Cherry (Prunus serotina), Wax Myrtle (Myrica cerifera), and a variety of lawn grass and ornamentals. Wetland vegetation found around the perimeter of the pond includes Olney's Three Square (Scirpus americanus), Salt Meadow Hay (Spartina patens), Soft Rush (Juncus effusus), Sea Ox-eye (Borrichia frutescens), and Cattail (Typha latifolia). Submerged aquatic vegetation found in the pond includes water milfoil (Myriophyllum spicatum) and widgeon grass (Ruppia maritinia). Birds seen in and around the pond include, but are not limited to, the Great Blue Heron (Ardea herodias), Little Blue Heron (Egretta caerulea), Great Egret (Casmerodius albus), American Coot (Fulica Americana), Double-Crested Cormorant (Phalacrocorax auvitus), kingfisher (Ceryle alcyon), Canadian Goose (Branca Canadensis), and a variety of ducks. Although the plans submitted by the applicant's agent show a navigation channel, there is no designated channel. The area shown is the approximate location of a traditionally used travel path by small boats. While the SAVs shown along the channel are present, surveys of the area have indicated a greater area than shown. The Currituck Sound is classified as joint waters by agreement between the Marine Fisheries Commission and Wildlife Resources Commission. The Division of Environmental Management's water quality classification for the Albemarle Sound is SC (fish propagation). Review indicates that there are no identified archeological sites on the applicant's property; however, the site is on the National Historic Register. PROPSED PROJECT Currituck County proposes to undertake the following development: Shoreline Stabilization alone Currituck Sound The applicant would like to place approximately one-foot of riprap over an existing 1,620 linear feet of riprap alignment along the Currituck Sound. The proposed work would also include extending the riprap an additional one-foot waterward of the existing three-foot wide alignment. Area of Fill below NWL: 1,620sf of Estuarine Water (EW) Total Fill: 60cy The placement 570 linear feet of new shoreline protection extending north of the existing alignment, landward of NWL and Coastal Wetlands, with a base width of three feet and a height of two feet. The proposed alignment is along the west shore adjacent to the public boat ramp and the Currituck Sound. Area of Fill above NWL: 1,710sf of Estuarine Shoreline (ES) Total Fill: 127cy (Jurisdictional Wetlands) Shoreline Stabilization along the Man-Made Pond The project proposal includes filling 8,712sf of the existing 70,960sf pond to extend the high ground separation between the pond and the Currituck Sound. A 1,174' low bulkhead is proposed along the perimeter of the pond and the fill area. Back fill along the main fill area, on the southern end of the pond, will average four feet in depth to the finished grade. The remaining high ground area along the landward side of the proposed bulkhead will be limited to an average distance of one foot round the structure with an average depth of one foot. This proposed reduction is to enhance the area for submerged aquatic vegetation and wetland vegetation production. The applicant believes that this enhancement proposal will increase the number of migratory waterfowl using the pond. Approximately 359ft x 20ft (or 7,180sf) of the enhancement area will be within the Estuarine Shoreline AEC, and 18,828sf will be outside of the Estuarine Shoreline AEC. According to the drawing, the average depth of the proposed fill area is approximately 3,112ft, including a sloped area merging the fill area and the existing pond water bottom. Existing depths within the proposed fill area range from one to five feet below NWL. The deepest area of the pond is six feet below NWL, and is located in the northwestern section of the pond. This area will remain unchanged while the proposed fill area will have an average finished depth of-1.5 feet. There is no indication that the applicant is proposing any silt barrier between the undisturbed section of the pond and the fill area. According to the narrative, access to the fill area will be along the proposed 8,712sf fill area, but no further information was provided. Area of Fill below NWL: 26,008sf x 3.112ft Total Fill: 2,997cy Staging Areas and Access Roads While access is necessary to redress the existing riprap alignment, place new riprap, fill and bulkhead the pond; it is not, in and of itself, considered "land disturbing activity." With the exception of the proposed temporary 20'x 60' gravel construction entrance, within the Estuarine Shoreline AEC, no other disturbance is proposed in conjunction with this project. Area of Temporary Fill: 120sf Area Impacted by Heavy Equipment Accessing the Project Site: Approximately 86,891sf of incidental disturbance is anticipated with the proposed work, and of that, 62,383sf will be within the Estuarine Shoreline AEC. ANTICIPATED IMPACT If permitted 8,712sf of open water pond habitat, including ruppia and milfoil, will be lost. Currituck County Field Report Page 5 • If permitted, 34,720sf of the existing pond will receive sand fill, reducing the depth to approximately 1.5' below NWL. The anticipated impact is the enhancement of the area for migratory waterfowl. • If permitted, approximately 1,710sf of delineated Section 404 Wetlands will be filled by riprap. • If permitted, approximately 1,000sf of high ground fill will be placed in the work area, and of that 120sf will be temporary in nature for the entrance road to the work area. • Temporary localized turbidity will occur during the placement of new riprap along 1,620' of existing riprap. • The construction of a bulkhead along the interior perimeter of the pond will stabilize the shoreline And allow safer access to the area by the public visiting the Whalehead Club. • If permitted temporary disturbance over 86,891sf of the property can be anticipated during the placement of fill and riprap. The original area required by the mitigation stipulations was 27,000 sq. feet and average depth of 2.5 feet. At the time of original excavation the pond was over excavated and the pond has since eroded and enlarged in scale to 70,920 sq. feet due to erosion and side slope sloughing, in large part due to the over- deepening (by previous ownership) at time of construction. The mitigation project was originally deemed unsuccessful by the USACE, but in recent years, the growth of SAV's in the outer margins (waterward to -3 feet) has now been considered significant. Our request for raising the substrate to -1.5 feet will multiply the SAV producing habitat area by a minimum of three times and will provide a habitat closer to the original mitigation requests and intent. This will result in a net gain for wetland species, SAV preferred substrate and waterfowl habitat. This fill area will also provide a larger spawning area for the sunfish population The 8,712 fill area will be used to as offloading area for the fill to -1.5 feet to prevent disturbance to vegetation in the remaining margins of the pond from construction processes. The intent of this request is to restore a large portion of the pond closer to the original specifications and to enhance its use by migratory waterfowl as a feeding and resting area. Currently the average depths are too deep to promote use as a feeding area for migratory waterfowl (excepting the outer margins). Therefore, use by waterfowl at this point is minimal due to the excessive depths and lack of SAV's. The fill area in the pond will provide adequate water depths to promote photosynthesis required by the submerged aquatic vegetation to thrive and flourish. The west end of the pond will remain at the existing depth to provide habitat for the existing sunfish population to have adequate water depths for winter survival. The pond is expected to re-vegetate itself after the work is completed. Existing SAV's (millfoil, typha and ruppia) will be left intact in areas outside of the fill area. If re-vegetation does not occur rapidly, SA Vs will be planted in the fill area to restore habitat as quickly as possible. The work would be completed as soon as possible to prepare and restore the site aesthetics prior to the tourist season. The 8,712 Square feet fill area adjacent to the Cumtuck Sound is requested to prevent future merging of the fresh water pond with the brackish waters of the Currituck Sound, and to allow for safe grounds maintenance of the area. Further unchecked erosion will cause the brackish waters to connect to the fresh water thereby reducing the variety of habitat available to the waterfowl in the area. Presently, the pond is significant because of the fresh water habitat it provides in an area dominated by brackish waters of the Currituck Sound and the saline waters of the Atlantic Ocean. This pond is also prohibited to hunters, providing a safe resting spot for migratory waterfowl. The existing rip-rap will be redressed in areas which require maintenance to preserve the integrity of the shoreline stabilization that exists on site. The request for 570 feet of new rip rap placement is requested for shoreline stabilization of the remaining unprotected west side of the property. This area is exposed to strong Northwest winds during winter and will complete the shoreline stabilization of the parcel. This rip rap will be placed landward of the normal water level to preserve the SAV habitat adjacent to the shoreline. The historical significance of the Whalehead Club as a sportsman's waterfowl retreat furthers the Whalehead Preservation Trust's desire to promote future waterfowl use of the site for the enjoyment by thousands of tourists, birdwatchers and future generations. If no action is taken, the Currituck Sound will connect to the fresh water pond and diminish the bio-diversity of the immediate area. The temporary gravel construction entrance is proposed at the displayed location due to the existence of old growth live oak trees at the entrance. If the haul road is proposed west of these oaks, the overhanging limbs will suffer permanent damage from collisions with dump trucks used to haul sand and rip rap. It is the applicants desire to minimize long term effects on these old growth trees and the scenic vistas they provide. Alternate routes were considered, but abandoned. This proposed route will lessen permanent effects of the project on scenic and historic vistas and property. The construction entrance will be temporary and a silt fence will be installed waterward of the haul road, adjacent to the canal.
