A file search revealed that on December 18, 1995, the DWQ authorized the use of General 401 Water Quality Certification No. 2671 to impact 0.30 acres of wetlands within Smith Creek Subdivision as described within a revised application dated December 8, 1995. These included impacts to wetlands on or adjacent to the subject property, Lot 48. The revised application stated that . "The remaining area of wetlands, shown in a green shade, will be left natural and undisturbed. Lots 3, 4, 9, -10 and 47 52 are shown on the enclosed drawing to have wetlands on them. Also shown on lots 3, 4;.9,10,47-:49, and 51 52 are the minimum building lines. These minimum building lines are shown to lesson the impacted wetland.area:,No building will occur outside these minimum building lines. Also, the recorded plat will reflect th:e-.wetland area, shown in green, to be left undisturbed and natural. A note will be placed on the map to indicate tharcertain lots will contain wetland areas which are to remain in the natural existing state." +. This authorization occurred prior to the effective date of the Neuse Buffer Rule (July 21, 1997).; As such, :the DWQ. has, determined that building a home within the approved "minimum building lines" on lots 3, 4,:,8,,10,47--, 49: (including the subject property, Lot 48), and 51 - 52 was approved in 1995 and is, therefore, cons idereWl`exempt" from the buffer rule: The DWQ has also determined (based on information provided within your variance request) that the bome on the subject property, Lot 48, was constructed within the "minimum building lines". As such, a minor variance approval is not required for the existing home on the subject property, Lot 48. Please note that any impacts to wetlands, streams and/or protected buffers other than the construction of a home or outside of the "minimum building lines" for these lots shall comply with DWQ 401 Water Quality Certifications and Neuse Buffer Rules.. In addition, any development must obtain or otherwise comply with any other required federal, state or local permits or regulations including (but not limited to) Erosion and Sediment Control and Non-discharge regulations.
