I appreciate your consideration of the difficulty we would have in placing this deed notification prior to our purchase of the property, which is presently still pending. The subject property received the necessary rezoning approvals in April of this year. It is possible the 53(x) acre tract will be subdivided and developed by more than one entity and in phases. In keeping with the conditions of our wetlands permit, you and I agreed in today's conversation that a deed notification could be recorded on the subject property, whether subdivided or as a whole, at the time each portion is transferred from its current owner, Timothy E. Fincher, et al, to a new entity. The mitigation fee of fifty-four thousand dollars ($54,000) is being mailed under separate cover to the Wetlands Restoration Program. I understand there are other conditions that must be met in order for the 401 Water Quality Certification Approval to be valid. These will be followed when development begins. In addition, a copy of this letter will be forwarded to the owner as notice of this requirement and to further clarify that any departure from the referenced approved and permitted project will require notification to your office and possibly a new application and re-certification. Karen Partee Aston Properties, Inc. 6525 Morrison Boulevard Charlotte, NC, 28211 APPROVAL of 401 Water Quality Certification and Catawba River Buffer Rules with Additional Conditions; Wetland Restoration Program Dear Mr. Partee: You have our approval, in accordance with the attached conditions, to place permanent fill in 0.26 acre of jurisdictional wetlands, 0.037 acre of isolated wetlands, 210 linear feet of intermittent streams and 270 linear feet of perennial streams in order to construct the McKee Road - Weddington Road Commercial and Residential Development in Mecklenburg County, as described in your revised application received by the Division of Water Quality (DWQ) on April 30, 2003, and in additional correspondence received May 1, 2003. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3402, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands. This Certification allows you to use Nationwide Permit Number 39 when it is issued by the U.S. Army Corps of Engineers. This approval is also valid for the Catawba River Mainstem and Lake Buffer Protection Rule (15A NCAC 2B .0243). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This Certification replaces the one issued to you on July 30, 2003. -U This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills forAhis project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification, as well as the additional condition listed below: 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds on the property. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). Erosion and sediment control practices must be in full compliance with all specifications governing the proper design, r.?lucic, installation and operation and maintenance of such Best Management Practices in order to protect surface waters standards: v a. The erosion and sediment control measures for the project must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Sediment and Erosion Control Planning and Design Manual. b. The design, installation, operation, and maintenance of the sediment and erosion control measures must be such that they equal, or exceed, the requirements specified in the most recent version of the North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor-owned or leased borrow pits associated with the project. c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. d. The reclamation measures and implementation must comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act. A NCDENR N. C. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur; `4. Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If 1 IC- placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 1:x (% 5. We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate for the impacts to streams. In accordance with 15A NCAC 2R.0402 and 15A NCAC 2B.0242(7), this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H .0506(h) and 15A NCAC 2B .0233(10). Until the Wetland Restoration Program receives and clears your check (made payable to: DENR -Wetlands Restoration Program), stream impacts (including fill) shall not occur. For accounting purposes, this Certification authorizes the fill of 210 linear feet of intermittent streams and 270 linear feet of perennial streams in the Catawba River Basin, Cataloging Unit 03050103, and 270 linear feet of stream mitigation is required. Please be aware that the Wetland Restoration Program (WRP) rules require rounding of wetland impacts to the nearest foot (15A NCAC 2R .0503(b)); 6. The culverts required for this project shall be installed in such a manner that the original stream profiles are not altered (i.e. the depth of the channel must not be reduced by a widening of the streambed). Existing stream dimensions (including the pattern and profile) are to be maintained above and below locations of each culvert. The culverts shall be designed and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re-established or, if the pipes installed in a perched manner, the pipes shall be removed and re-installed correctly. The Applicant must submit a plan and receive written approval from this Office to address any head cutting that will occur as a result of this project (e.g., use of cross vanes downstream of the culvert). Use of native vegetation and other soft stream bank stabilization techniques must be used where practicable instead of rip rap or other bank hardening methods; If rip-rap is necessary, it shall not be placed in the stream bed, unless specifically approved by the Division of Water Quality; c a 7. Upon completion of the project, the Applicant shall complete and return the enclosed "Certificate of Completion" form to notify NCDWQ when all work included in the §401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401 /Wetlands Unit of the NC Division of Water Quality upon completion of the project. Please send photographs upstream and downstream of each culvert site to document correct installation along with the Certificate of Completion form. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. As a condition of your permit, you were required to make payment to the North Carolina Wetland Restoration Fund in an amount sufficient to restore 270 linear feet of warm water stream. Through coordination with the NC WRP, we have been informed that an invoice for $54,000.00 was sent to the above address on 19 June 2003 but that the NC WRP has no record of having received your payment. You should be aware that if the work that was authorized has been completed that we consider this to be a violation of Section 301 of the Clean Water Act (33 USC 1311). You are directed to submit the required payment to the NC WRP immediately, or further legal or administrative action may be taken against you, including a directive to remove the fill material from waters or wetlands. Four Mlle Creek is not on the 303d list of unpaired waters. The current land-use is undeveloped woodland and agricultural areas. The woodlands are in secondary succession, however there are some large specimens. The wetland areas can be classified, as Palustrine Broad Leaved, Scrub Shrub Temporarily Flooded, and Emergent areas (PFOlA, PSS1A, PEM1C). The hydric soil indicators included gleyed and low chroma conditions, and concretions. The site includes Iredell, Helena, and Monacan soils. These soils are map units which may have inclusions of hydric soils according to the Natural Resource Conservation Service, Technical Guide- Section H-A-2, June 1991. The perennial streams have important aquatic value. Characteristics include evidence of persistent pools; amphibians and macro-invertebrates; evidence of wildlife utilizing the stream; and rocky, gravelly, and sandy channel substrate. Veaetative Communities A majority of the site is in various stages of field succession from formerly farmed areas and woodland in succession from timbering activities. Bottomland Hardwood/Headwater Forest The Bottomland Hardwood and Headwater Forests on this site have developed in the moderately sloping drainage ways. Species, which occur in these areas, include willow oak, sweetgum, red maple, hackberry, red oak, ironwood, and other typical species that tolerate these wet and shallow root conditions. Open Field This includes all cleared non wetland areas dominated by herbaceous plants. These have been periodically mowed and are dominated by pasture grasses and perennial herbs including broomsedge, goldenrod, and bush clover. Other areas have been undisturbed for longer and are in transition to dominant species such as blackberry, greenbriar, redcedar, pines, and saplings. Mixed Forest The non-wetland forested areas of the site 'are dominated by mixed forest. The Mixed Forest is characterized by a mixture of canopy species of pines and hardwoods. Small areas within these forest areas may have a predominance of pine or hardwoods. Pines include shortleaf pine, Virginia pine, and loblolly pine, with eastern redcedar. Hardwoods include pine, sweetgum, red maple, red oak, white oak, tulip poplar, hickory, and other common species. The subcanopy contains saplings and seedlings of canopy species. Other subcanopy species include black cherry, holly, dogwood, ehn, and privet. Woody vines common in the understory include poison ivy, muscadine grape, honeysuckle, and other herbaceous and woody species. Hydrophytic Vegetation has been identified according to the National List of Plant Species That Occur in Wetlands: Southeast (Region 2), US Department of the Interior, Fish and Wildlife Service. Its current distribution according to the U.S. Fish and Wildlife Service is limited to portions of two streams - Goose Creek and Waxhaw Creek - and a small river originating from rural areas in Union County. Therefore it is not expected to occur on this site. Aquatic Habitat The aquatic systems in the project area consist of tributaries in the Catawba River Basin. A variety of wildlife is supported by these systems including mammals, birds, reptiles, amphibians, fish, insects, mollusks, and crustaceans. Therefore strict adherence to an approved erosion and sedimentation control plan will be maintained during the construction period in order to control degradation of water quality downstream and protect the areas to be preserved. The Carolina Darter (Etheostoma collis) is a fish that inhabits small streams such as those found in the project area This species has a federal status of Proposed Special Concern and a state status of Special Concern. The species prefers small clear streams of less than 15' width with moderate to swift current and a sand/gravel benthic composition. It apparently tolerates a wide range of water quality conditions and vegetation types adjacent to the streams and appears resistant to pollution. Therefore, strict adherence to an approved erosion and sedimentation control plan will be maintained during the construction period in order to control degradation of water quality. Previous studies included creating a water feature. Stormwater treatment for this project will be designed and implemented according to NCDENR and Mecklenburg County requirements. Prior to submitting this application, meetings were held with Mike Parker of NCDENR and Steve Chapin of the USACE to review the site plan, and discuss the alternatives. The permit application and supportive documentation reflects the findings of these meetings. Summery of Waters of the U.9 Wetland delineation was conducted to determine the actual extents and surveyed for planning and study purposes. Methodoloav Preliminary identification and delineation of the Jurisdictional Waters on the site were determined according to the Corps of Engineers Wetland Delineation Manual, Technical Report Y-87-1, 1987, with Appendices. Preliminary data gathering included review and interpretation of topographic maps; USDA Soil Conservation Survey; aerial photographs, and preliminary site visits to selected areas. Then the Routine On-Site Determination Method was utilized to determine the upper boundary of the wetlands. In order to make a positive wetland determination indicators of hydrophytic vegetation, hydric soil, and wetland hydrology must be identified as described in the manual. The wetland boundary and surface waters were identified in the field by Leonard S. Rindner, PWS and were reviewed and verified by the USACE (Steve Chapin). The approved map has been used for planning and potential permitting purposes. 2 General Wetland Classification and Descriotio The site is within drainage areas of an unnamed tributary of Four Mile Creek in the Catawba River Basin. Four Mile Creek is on the 303d list of impaired waters. The current land-use is undeveloped woodland and agricultural areas. The woodlands are in secondary succession, however there are some large specimens. The wetland areas can be classified as Palustrine Broad Leaved, Scrub Shrub Temporarily Flooded, and Emergent areas (PFOIA, PSS1A, PEM1C). The hydric soil indicators included gleyed and low chroma conditions, and concretions. The site includes Iredell, Helena, and Monacan soils. These soils are map units which may have inclusions of hydric soils according to the Natural Resource Conservation Service, Technical Guide- Section 11-A-2, June 1991. The perennial streams have important aquatic value. Characteristics include evidence of persistent pools; amphibians and macro-invertebrates; evidence of wildlife utilizing the stream; and rocky, gravelly, and sandy channel substrate. Venetative Communities A majority of the site is in various stages of field succession from formerly farmed areas and woodland in succession from timbering activities. Bottomland HardwoodlReadwater Forest The Bottomland Hardwood and Headwater forests on this site have developed in the moderately sloping drainage ways. Species, which occur in these areas, include willow oak, sweetgum, red maple, hackberry, red oak, ironwood, and other typical species that tolerate these wet and shallow root conditions. Open Field % This includes all cleared non-wetland areas dominated by herbaceous plants. These have been periodically mowed and are dominated by pasture grasses and perennial herbs including broomsedge, goldenrod, and bush clover. Other areas have been undisturbed for longer and are in transition to dominant species such as blackberry, greenbriar, redcedar, pines, and saplings. Mixed Forest The non-wetland forested areas of the site are dominated by mixed forest. The Mixed Forest is characterized by a mixture of canopy species of pines and hardwoods. Small areas within these forest areas may have a predominance of pine or hardwoods. Pines include shortleaf pine, Virginia pine, and loblolly pine, with eastern redcedar. Hardwoods include pine, sweetgum, red maple, red oak, white oak, tulip poplar, hickory, and other common species. The subcanopy contains saplings and seedlings of canopy species. Other subcanopy species include black cherry, holly, dogwood, elm, and privet. Woody vines common in the understory include poison ivy, muscadine grape, honeysuckle, and other herbaceous and woody species. Hydrophytic Vegetation has been identified according to the National List of Plant Species That Occur in Wetlands: Southeast (Re ogin 2), US Department of the Interior, Fish and Wildlife Service. Best Management Practices will include utilizing siltation trapping ponds and other erosion control structures where appropriate. Impacts from hazardous materials and other toxins to fish and aquatic life such as fuels will be avoided by not permitting staging areas to be located near surface waters. e) As required by the 401 Water Quality Certification conditions, measures will be taken to prevent "live" or fresh concrete from coming into contact with waters until the concrete has hardened. MITIGATION PLAN The mitigation plan is proposed to minimize the loss of streams and wetlands by the proposed development. The perennial stream and wetland complex will be avoided and will be protected by buffers in common open space. The proposed buffers will be a minimum of 50' to the extent feasible. Areas of the buffer that require clearing will be replanted with forested vegetation. The buffer plan will be submitted to the USACE and NCDWQ for approval. The developer is proposing to utilize the North Carolina Wetlands Restoration Program to meet the stream mitigation requirements. Mitigation for Stream Impacts Stream Mitigation - NWP #39 To meet restoration mitigation requirements for stream impacts by grading, the developer is proposing to contribute $54,000 to the North Carolina Wetland Restoration Program (2701f X $200/11). 4 STORMWA TER MANAGEMENT PLAN A Stormwater Management Plan will be designed and implemented for the project to meet the 401 Water Quality Certification requirements. The Stormwater Management Plan will include wet detention basins as the primary treatment system for stormwater runoff from paved surfaces and landscaping. The ponds are expected to be designed so they serve as an aesthetic amenity for the project. The planners will utilize information and guidelines provided by the North Carolina Department of Environment, Health, and Natural Resources in developing the design of wet detention basins using the Table 1.1 in the Stormwater Best Management Practices, NCDENR, April, 1999.A Stormwater Management Plan will be designed and implemented for the project to meet the 401 Water Quality Certification requirements. PROTECTION FROM FUTURE DEVELOPMENT Development of the protected areas will be deed restricted. Restrictive covenants or similar mechanisms will be developed for approval by the USACE and/or NCDWQ. Protection from Future Development Remaining streams and wetlands will be protected in common open space. As required, deed notifications or similar mechanisms will be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of al streams and ponds on the property. The US Fish and Wildlife Service has identified Schweinitz's sunflower and the Carolina heelsplitter. Schweinitz's sunflower thrives in full sun characteristic of succession fields, margins, and forested openings. Based on a review of that survey habitat conducive to support the Schweinitz's sunflower is not present area. The Carolina heelsplitter is a freshwater mussel, which prefers shaded areas either, in a ponded portion of a small stream or in runs along steep banks with moderate current. Primary habitat is waters less than three feet deep with a soft mud, muddy sand, or shady gravelly substrate. It is normally restricted to protected silted areas or under banks especially associated with obstructions such as stumps or fallen trees. Its current distribution according to the U.S. Fish and Wildlife Service is limited to portions of two streams -- Goose Creek and Waxhaw Creek -- and a small river originating from rural areas in Union County. Therefore it is not expected to occur on this site. Aquatic Habitat The aquatic systems in the project area consist of tributaries in the Catawba River Basin. A variety of wildlife is supported by these systems including mammals, birds, reptiles, amphibians, fish, insects, mollusks, and crustaceans. Therefore strict adherence to an approved erosion and sedimentation control plan will be maintained during the construction period in order to control degradation of water quality downstream and protect the areas to be preserved. The Carolina Darter (Etheostoma collis) is a fish that inhabits small streams such as those found in the project area. This species has a federal status of Proposed Special Concern and a state status of Special Concern. The species prefers small clear streams of less than 15' width with moderate to swift current and a sand/gravel benthic composition. It apparently tolerates a wide range of water quality conditions and vegetation types adjacent to the streams and appears resistant to pollution. Therefore, strict adherence to an approved erosion and sedimentation control plan will be maintained during the construction period in order to control degradation of water quality. Cultural Resources The project site is disturbed from previous agricultural activities. The State Historic Preservation Office may review of the USGS maps at the Office of State Archaeology and the Survey and Planning Office of the North Carolina Department of Cultural Resources to determine if sites are indicated on the National Historic Register within the study area. 6 Conclusion Based on the value of the jurisdictional waters and wetlands on this site, the developer through sensitive site planning has chosen to balance the site's economic viability with its environmental value and permitability. An area is determined to be a wetland when it exhibits Hydric Soil, Hydrophytic Vegetation, and Wetland Hydrology characteristics. These characteristics are required to be in accordance with the definitions in the U.S. Army Corps Wetland Delineation Manual, 1987. Areas which exhibit these three characteristics, are identified as a wetland and permits may be required for development activities within these areas. Surface waters such as perennial and intermittent creeks are also subject to Section 404 of the Clean Water Act. Wetland Survey The delineation should now be surveyed These areas are approximately indicated on the attached map, however this map should not be used as an accurate representation of wetland and stream extents. A survey would determine the actual extents more accurately and clarify the regulatory issues and potential mitigation conditions, if necessary. The attached map is for illustrative purposes only. A survey is required for the USACE to make a final jurisdictional determination on the property. The flags used to define the wetlands are yellow and blue tied together numbered sequentially as roughly depicted on the attached map. A slash (/) next to the number indicates a connection. All notes on the flags should be recorded. The point numbers must appear on the survey in a clear and legible manner. An area is determined to be a wetland when it exhibits Hydric Soil, Hydrophythic Vegetation, and Wetland Hydrology characteristics. These characteristics are required to be in accordance with the definitions in the U.S. Army Corps Wetland Delineation Manual, 1987. Areas that exhibit these three characteristics are identified as a wetland and permits are required for development activities within these areas. Surface waters such as perennial and intermittent creeks, and certain ponds are also subject to Section 404 and Section 401 of the Clean Water Act. The approximate extent of the Waters of the U.S. are depicted on the map are based on an analysis of site characteristics, topographic and soil maps, and an on-site review. Stream and Wetland Hydrology, Hydric Soil, Hydrophytic Vegetation The site is within drainage areas of an unnamed tributary of Four Mile Creek in the Catawba River Basin. The current land-use is agricultural and woodland in mid-succession. The riparian areas can be classified as Palustrine Broad Leaved, and Scrub Shrub (PFOIA, PSS1A). The U.S. Army Corps of Engineers (USACE) will likely confirm that the perennial streams and sections of the intermittent streams to have important aquatic value. Characteristics include evidence of persistent pools; amphibians and macro- invertebrates; evidence of wildlife utilizing the stream; and rocky, gravelly, and sandy channel substrate. The upper sections of the intermittent streams may be determined unimportant. The hydnc soil indicators included gleyed and low chroma conditions, and concretions. The site includes Monacan and Helena soils. These soils are map units, which may have inclusions of hydric soils according to the Natural Resource Conservation Service, Technical Guide- Section H-A-2, June 1991. Permitting Issues A permit is not required for work on the property restricted entirely to existing high ground. If the impacts require an application to the North Carolina Division of Water Quality (NCDWQ), stormwater treatment will be required as a condition of the permit for all commercial, institutional, industrial, and multi-family developments. High-density single family developments may also be required to provide stormwater treatment facilities - notably those over 30% impervious. If the entire project is over 30% you must addre$s the entire project. If the entire project is less than 30% but there are significant areas of greater than 30% impervious then the NCDWQ may require that you address those areas. The sedimentation and erosion control plan should include strong protection of the wetland areas on this site to avoid violations of the general conditions of the Nationwide Permits. C Ms. L. An application to the NCDWQ and/or USACE is required for any stream impact using Nationwide Permit 014 or #39. The maximum impact to important streams is 300 linear feet. Use of typical bottomless culverts may not avoid the regulatory process. Bridge like features may be used to minimize impacts. if impacts to streams are 1501f or more of important and/or unimportant streams, or 1/10th acre of wetlands, an application is required to the North Carolina Department of Environment and Natural Resources Division of Water Quality (NCDWQ) using Nationwide Permit #39. An application is required for any use of Nationwide Permit #14 to the NCDWQ. Minimization measures such as plan modifications may be required to reduce the impacts. With an application to the NCDWQ, storm water treatment facilities will be required by the NCDWQ as a condition of the permit for all projects, including residential projects, notably those over 30% impervious. Storm water detention may also be required. Mitigation is generally required with impacts to important streams and wetlands when an application is required. Stream mitigation can include restoring and approved degraded stream. This generally included meanders, substrate, banks, buffers, and combinations. Plans must be submitted for approval. If a permit is authorized - there is potential of participating in the state Wetland Restoration Program (WRP) for wetland and stream restoration to meet NCDWQ for requirements and the USACE requirements. Stream buffers are typically the property as part of the mitigation requirement. Permits must meet standard and general conditions, i.e. endangered species, historic properties, and other particular conditions. Comments area possible with and application from USFWS, SHPO (State Historic Preservation Office), North Carolina Wildlife Resource Commission, and other agencies. Impacts made in a first phase may impact permitting on future phases if or when the thresholds are exceeded. Therefore, and overall master plan including an evaluation of potential future permitting requirements should be conducted. The USACE and the NCDW Q the US CE will project cumulatively. Typically, based on the Subdivision Rule in the regulations, evaluate the subdivision as one project. A review with Mecklenburg Environmental Protection will be necessary to change or modify the SWIM buffer locations. The SWIM buffer relates to the actual locations of the stream bank. The SWIM buffers in this location are 35 feet. Individual Permits Individual permits are required for all activities in Waters of the U.S. that do not qualify for a Nationwide permit and are reviewed on a case by case basis by the USACE and other agencies, including NCDWQ, USFWS, NCWRC, and SHPO. As with NWP's a 401 Water Quality Certification from NCDWQ is a requirement. There is also a Public Notice. By a Memorandum of Agreement, the EPA and the USACCEd requires a strict mitigation sequence (no practicable alternative [avoidance], minimization, compensatory mitigation be followed for all Individual Permits. It is generally understood that obtaining an individual Permit may be difficult. Establishing that there are no practicable alternatives is the most important part and most difficult in the evaluation process. The USACE may ask for additional information regarding their comments. It is generally understood that individual Permits have no over 90°/ ri the Individual Permit applications that are not withdrawn are eventually approved, however applications are modified (some substantially) in the process or include additional avoidance, minimization, and mitigation conditions. Recommendations A variety of planning and permitting options should also be studied to utilize the current Nationwide Permits effectively. Avoidance and minimization of impacts to streams can reduce the regulatory process significantly. This can be achieved by incorporating the streams and wetlands into the common open space and limiting stream impacts to stream crossings. It is strongly recommended that the Individual Permit process be avoided if possible, due to the complexity. However, individual permits have been issued for projects in which an acceptable analysis of alternatives and a significant mitigation plan has been proposed. However, it will be important to anticipate the potential for extensive analysis, the time frame, potential response to the public notice, and a less predictable outcome of the process.
