DWQ No. 03-0325 Biologists with the North Carolina Wildlife Resources Commission (Commission) reviewed the application with regard to impacts of the project on fish and wildlife resources. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and the Clean Water Act of 1977 (as amended). The Pitt County Soil & Water Conservation District is requesting authorization to restore hydrology in a 0.7 acre riparian wetland along Little Contentnea Creek near its confluence with Contentnea Creek. The proposed restoration involves construction of a weir to maintain 1-2 feet of water in the wetland. This wetland is typically dry under low water conditions in the creek possibly because of unnatural incision of the wetland's channel. Also associated with the project are the construction of an elevated wetland boardwalk and a pier on Little Contentnea Creek that will be used for educational purposes. Although the Commission supports the overall restoration objectives, there is the potential for the project to adversely affect anadromous fish populations that frequent this region of Little Contentnea Creek. Hickory shad (Alosa mediocris) and river herring (Alosa sp.) ascend this creek each winter to spring period to spawn along its flooded wetlands. If the weir plate is installed at an elevation above flood heights typical for these seasons, then a potentially significant area of spawning habitat could be isolated. Therefore, the Commission requests that information regarding the proposed weir elevation versus creek elevations during various flow conditions be provided. A weir elevation that corresponds to a stream flow of approximately 500 cubic feet per second, which is near the minimum average stream flow for Little Contentnea Creek near Hookerton (USGS 02091500) from February to June, may be required to maintain connectivity of this wetland. 404-Pitt County S&WCD Page 2 April 17, 2003 The Commission also questions whether the proposed hydrologic modification would establish a wetland vegetative community that possibly is neither desired nor ideal for the area. Specifically, maintaining standing water in this wetland during the growing season may establish a herbaceous community, whereas a bottomland hardwood community that is only seasonally inundated may be more appropriate. This latter community, although requiring much more time to fully mature, is a typical riparian community in this region of the Neuse River watershed. It cannot be determined what community is anticipated for this restoration project without knowing the proposed plantings, elevation of this wetland versus the creek, and the extent of inundation expected by the weir construction. Therefore, the Commission recommends that these factors be considered within the context of the restoration objectives. Finally, the Commission requests design information about the proposed pier on Little Contentnea Creek. From the application narrative, we anticipate that the pier will be relatively small and close to the shoreline given its intended use. Nevertheless, the Commission would be concerned if the pier would extend far enough from shore or close enough to the deeper portions of the creek so as to produce a hazard to navigation. After reviewing your application, we have decided that the impacts are covered by the DWQ General Water Quality Certification Number(s) 3399 (GC3399). The Certification(s) allows you to use Nationwide Permit 27 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 2B .0233. In addition, you should obtain or otherwise comply, with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control regulations. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed in the attached certification (GC3399). If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 150B. WE7ZANDS1401 GROUP MAR 19 2003 WATER QUACfTy SEC rIoN Pitt County is in the process of establishing an Environmental Education Center on Little Contentnea Creek in southeast Pitt County where it empties into Contentnea Creek. The site is located in the Contentnea Creek Estates Subdivision which suffered extensive flooding during Hurricane Floyd in September of 1999. As a result of the flood, several properties where bought out by FEMA and ownership for maintenance was retained by the county. The Pitt County Soil and Water Conservation District has a strong commitment to educating students and landowners on the environment. There is a great need to have an area to demonstrate Best Management Practices we encourage landowners to install on their property as well as bringing environmental awareness to students in an outdoor classroom setting. The project we are establishing will have a boardwalk constructed through an area of wetlands. The wetland is a broad area, about 150' ± wide, and drains about 80 acres of cropland, forest, and subdivided development upstream. It appears that the section of Little Contentnea Creek which the wetland outlets into has been channelized at some time and the outlet for the wetland was reduced from its wide bottom to a V channel. Due to the elevation change at the outlet from the low flows in the creek during the dry season, the outlet has incised reducing the hydrologic state of the wetland. The incised channel extends about 100' up into the wetland and no definite channel is obvious from that point on. For this reason we would like to install a weir, at the outlet of the wetland, at an elevation to retain 1 to 2 foot of water in the wetland. This will be done to support a more diverse wetland plant habitat. (See attached map for weir location) An access to Little Contentnea Creek, in the form of a pier, will be used to gather samples for water quality testing. With this site being in the Neuse River basin, as is 40% of our county, we see an opportunity to re-establish the buffers that show signs of human influence. The buffers would serve as a demonstration area for landowners on the proper construction of riparian buffers to meet the current rules. The full intent of this property is to provide an outdoor learning area. Therefore, any impacts made to buffers or wetlands will be coordinated with partnering agencies to insure that they are positive ones. Construction of the boardwalk will be done to allow sunlight to penetrate under the walk area, and access areas through the buffers will be kept to a minimum. A determination of the wetlands' importance to anadromous fisheries will be obtained before the weir is constructed. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at htW://h2o.enr.state.nc.us/ncwetlands/stn-n!zide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed ,(restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of constriction. Please attach a separate sheet if more space is needed. 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that you would like to pay into the NCWRP. Please note that payment into the NC VVRP must be reviewed and approved before it can be used to satisfy mitigation requirements. Applicants will be notified early in the review process by the 401/Wetlands Unit if payment into the NCWRP is available as an option.
