Dear Mr. Nelson:
The Division of Water Quality (the Division or DWQ) hereby issues the attached NPDES permit for the
subject facility. We issue this permit pursuant to the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental
Protection Agency dated October 15, 2007, or as subsequently amended.
The Division understands that you have made no changes to your facility since last renewal except to add
offloading and above -ground storage for ethanol and butane, neither affecting your Water Pollution
Control System. We have therefore drafted this renewal considering your monthly discharge monitoring
reports (DMRs), permit compliance history, and the effluent monitoring database.
Changes to Your Previous Permit -- Based on new surface water -quality stream standards, DWQ has
replaced the monitoring for Phenol (single compound) with Total Phenolic Compounds required of
discharges to Water Supply (WS) waters. The Division has removed previous Special Condition A. (2.)
for. Methyl Tertiary Butyl Either (MTBE). We will evaluate future MTBE compliance based on new
surface -water standards for Human Health of 1500 µg1L, and Water Supply (WS) at 19µg/L. While you
must continue to monitor MTBE, we have reduced the monitoring frequency from Monthly to Quarterly
based on levels reported as "not detected" during the previous permit cycle. Please note that BTEX
sampling events in all cases should coincide with annual WET test sampling [see Section A. (1.)].
Finally, we have updated your facility description and site map, adding parameter codes to Section A.
(L) for your convenience.
Please note that your receiving stream Horsepen Creek, remains classified a nutrient sensitive
waterbody (NSW), but since last renewal has been formally listed on the State's 303d List as
"impaired" for aquatic life, evidenced by poor bio-diversity. Addressing impaired waters is a high

priority with the Division, and we will continue to evaluate instream data. Although the majority of
impairment is likely due to non -point sources, mitigative action may be required if stream impairment
can be attributed to your facility.
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within thirty
(30) days after receiving this letter. Your request must take the form of a written petition conforming to
Chapter 150B of the North Carolina General Statutes, and you must file it with the office of
Administrative Hearings, 67.14 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a
demand is made, this permit shall be final and binding.
This permit is not transferable except after notifying the Division of Water Quality. The Division may
require permit modification, or revocation and re -issuance. Please note that this permit does not affect
your legal obligation to obtain other permits required by the Division of Water Quality, the Division of
Land Resources, the Coastal Area Management Act, or other federal or local governments.

currently classified WS-III; NSW within subbasin 03-06-02 of the Cape Fear River Basin.

1. Flow — if the facility does not discharge during a given compliance month, the Discharge
Monitoring Report (DMR) shall report "No Flow or "No Discharge."
2. Oil and Grease — where possible, skim the grab sample from the surface of a quiescent (calm
water) zone.

Conditions:

3. The Permittee shall discharge no tank (or pipe) contents following hydrostatic testing unless
benzene concentration is less than LI9µg/L and toluene concentration is less than 11pg/L.

A. (2.) ACUTE TOXICITY -- 24-HOUR STATIC TEST (ANNUAL)
The permittee shall conduct annual toxicity tests using protocols defined as definitive in E.P.A. Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and Marine
Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24-hour static test.
Effluent samples for self-monitoringpurposes must be obtained below all waste treatment. The permittee will
conduct one test annually, with the annual period beginning in January of the calendar year of the effective date of
the permit.
The annual toxicity test must be performed by June 30. Should there be no discharge of flow from the facility
during the six month period January 1-June 30, the permittee will complete the information located at the top of the
aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county and in the
comments section indicate "No Flow for January 1-June 30, (calendar year)." The report must be signed and
submitted to the Environmental Sciences Section at the address noted below.
If no discharge event occurs from January 1-June 30, yet scharge event occurs from July i-December 31, then
the facility must perform toxicity monitoring and report the data as noted below.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit condition will
be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the appropriate
parameter code. Additionally, DWQ Form AT-1 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30
days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in
association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity
sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina Division
of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to
include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-
up testing to be completed no later than the last day of the month following the month of the initial monitoring.

Dear Ms. Sprinkle:
Enclosed please find one signed original and two copies of the application to renew the NPDES permit
for the Magellan Terminals Holdings (MTH) Greensboro II Terminal facility. MTH is requesting renewal
of the permit. There have been two changes at the facility since issuance of the last permit however only
one could potentially affect storm water discharge. MTH added a butane offloading skid and began
storing butane in five 60,000 gallon bullets in 2008 and added an ethanol offloading skid and began
storing ethanol in 2009.

At the Greensboro II Terminal stormwater is not treated by any method before discharge and therefore
solids are not generated by a wastewater treatment system. Stormwater collected in the storage tank
containment area and stormwater from the ethanol skid are the only waters that are discharged at this
facility.

All wastewater discharge is storm water. The facility does not have a wastewater treatment
system that discharges water. The facility has one Oil Water Separator that skims off any oil
or gas to a tank and discharges water into the pond before discharging from the facility.
