DANIEL SMITH Director Bull Creek Farms LLC 304 Fox Lake Dr. Clinton, NC 28328 Subject: Notice of Deficiency Bull Creek Farms LLC AWS090173 Bladen County NOD-2020-PC-0088 Dear Mr. Sargent: NORTH CAROLINA Environmental Quality April 2, 2020 On February 15, 2020, staff of the NC Division of Water Resources (DWR), Water Quality Regional Operations Section (WQROS), were notified by Mr. Sargent of a broken irrigation line at your facility. On February 16, 2020, staff of the DWR, WQROS inspected the Bull Creek Farms LLC waste disposal system. We wish to think Mr. Sargent, who was present and assisted during the inspection. As a result of this incident, you are hereby notified that, having been permitted to have a non - discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, you have been found to have been found to be in violation of your permit as follows: Deficiency 1: Failure to maintain the collection, treatment, and storage facilities, and the land application equipment and fields shall be properly operated and maintained at all times, [I 5A NCAC 02T. 1304(b)] in accordance with Condition II 1. of Swine Waste System General Permit No. AWG100000. On February 16, 2020 it was documented by DWR staff that a six-inch irrigation line had broken underground during the transfer of waste from one lagoon to another. Several earthen containment areas were constructed in the ditch to prevent waste from reaching surface waters and leaving your property. DWR staff documented that an outside contractor was hired to help clean up all waste with larger pumps and a vacuum truck. Take advantage of your isolation valves to close off areas during irrigation events or transfer of waste to prevent possible discharges. Take all necessary additional steps to ensure your waste system remains in compliance with Section II 1 of your permit. The DWR would like to thank you for your quick mitigation of this incident. You are required to take any necessary action to address the above violation: The Division of Water Quality requests that, in addition to the specified corrective action above, please submit the following items on or before April 30, 2020 1. An explanation from the OIC for this farm regarding how this violation occurred. 2. A list from the OIC concerning the steps that will be taken to prevent these violations from occurring in the future. 3. Documentation that the irrigation line has been repaired. 4. An estimated volume of waste/water returned to the lagoon. Failure to comply with conditions in the permit may result in a recommendation of enforcement action, to the Director of the Division of Water Resources who may issue a civil penalty assessment of not more than twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A If you have any questions concerning this Notice, please contact Steve Guyton at (910) 303-0151 or at Steve. g_uytongncdenr. _ og_v.
