Division personnel have reviewed and approved your application for renewal of the
subject permit. Accordingly, we are forwarding the attached NPDES discharge permit.
Thank you for your comments on the draft permit. The limitations for oil & grease and
total suspended residue were recalculated based on the corrected production figures.
This permit is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
If any parts, measurement frequencies or sampling requirements contained in this
permit are unacceptable to you, you have the right to an adjudicatory hearing upon written
request within thirty (30) days following receipt of this letter.
This request must be in the form of a written petition, conforming to Chapter 150B of
the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714
Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this
decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The
Division may require modification or revocation and reissuance of the permit. This permit
does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, the Coastal
Area Management Act or any other Federal or Local governmental permit that may be
required.

A. (3.) Total Suspended Solids and Oil & Grease Reporting Requirement
Outfalls 001 and 002 shall both be independently sampled and monitored monthly for oil &
grease and Total Suspended Solids (TSS). The value reported on the discharge monitoring report
for Outfall 001 shall be the sum of mass loading from both Outfalls 001 and 002.

A. (4.) Best Management Practices (BMPs)
BMPs must be employed to ensure that excessive pollutants are not discharged to the surface
water of the state. These practices should include as a minimum the following:
• No discharge of fish or crab parts, floating solids, foam visible in other than trace amount.
• The permittee shall direct employees and provide resources to follow, at a minimum, the
following practices such that wastewater volume and wastewater constituents are reduced:
a) All hoses used to provide on demand water delivery shall be equipped with automatic
shut-off nozzles.
b) Personnel shall be instructed to eliminate flows through idle equipment.
c) All process and washdown equipment shall be fitted with high pressure/low volume
nozzles.
d) Dry cleanup shall be preformed prior to washdown of the facility
A. (5.) Dry Cleanup Requirements
Dry Cleanup shall emphasize the following techniques where practical:
a) Batter drippings shall be collected in pans under the breading tables.
b) Spilled batters shall be squeegeed off the floor prior to wet cleanup.
c) Leftover batter shall be collected in a container and disposed of properly. Discharge to
surface waters of batter residuals shall not be allowed.
d) Trays shall be placed under machines and conveyor belts to catch particles of breading or
other food products.
A. (6.) Temperature Condition
The temperature of the effluent shall not cause the temperature of the receiving stream to
increase by more than 0.8 °C above the natural water temperature during the months of June,
July, and August nor more than 2.2°C during any other month and in no case to exceed a
maximum of 32°C.
A. (7.) Biocide Condition
There shall be no chromium, zinc or copper added to the treatment system except as pre -
approved additives to biocidal compounds.
The Permittee shall obtain approval from the Division of Water Quality's Aquatic Toxicology
Unit (ATU) prior to the addition of any biocidal compound to the water discharged from
outfall(s) 001. Approval for use of new compounds (not previously approved) must be
submitted to the ATU at least 90 days in advance of any planned use of those compounds.

Introduction
The Aurora Packing Company requires a National Pollutant Discharge Elimination System
(NPDES) discharge permit to dispose of crab processing wastewater to waters of the state.
Aurora Packing Company's NPDES permit has expired and they have requested renewal of
their permit. The Division of Water Quality's NPDES Unit issues the permits for individually
permitted facilities, and determines the conditions that must be achieved prior to discharging
wastewater. This fact sheet summarizes the rationale used to determine permit limits and
conditions.
Aurora Packing Company operates a crab process facility in Beaufort County that employs 10
to 32 people'. On September 30, 1999, Aurora Packing applied for a renewed permit to replace
the expired (March 31, 2000) effective permit'.
In 1998, the facility operated 154 days'. The company handpicks crabs according to the
production schedule outlined in Table 1'.

Process wastewater is discharged through outfalls 001 and 002, at a rate not exceeding 0.007
MGD and 0.0005 MGD, respectively. Wastewater is discharged to an Unnamed Tributary to
South Creek, a stream classified SC NSW water in the Tar -Pamlico River Basin'''.

Current Stream Conditions
There are no ambient sites located directly on the Unnamed Tributary to South Creek. The
receiving stream discharges to South Creek.
South Creek was `not rated' during the latest Use -Support assessment and has one benthic
macroinvertebrate site located downstream of the confluence the Unnamed Tributary to South
Creek and South Creek.
South Creek has been removed from the state's list of impaired waters. In 1998, South Creek
was rated as impaired primarily due to DEH closing the SA classified waters for shell fishing.
Though South Creek is rated as SA waters there are no viable shell fishing resources in the
stream. Since South Creek shell fishing closures are not due to impairment, DWQ has de -listed
South Creek from the state's 303(d) list.
Technology Based Effluent Limit Development
Technology based limits were evaluated according to 40 CFR 408 Subpart B. These limits were
promulgated on June 26, 1974 and modified on June 29, 1995'. Effluent limits representing the
degree of pollutant reduction have been established as Best Practicable Technology (BPT) and
Best Conventional Technology (BCT)'. The limits for BPT and BCT are identical and only apply
to existing dischargers, processing greater than 3,000 pounds of raw material per day'.
Production figures supplied by the permittee indicate that the facility processes a maximum of

Additionally, the mass based limit for TSS and Oil & Grease apply to the total mass loading
discharged from the facility. The limit should apply to the mass discharged from both outfall
001 and 002. Therefore, the calculated limit has been applied to Outfall 001 and the permittee
has been instructed to report the sum of the mass loading from Outfalls 001 and 002.
