Specifically, we still have not received your mitigation proposal, for our review and approval, for the 120 linear feet of stream impacts and 0.29 acres of wetland impacts associated with your anticipated road crossings. Our previous conversations with your Agent/Consultant, Mr. Aden Stoltzfus, left us with the understanding that you wished to offer the remaining wetland acres on the subdivision property as compensatory mitigation for the impacts authorized by Nationwide Permit 39. Subsequent conversations with your attorney, Mr. Paul Trevarrow, indicate that you no longer wish to propose such mitigation. Please submit to this office a written mitigation plan for immediate review. We also have concerns regarding other anticipated impacts to wetlands on the Morgan Wood property. Your Pre-Construction Notification Application Form, Section V, indicates that no future permit requests are anticipated for this project. Subsequent conversations have indicated that some lots on the property may not be buildable without additional wetland or stream impacts, or that potential lot owners may expect to be able to further impact wetlands on lots within the subdivision. Please note that, pursuant to Nationwide Permit 39, "the aggregate loss of waters of the United States authorized by Nationwide Permit 39 can not exceed 1/i acre. This includes any loss of waters associated with development of individual subdivision lots." Furthermore, General Condition 15 states that, generally, "the use of more than one NWP for a single and complete project is prohibited...." As Morgan Woods Phase 3 is ostensibly a single and_complete project, future impacts to waters and wetlands by individual property owners, which would exceed the aggregate 1/2 acre allowed a single subdivision under NWP 39, would be subject to the individual permit process. Therefore, we need written clarification from you regarding future anticipated impacts associated with the development of your subdivision, outlining any plans that you foresee or have approved for future impacts to waters and wetlands. We also hope that you will inform all potential purchasers that Nationwide Permits would likely not be available for further impacts to wetlands and waters within their lots. Finally, as part of this agency's obligations under Section 7 of the Endangered Species Act, we must make a determination of the potential effect of your action on the endangered Red- Cockaded Woodpecker (RCW). To enable us to make an effective determination, we will need you to perform a survey on the entire Morgan Wood Phase 3 property to identify any previously undetected active RCW cavities. As future Phases are developed, you may be required to conduct additional surveys. Also, please reference an April 30, 2003, letter from Mr. Stoltzfus, regarding regulated activities on the subject property. Specifically the items of concern were the construction of fences in wetlands, livestock utilizing wetland areas, bridged crossings of wetlands and hand clearing of wetlands. Generally the Corps does not regulate the construction of fences through wetlands unless the construction of the fence requires mechanized land clearing of wetlands, filling of wetlands, or if the fence itself would be considered fill (like a rock fence). Remember any mechanized land clearing or filling of wetlands is regulated under Section 404 of the Clean Water Act. Typically, the construction of post fences in wetlands is not regulated. As for livestock utilizing wetland areas, the Corps does not regulate livestock activities in wetlands. Generally bridging wetlands is not regulated unless the construction of the bridge requires mechanized land clearing of wetlands, filling of wetlands, or if the bridge itself would be considered fill (like a stone bridge). If landowners proposed to construct a bridge through wetlands the Corps recommends that they send us documentation so we can determine if the construction of the bridge would be a regulated activity. Hand clearing of wetlands is not a regulated activity under Section 404 of the Clean Water Act. As stated earlier, please remember that any mechanized land clearing and filling of wetlands is regulated under Section 404 of the Clean Water Act and will require a permit. After months of going back and forth on this, we have agreed to accept WRP at 2:1 - we originally discussed restrictive covenants for the remaining wetlands; however, they did not like the language of the covenants and chose not to preserve the remaining acreage. The reason I am telling you this is that I noticed that your GC has the standard Deed Notification requirement .... if they would have done the covenants, it seems to me they would have met this requirement - but since they are not doing the covenants for us they still need to satisfy your condition. Just FYI if you end up doing compliance on them. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than 11 by 17-inch format; however, DWQ may accept paperwork of any size. Page 9 of 12 USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: red-icing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed.
