Based on my site visit of April 3, 2003, the `proposed sewer line impact to about 200 square feet.
of isolated wetlands on your property, on NC =62 near the Guilford/Alamance County line (as depicted
on the Preliminary Map` prepared for you by William Knight, JR; P.L.S) is deemed permitted according
to 15A `NCAC ?2H .1300 (Discharges tG Isolated,,-Wetlands-and Waters) as- long as-:the--fol.lowing
conditions are met:
(1) Appropriate erosion and sediment control practices that equal or exceed those required by the
N.C. Division of Land Resources or their local delegated program for the Sedimentation
Pollution Control Act shall be in full compliance with all specifications governing the proper
design, installation, operation and maintenance of such Best Management Practices in order to
help assure compliance with the appropriate turbidity and other water quality standards;
(2) All erosion and sediment control practices placed in isolated wetlands or isolated classified
surface waters must be removed and the original grade restored within two months after the
Division of Land. Resources or local delegated program determines that the land disturbance
project is completed and the file is closed out;
(3) Live or fresh concrete shall not come into contact with surface water until the concrete has
hardened; and,
(4) Measures shall be taken to ensure that the hydrology of any remaining isolated wetland or
isolated classified surface waters is not affected by the discharge.
In addition, the ditch that has been constructed-into the edge of the wetland will- need, to be
backfilled, and stabilized for a length of at least 50 feet beyond the edge of the wetland. Finally, an
anti-seep collar shall be installed' at the edge of "the wetland nearest the existing ditch to, prevent the
french-drain effect of the sewer line and thereby retain the natural- hydrology of the remaining
wetland. Please be aware that violations of any condition herein set forth may result in revocation of
this Permit and may result in criminal and/or civil penalties.
If this Permit is unacceptable to you have the right to an adjudicatory hearing upon written request
within sixty (60) days following receipt of this. Certification. This request must be in the form of a written
petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. If modifications are made to an
original Permit, you have the right to an adjudicatory hearing on the modifications upon written request
within sixty (60) days following receipt of the Permit Unless such demands are made, this Permit shall be
final and binding.

On February 24, 20031 was informed by Mr. Todd Tugwell of the US Army Corps of Engineers that you
have installed a ditch to drain an isolated wetland located on your property at NC 62 near the Guilford-
Alamance County line. Please be aware that impact to more than one-tenth (1/10) acre of this wetland
requires application to and written approval from the N.C. Division of Water Quality. I understand from Mr.
Tugwell that Denise Poulos with ECS will be working with you on this project. Please have her call me (or call
me yourself) at 919-733-9646 so we can discuss the permitting issues with respect to this property.

An update on the site on NC 62. The address for Mr. Wagoner I'sent earlier is wrong - the
correct address is 154 Huff ine Mill Rd., Burlington, NC. 27215 and his phone # is. „
336-584-5350. I spoke with him today. He is planning on installing drainage culverts from the
.wetland to the roadside ditch soon and then clearing the site for pasture. He also does not
agree that the site is wet and is a bit unhappy at possibly needing a permit. Let-me know if.I

Yesterday I met with Earl Davis and Brian Grogan with the Guilford County Erosion Control (336-641-8403) on
a site off NC 62 just inside the Guilford-Alamace county line. There is a +/- 5 acre isolated wetland that is
being drained by a recently excavated ditch. The ditch barely extends into the wetland, but it appears the
ditch was dug to remove surface water to allow development of the site. It is an interesting wetland that
appears to be a bowl-shaped depression on a ridge that is supported by a perched water table. See the
attached USGS and photo. The owner's name is Garland W. Wagoner, Jr., 2603 Holly Hill Street, Burlington,
NC 27215. Let me know if you want to discuss further.
