Melchoir 111 New Rail Drive Cary, NC 27513-2721 Subject Property: 521 Sagamore Drive, Lake Royale, Bunn, NC Lake Royale [03-03-01, 28-31-(1), B NSW] WAIVER of the 401 Water Quality Certification and Tar-Pamlico River Buffer Authorization Certificate To Whom It May Concern: Your application for a 401 Water Quality Certification and Tar-Pamlico River Buffer Authorization Certificate dated March 16, 2003 was received in the Wetlands/401 Unit of the Division of Water Quality (DWQ) on March 19, 2003. According to our rules (15A NCAC 2H .0507(A) and 15A NCAC 2B .0259(8)), if final action is not taken within sixty (60) days, the 401 Certification and Tar-Pamlico Buffer Authorization Certificate is waived unless DWQ has objected in writing to your application. Therefore, DWQ has waived the requirement of written authorization for the use of 401 Water Quality Certification Number 3399 (GC3362) and the buffer rules for your plans to impact 0.004 acres of waters and approximately 313 square feet of buffers to construct an 87-foot long bulkhead and 10'x 14' boat basin as described in your application. As such, the water and buffer impacts are approved. However, please be aware that you must follow the plans as described within your application dated March 16, 2003 and all other conditions of GC3399 and the Tar-Pamlico River Buffer Rules, including but not limited to diffuse flow per 15A NCAC 2B .0259(5). You must also obtain or otherwise comply with all other required State, Federal and Local regulations, including but not limited to DWQ Standards (15A NCAC 02B .0100 and .0200). Please note that new boat basins (such as the one you are proposing to construct) are considered by the DWQ as a modification of the existing shoreline. As such, a 50-foot buffer that meets the requirements of Sections (4) and (5) of 15A NCAC 02B .0259 must be established around the newly created shoreline (basin). You are required to establish a new buffer around the shoreline of the basin. All associated upland development (such as parking areas, buildings, etc.) and any new impervious surfaces shall not be located within the newly established buffer or any existing protected buffers. Replanting of vegetation within disturbed areas and establishment of new buffers located within 30 feet of the shoreline must be done in an "in kind" manner immediately following construction. Disturbed areas with pre-existing maintained grassed areas must be replanted with grass. Disturbed areas with pre-existing trees or woody vegetation must be replanted with trees and woody vegetation. Please note that if additional impacts occur within the development beyond those requested within your application, this waiver is no longer valid and a new 401 Water Quality Certification and Authorization Certificate will be required. Also, please note that the DWQ reserves the right to conduct a compliance review of your protect to ensure compliance with the wetland and buffer rules. I have no problem with the wall at the boat basin but do when they wnat to use this shoreline stabliization method along the water line or normal pool or whatever level.
