DANIEL SMITH Director Hd3 Farms of the Carolinas LLC PO Box 2107 Elizabethtown, NC 28337 Subject: Notice of Deficiency Ham Hock Farm AWS090103 Bladen County NOD-2020-PC-0190 Dear Mr. Hilton: NORTH CAROLINA Environmental Quality April 6, 2020 On January 16, 2020, staff of the NC Division of Water Resources (DWR), Water Quality Regional Operations Section (WQROS), inspected the Ham Hock Farm and the permitted waste disposal system. We wish to thank Mr. Curtis Barwick an Mr. David Mixon, who were present and assisted during the inspection. As a result of this incident, you are hereby notified that, having been permitted to have a non - discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 02T Section .1305, you have been found to have been found to be in violation of your permit as follows: Deficiency 1 Failure to harvest crops for which animal waste is land applied, removed from the land application site and properly managed and utilized unless other management practices are approved in the CAWMP. (Permit AWG100000 Section II 28.). On November 1, 2019, DWR staff documented with pictures from the farm entrance that grass was being cut in preparation for harvest. On December 3, 2019, DWR staff documented with pictures from the farm entrance that no effort had been made to harvest the grass cut on November 1, 2019. It was confirmed that the grass was never harvested and removed from the application field. In addition, the cover crop had been broadcast recently and discussions about establishing Bermuda grass in all spray fields in the spring. Required Corrective Action for Deficiency 1: In the future, manage the spray fields as required in the WUP by establishing the crop specified and timely harvest and removal of all crops grown. As the Permittee, you are responsible for the action of any third party contractors that manage your spray field crops. You are required to take any necessary action to address the above Deficiency: The Division of Water Quality requests that, in addition to the specified corrective action above, please submit the following items on or before June 7, 2020. 1. An explanation from the OIC for this farm regarding how this violation occurred. 2. A list from the OIC concerning the steps that will be taken to prevent these violations from occurring in the future. 3. Documentation that your spray fields have been sprigged with Bermuda. 4. If any change is made to your CA WMPprovide DWR FRO with a copy of the new CAWMP. Failure to comply with conditions in the permit may result in a recommendation of enforcement action, to the Director of the Division of Water Resources who may issue a civil penalty assessment of not more than twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A Page 3 Mr. Dean Hilton April 6, 2020 If you have any questions concerning this Notice, please contact Steve Guyton at (910) 303-0151 or at steve.guytongncdenr.gov.
