The Division of Water Quality (the Division) hereby issues this final permit for the subject facility. This permit
is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007, or
as subsequently amended.
Changes to Your Previous Permit. In accord with federal guidelines for seafood processing (40CFR 408),
the Division has revised effluent parameter limits for Outfalls 002, 003 and 004 to reflect production data
submitted with your permit renewal application. The Division also acknowledges -your comments on the
draft permit received May 2, 2008. We offer the following:
Total Residual Chlorine (TRC). The Division understands that the subject facility may use dilute chlorine
to wipe down processing tables and to disinfect food -contact rooms or equipment. We therefore have
removed TRC monitoring from boiler-blowdown Outfall 005. Because of difficulties quantifying TRC in a
wastewater matrix, the Division will consider all TRC values reported below 50 ug/L to be "in compliance"
with this permit. However, please continue to monitor TRC regularly according to your permit using
instrumentation appropriate to this level, as required for similar permits statewide. To date, the Division has
no data on your discharge of chlorine. After you have established a database proving that your discharges do
not impact the receiving stream, you may petition the Division to relax or discontinue monitoring. Failure to
monitor will prompt a Notice of Violation and possible assessment of fines.
Please note that your facility discharges to waters within the Neuse River Basin. All streams within this
basin have been designated nutrient sensitive waters (NSW) as a result of environmental problems including
algal -blooms in the estuary. The North Carolina Environmental Management Commission adopted rules
establishing the Neuse River Basin Nutrient -Sensitive Waters Management Strategy to reduce phosphorus
and nitrogen inputs.
If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable,
you have the right to an adjudicatory hearing upon written request within thirty (30) days after receiving this
letter. Your request must be in the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes, and must be filed with the office of Administrative Hearings, 6714 Mail Service
Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall be final and
binding.

is hereby authorized to discharge wastewater from a facility located at
Pamlico Packing Company, Inc,
28 North First Street, Vandemere, NC
Pamlico County
to receiving waters designated as the Bay River within the Neuse River Basin in accordance with
effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II, III and W
hereof.
This permit shall become effective June 1, 2008
This permit and authorization to discharge shall expire at midnight on May 31, 2013.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked, and as of this issuance, any previously issued permit bearing this number is no longer effective.
Therefore, the exclusive authority to operate and discharge from this facility arises under the permit
conditions, requirements, terms, and provisions described herein.
Pamlico Packing Company, Inc.
is hereby authorized: -
1. to continue producing fish packing wash -down wastewater (Outfall 001); fish -processing
wastewater (Outfall 002); shrimp -processing wastewater (Outfall 003); crab -processing wastewater
(Outfall 004), and boiler blowdown (Outfall'005),
from facilities located at the Pamlico Packing Company, Inc., 28 North First Street, Vandemere,
Pamlico County; and,
2. to discharge from said packing and processing works at a specified location (see attached map), into
the Bay River, a Class SC, Sw; NSW waterbody located within the Neuse River Basin.

SUPPLIMENT TO EFFLUENT LIMITATIONS
AND MONITORING REQUIREMENTS
A. (6.) TOTAL NITROGEN MONITORING
The Permittee shall calculate the annual mass loading of total nitrogen as the sum of monthly loadings, according
to the following equations:
(a) Monthly Mass Loading Obs/month) = TN x Q x 8.34
where:
TN = the average total nitrogen concentration (mg/L) of
the grab samples collected during the month
Q = the total wastewater flow discharged during the
month (MG/month)
8.34 = Conversion factor, from (mg/L x MG) to pounds
(b) Annual Mass Loading (lbs/year) = ❑ (Monthly Mass Loadings) for the calendar year
The Permittee shall report the total nitrogen concentration for each sample and the monthly mass
loading in the appropriate self -monitoring report and the annual mass loading of total nitrogen in the
December self -monitoring report for the year.
A. (7.) SPECIAL OPERATING CONDITIONS
(a) Best Management Practice (BMP) Requirements:
(1) The Permittee shall discharge no fish parts or floating solids. Discharge shall contain no
foam visible in other than trace amounts.
(2) Permittee shall direct employees and provide resources to implement, at a minimum, such
practices that wastewater volume and wastewater constituents are reduced, as follows:
• Dry cleanup to be performed prior to washdown of the facility;
• Personnel shall be instructed to stop water flow through idle
equipment;
• All process and.washdown equipment shall be fitted with high
pressure/low volume nozzles;
• All on-demand'water delivery hoses shall be fitted with automatic
shut-off nozzles.
(b) Dry Clean-up Requirements:
(1) All batter drippings shall be collected in pans under the breading tables;
(2) Spilled batter shall be squeegeed off the floor prior to wet cleanup;

(3) Perinittec shall not allow batter residuals to be discharged to surface waters; all left over
batter and solids shall be collected in a container and disposed properly;
(4) Where practical, trays shall be placed under machines and conveyor belts to collect
.particles of breading or other food products;
(5) . Employees shall be instructed to remove, by hand or other method, leftover breading
from sifters and other machines prior to these solids entering the drainage system;
(6) Flooring shall be brushed with a stiff broom prior to wet cleanup.
A. (8)USE OF BIOCIDE
The Permittee shall use no biocide(s) other than those approved by the Division for this specific
discharge. Should the Permittee intend to use a new biocide not previously approved, a request for
approval must be submitted to the Division no later than 90 days prior to its intended first use. This
approval request shall include both an accurately completed Biocide Form 101 and a Material Safety
Data Sheet (MSDS) for each proposed biocide.

FACILITY DESCRIPTION
Pamlico Packing sits on the north western shore of the Bay River where local topography is flat
and low-lying, about 0.5 feet above MSL. The Permittee operates a five- to six -day -per -week
seafood packing and processing facility that utilizes both year-round and seasonal processes.
Considering all waste streams, total discharge flow averages between 3,000 and 4,000 gallons per
day (gpd) through 5 outfalls. The report noted that there are now five discharge pipes (Outfalls
001 through 005) located within a 10-meter distance.
Outfall 001 -- fish packing (without processing) operates under General Perm it'conditions
Outfall 002 -- fish processing (bottom fish) per 40CFR 408.212(b), Subpart U.
Outfall 003 -- shrimp processing per 40CFR 408.122(b), Subpart L,
Outfall 004 -- crab processing per 40CFR 408.22(b), Subpart B.
Outfall 005 -- boiler blowdown associated with crab cooking (not process -contact wastewater)
Peak production (daily) has reached 6,000 lbs/day (shrimp), 6,000 Ibs/day (fish), and 800 lbs/day
(crab), during summer months. Pamlico removes solids by physical screening through containers
called "drain buckets" (a minor, Class 1 treatment facility). This facility discharges to the Neuse
River estuary and is not a member of the Lower Neuse River Basin Association.

Previous Permit. This facility was first permitted in 1980. The previous permit was issued on
December 29, 2005 and expires on May 31, 2008 and the Division has received the appropriate
documentation to renew.
Waste Load Allocation (WLA). The Division prepared the last Waste Load Allocation in
1991. Effluent limits were based on Guidelines (pH on saltwater guidelines). The Division views
this allocation appropriate for renewal except as noted herein.
Verification of Receiving Stream Conditions. The Division verified discharge to the Bay
River, located within sub -basin 03-04-13 [stream segment 27-150-(1)]. This waterbody has been
classified SC, Sw; NSW and ocean and wind tides influence stream flow. This waterbody is not
listed as an "impaired" on the Division's 303 (d) list. This facility discharges upstream in
proximity, but not within, a waterbody classified High Quality Waters (Sa, HQW; NSW), see
revised map.
PERMITTING APPROACH
Seafood Production. The Permittee's application estimated gross weights for processing fish (Table
2), shrimp (Table 3), and crab (Table 4), as required under federal regulations §40CFR 408, Subparts
U, L and B, respectively. Production data provided by the Permittee on December 4, 2007 is identical
to the previous renewal application. Therefore for this renewal, the Division has not revised
production -based permit limits. Applicable regulations and resulting production calculations are
summarized in the Tables 2, 3, and 4:

Outfall 002 Fish Processing -- Review of DMRs. For a 3-year period (January 2005 through
December 2007), the Permittee reported analytical results in 5 to 7 months per year — all other
months were reported.as "No flow" months, in accord with the permit. Monthly levels of Total
Suspended Solids (TSS) ranged from 0.009 lbs/day to 57 lbslday (6,814 mg/L) in compliance
with permit limits. Wide-ranging levels were reported for Oil & Grease at 0.0003 to 4.0 Ibs/day
again within limits of the permit. On January 29, 2007 the Permittee reported its lowest levels of
Total Nitrogen (0.3 mg/L TN) and Total Phosphorus (0.04 mg/L TP), while on March 21, 2007
the Permittee reported its highest TN at 799 mg/L and TP at 51.6 mg/L. Currently TN and TP are
not permit limited.
Outfall 003 Shrimp Processing -- Review of DMRs. Similar to Outfall 002, the Permittee
reported analytical results for 5 to 7 months per year — all other months reported as "No flow"
months. From January 2005 through December 2007, flow at this outfall appears relatively low,
with reported on -time rates between 2 gallons (0.00002 MGD) to 265 gallons (0.000265 MGD)
total. Monthly values for TSS range from 0.004 lbslday to 9.8 lbslday (521 mg/L). DO levels
appear consistent averaging 7.36 mg/L over 3 years. Oil & Grease levels appear relatively low
with a maximum of 4.0 Ibs/day (S.1 mg/L). TN levels vary widely from a minimum of 0.22 mg/L
(November 30, 2006) to a maximum of 566 mg/L (March 21, 2006) at 0.002809 MGD. The
Permittee reported relatively high single -day levels of TP at 38.4 mg/L and TN at 566 mg/L on
March 21, 2006,
Outfall 004 Crab Processing -- Review of DMRs. For a 3-year period (January 2005 through
December 2007), the Permittee collected samples 4 to 5 months per year — all other months were
reported as "No flow Month." Several parameters appear generally compliant such as
Temperature (seasonally within range), Dissolved Oxygen (6.7 to 8.2 mg/L), and pH (7.0 to 7.6
su). Monthly levels for TSS however range widely from a maximum of 11.1 lbslday (474 mg/L)
at < 0.003 MGD to a minimum of 0.05 lbslday (2.13 mg/L) at an estimated flow of 1000 gallons
(0.001 MGD). TN levels also varied widely from a maximum of 155 mg/L to a minimum of 1.03
mg/L reported at a flow of 0,002809 MGD for this 3-year period. Similarly TN and TP spiked on
a particular sampling day (September 9, 2006) when the Permittee report levels of TP at 33.24
mg/L and TN at 155 mg/L.
COMPLINACE SUMMARY
• The Division notes that production data provided by the Permittee has not changed since
the previous renewal. Therefore, effluent limits have not changed.
Pamlico Packing has stated on its application that it uses chlorine for cleanup, as required
by the Department of Health. The Division has therefore added TRC monitoring and a
permit limit of 28 ug/L to federally regulated Outfalls 002, 003, and 004 in compliance
with the new statewide limit standard for chlorine. However, a footnote has been added
noting that the limit and monitoring apply only if chlorine is used to disinfect effluent.
