Page 7 of 13 MAR-31-03.02:03 PM VIII.Mitigation P. 07 DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to pcrcnninl streams. USAGE -- In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining; wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving, similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide . for Stream Work in North Carolina, available at litip://li2o.enr.state.-nr,.us/ncwetlaiids/stm 1.Provide a brief description of the proposed mitigation plan. The purpose of this correspondence is for Mitchell & Associates, Inc., representing Mr. Tom Dugan, to submit an application for a NWP #39 for the placement of fill within approximately .17 acres of jurisdictional wetlands on my clients property. This property is located .7 miles east of HWY 17, .3 miles north of Sloop Point Rd., at the end of Windward Oaks Ln, Lot #2, Middle Point subdivision, Pender County, North Carolina. We are enclosing the permit application along with all relevant material for you approval. The purpose of the proposed fill in wetlands is to facilitate the construction of proposed house. The existing location of wetlands makes planning extremely difficult with respect to lot design that are consistent with applicable county requirements. The .17 acre impact is the minimal our client needs to build his house due to subdivision requirements and the location of the septic system. My client has chosen to limit his proposed fill to .17 acres, the minimum needed for development. In accordance with the existing permit conditions, my client is willing to place deed restrictions on the remaining wetlands (1.50 acres) to prevent any further future impacts. The applicant has considered other alternatives other than the placement of fill in wetlands to accomplish his project goals, however, the proposed plan is the only practical alternative available. Other alternatives considered were not practical, significantly more expensive, or involved either greater wetland impacts. The project has been designed to avoid and minimize potential adverse effects to neighboring wetlands, and all work conducted will be done so in strict conformance to all conditions pursuant to NWP #39 requirements, as well as all other federal, state and local requirements.
