Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly,
we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
Further review of your Aquatic Toxicity results have warranted the following changes from the draft
permit sent to you on July 5, 2006:
➢ Footnote #1 from A. (1.) has been deleted.
➢ Attachment A. (4.) has been deleted.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a. written petition, conforming to Chapter 1 SOB of the North.
Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center,
Raleigh, North Carolina 27699-6714). Unless'such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the Segal requirements to
obtain other permits which may be required by the Division of Water Quality or permits required by the Division. of
Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may

into an unnamed tributary (UT) to Horsepen Creek, classified WS-III waters in the
Cape Fear River Basin.

There shall be no discharge of floating solids or foam visible in other than trace amounts.
Direct discharge of tank solids, tank bottom water, or the rag layer is not permitted.
The permittee shall not discharge tank (or pipe) contents fallowing hydrostatic testing unless benzene
concentration is less than 1.19 µg/L and toluene concentration is less than 11 µg/L.

SPECIAL. CONDITIONS FINAL
A. (2.) MTBE MONITORING -SPECIAL CONDITION
For the protection of public health; oil terminals discharging to waters classified as water supply (WS) waters
shall 'monitor Methyl Tertiary Butyl Ether (MTBE) for the duration of this permit.
The Division anticipates that an MTBE regulatory criterion or Water Quality Standard will be established during
the coming permit cycle. For the next cycle of permit renewals, the Division expects to apply this criterion or
standard to MTBE data collected during this permit cycle. Should the perrnittee's MTBE data indicate discharge
in excess of this criterion or Water Quality Standard, an MTBE limit will be added to the permit monitoring
requirements at renewal:

EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS - FINAL
A. (3.) ACUTE TOXICITY MONITORING (ANNUAL)
The permittee shall conduct annual toxicity tests using protocols defined as definitive in E.P.A. Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute.Toxicity of Effluents to Freshwater and Marine
Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24-hour static test.
Effluent samples for self -monitoring purposes must be obtained below all waste treatment. The permittee will .
conduct one test annually, with the annual period beginning in January of the calendar year of the effective date .
of the permit.
The annual toxicity test must be performed by June 30. Should. there be no discharge of flow from the facility
during the six month period January l-June 30,the permittee will complete the information located at the top of
the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county and in the
comments section indicate "No Flow for January 1-June 30, (calendar year)." The report must be signed and
submitted to the Environmental Sciences Section at the address noted below:
If no discharge event occurs from January I -June 30. vet a discharge event occurs from Julv 1-December 31. then
the facility must perform toxicity monitoring and report the data as noted below.
The parameter code for this test is TAE6C. All tonicity testing results required as part of this permit condition
will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the
appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30
days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemicallphysical measurements performed
in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent
toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina Division
of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and'modified to
include alternate monitoring. requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival and appropriate environmental controls, shall constitute an invalid test and will require immediate
follow-up testing to be completed no later than the last day of the month following the month of the initial
. monitoring.

INTRODUCTION
Magellan Terminals Holdings, L.P. (formerly Williams Terminal Holdings, L.P.), herein referred to
as Magellan or the permittee, requires a National Pollutant Discharge Elimination System (NPDES)
permit to dispose treated wastewater to the surface waters of the state. The Permittee's 5-year NPDES
permit has expired and they have requested renewal from the Division of Water Quality (the
Division). This Fact Sheet summarizes background information and rationale used by the Division's
NPDES Unit to determine permit limits and conditions.
FACILITY RECORDS REVIEW
Facility Description. Magellan (Table 1) operates the Magellan Greensboro 11 Terminal, which is a bulk
storage petroleum fuel distribution center in Guilford County. Discharge from the facility consists of
stormwater runoff controlled by a Water Pollution Control System consisting of. loading rack drains;
oil/water separator; waste holding tank with optional offsite disposal; gravity -drained dike containment
areas; and discharge control valves. Discharge travels to an unnamed tributary (UT) of Horsepen Creek.

Waste Load Allocation (WLA). The Division conducted a WLA in August 1989 and developed
effluent limits and monitoring requirements based on an in -stream waste concentration (IWC) of
100% (zero -flow stream). The Division judges these limits and monitoring requirements to be
appropriate for this renewal with the exception of additions and deletions listed below (see
PERMITTING STRATEGY).
Verifying Existing Stream Conditions. This facility discharges to a "zero -flow" stream, an
unnamed tributary (UT) Horsepen Creek. This creek is a Class WS-III NSW stream within the Cape
Fear River Basin. This section of Horsepen Creek is not listed as an "impaired" waterbody [not
303(d) listed].
COMPLIANCE REVIEW
Discharge Monitoring Reports (DMR) -- Effluent Data Review. DMRs were reviewed from
January 2002 through April 2006, Discharges from Outfall 001 occurred episodically, zero to four
times per monthly -- non -discharge months reported as "no flow." The permittee reported a maximum
discharge of 0.081 MGD (September 2004). Monitored parameters and are summarized in Table 2:

PERMIT CHANGES
Based on Discharge Monitoring Reports (DMRs) submitted over the last permit cycle, new permitting
strategies, and information currently available, the Division has made the following changes to the
previous permit:
• EPA Test Method 625 -- Deleted per 2005 SOP.
• Naphthalene — (not included in previous permit) added 1/Month monitoring; no limit
per 2005 SOP.
• Phenol — delete limit continue Monthly monitoring
• Benzene — Delete limit continue monthly monitoring do not change to Quarterly.
o DMRJs submitted in early 2003 and 2002 reflected four (4) hits. Since Facility new
ownership change, 9-26-03, it is my Best Professions Judgment that the current data
points used are reflective of current Terminal Operations.

Notices of Violation (NOVs). No NOV's was issued to this facility during this permit cycle.
Facility Inspections. This facility was last inspected in December 22, 2005 by the WSRO and
found to be in compliance.
Whole Effluent Toxicity (WET) Test. The facility has passed its annual acute toxicity test for four
(3) years (2002 through year 2005).
PERMITTING STRATEGY
New SOP for Oil Terminals. The Division established renewal criteria for this permit according to
the NPDES Permitting Requirements for Petroleum Bulk -Storage 2005 Permitting Strategy, version
September 9, 2005 (2005 SOP), as amended (April 14, 2006).
Cape Fear Nutrient Strategy 2006. The Division renewed this permit in accordance with the
Supplement to NPDES Permitting Strategies for the Cape Fear River Basin, 2006 Permit Renewal
(May 10, 2006). The Magellan discharge location is governed by the Cape Fear River Basin
permitting strategy for Nutrients and oxygen demanding wastes (Subbasin 30602). Therefore, this
facility is not impacted by this new permitting strategy to monitor for Total Nitrogen and Total
Phosphorus.
Phenol — Monitoring and Limits Calculations. Therefore, in accordance with SOP 2005, all
dischargers to state water supply (WS) waters shall conduct monthly effluent monitoring for total
phenol. Moreover, if analytical results suggest "reasonable potential," a phenol limit shall be included
in the permit.
Summary of Reasonable Potential Analysis (RPA). The 2005 SOP establishes 12 criteria for
renewal including those requiring a reasonable potential analysis (RPA). RPA parameters of concern
(POCs) with stream standards or criteria include benzene, toluene, MTBE and Phenols based on the
Division's review of effluent data submitted by the Permittee. The data reported by the facility in
BIMS reflected that no RPA exists for these (POCs). Resultantly, Monthly monitoring for these
pollutants will continue to be Monthly Monitoring with no limits.
MTBE, and Total Suspended Solids (TSS). Total Suspended Solids (TSS) did not exceed
permit limit of 45 mg/L during this permit cycle but must still be monitored monthly with a
45.0 mg/L limit per the 2005 SOP. This SOP rationale for continuing the TSS monitoring
and limit is that the daily maximum limit is recommended as a minimum stormwater
management practice. Similarly, MTBE was not detected and 1/Month monitoring was
reduced to 1/Quarter. Because phenol was not detected during this permit cycle, reasonable
potential will not be calculated, and no phenol limit will be included — monitoring frequency
will remain at I/Month, per SOP 2005.

Dear Charles:
Please" find 'attached the NPDES .permit applications for the renewal of the above
referenced permits. There have been no changes in the source, treatment or discharge of
wastewater at these refined product storage terminals since the last permits were issued.
Please note that Greensboro I does not utilize an oil/water separator or other treatment
system for any discharges at the terminal. Greensboro I1 continues to use an oil/water
separator for discharges of storm and wash water from the loading rack area. The
loading rack area waste water at Greensboro I iscontained and disposed off site.
There are virtually no solids generated from the containmbnt or treatment of the
wastewaters at either of these terminals. Every few years any sediments are removed
from the oil water separator(s) and the floor drain mud boxes in the loading racks. These
sediments are disposed of off -site as a product contact waste.
