Martin Marietta's Kings Mountain Quarry in Cleveland County is planning to re-locate
its processing plant. The existing plant is located on top of future mining reserves and is in the
way of our future mining operation. In December 2008 we had Fish and Wildlife Associates, Inc.
delineate the wetlands on the proposed plant site and they determined that the site contains a 3.61
acre isolated wetland. Martin Marietta requested and received a Jurisdictional Determination
from the USACOE stating that there are no waters of the US, to include wetlands present on the
proposed site. The USACOE has confirmed that the wetlands on site are isolated and non
jurisdictional. The JD was issued on August 31, 2009.
In order for Martin Marietta to construct the new plant and stockpile yard, it will be
necessary for us to fill approximately 2.69 acres of the isolated wetlands. In order to proceed
with our project, we are requesting a non-404 Jurisdictional General Permit to fill these wetlands.
Enclosed, please find five copies of the completed Pre-Construction Notification (PCN) Form,
along with associated maps. We have also enclosed copies of the USACOE JD and Identification
and Delineation of Aquatic Resources Report by Fish and Wildlife Resources, Inc. A check in
the amount in $570.00 is enclosed to cover the cost of the application.

There are Navigable Waters of the United States within the above described property subject to the permit requirements of
Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act. Unless there is a change in the law or
our published regulations, this determination may be relied upon for a period not to exceed five years from the date of this

We strongly suggest you have the wetlands on your property delineated. Due to the size of your property and/or our
present workload, the Corps may not be able to accomplish this wetland delineation in a timely manner. For a more timely
delineation, you may wish to obtain a consultant. To be considered final, any delineation must be verified by the Corps.

by the Corps. We strongly suggest you have this delineation surveyed. Upon completion, this survey should be reviewed

Introduction
Fish and Wildlife Associates, Inc. (FWA) was retained by Martin Marietta Materials, Inc. to
identify and delineate aquatic resources within a 38-acre tract on the Kings Mountain Quarry
property. The purpose of this investigation was to determine if any 404 jurisdictional waters
were present on the proposed site for the new processing plant.
Methods
Desktop Review
FWA personnel conducted a desktop review prior to the field investigation. Data sources
included USGS topographic maps, aerial maps, NRCS soil maps, as well as detailed site plans,
small scale topographic maps, and aerial maps provided by Martin Marietta Materials, Inc. A
map showing the review area is provided in Appendix A.
Field Investigation
FWA personnel conducted a field investigation of the 38-acre tract on the Kings Mountain
Quarry property on December 18-19, 2008. Based on the desktop review, areas with potential
tributaries and/or wetlands were investigated on foot. Streams were identified following the NC
Division of Water Quality's Stream Identification Form, Version 3.1. Wetlands determinations
followed the Army Corps of Engineers Wetland Delineation Manual (1987).
Wetlands identified on the tract were delineated, flagged, and GPS coordinates were recorded.
In addition, any streams identified were flagged and GPS coordinates were recorded. GPS
coordinates were converted into shapefiles and mapped in ArcMap.
Results
Desktop Review
A small pond, or open water, was shown just north of Holiday Inn Road on the USGS
topographic map and aerial maps. A blue line stream flowing north from the pond directly to
Kings Creek was shown on the USGS topographic map, but did not appear on any other data
source.
Elevations on the USGS topographic map differed from the detailed topographic maps provided
by Martin Marietta Materials. The elevation decreases from the pond to Kings Creek on the
USGS topographic map, whereas it increases on the Martin Marietta topographic maps. This is
likely due to changes made on the Kings Mountain Quarry property after the USGS topographic
maps were made.
Three drainage areas with steep slopes were shown on the detailed topographic maps. When
looking at the surrounding terrain, these areas did not appear to be natural contours. The
drainages were investigated during the field survey to determine if any tributaries were present.
Field Investigation
No 404 jurisdictional waters were found on the 38-acre tract. One isolated wetland was
identified and delineated. The wetland was in the approximate location of the pond shown on
USGS maps, but was larger, approximately 3.6 acres. A map showing the delineated wetland is
provided in Appendix A. The source of hydrology appeared to be mainly stormwater. Drainage
patterns ran from the northwest to the southeast, which agrees with the elevations on the Martin
Marietta topographic map. The wetland also receives stormwater from Holiday Inn Road.
Because this area was shown on USGS maps as a pond with outflow, it is possible a spring may
be present. Due to the road fill from Holiday Inn Road, water accumulates in the wetland, but no
surface water connection to a tributary exists.
Wetland characteristics, such as vegetative cover and hydrology, varied throughout the
delineated area. Standing water was present during the field survey, as shown from data sources
during the desktop review. Other portions of the wetland were not inundated, but saturated soils,
drainage patterns, and/or oxidized root channels were present. The Wetland Data Form is
provided in Appendix B.
Common species in the inundated portion included Salix nigra, Juncus sp. and Eupatorium
capillifolium. Platanus occidentalis, Liquidambar styrac flua, Phragmites australis, and
Baccharis halimifolia were common in areas without standing water. Other species encountered,
but not as common included Acer rubrum, Acer negundo, Juniperus virginiana, Rubus sp., and
Lonicera japonica.
The three drainages investigated for tributaries scored less than 10 on the NC DWQ Stream
Identification Forms (Appendix B). The drainages had an abundance of leaf litter and no water
was present in the channel even though there had been recent rain. A small, dirt road ran
perpendicular to the drainages. No culverts were present, and no water had pooled above the
road.
Adjacent to the northeastern end of the review area was a large industrial pond. A drainage way
was found near the northeast portion of the tract. This channel appeared to be excavated for
overflow from the lake. Water was flowing in the channel during the field survey for
approximately 75 feet until it went underground. Approximately 15 feet down the channel from
where the water flowed underground, there was a 30 foot vertical drop in the channel. No water
was present in the lower portion of the channel. The channel had no natural substrate, only rip-
rap in small and large sizes. This drainage way scored less than 19 on the Stream Identification
Form.
Conclusions
No 404 jurisdictional waters were present on the 38-acre tract on the Kings Mountain Quarry
property. However, a 3.61 acre isolated wetland was identified by FWA personnel.
Concurrence from the Army Corps of Engineers is required and a Jurisdictional Determination
Form has been prepared. Any impacts to this wetland will require an Isolated Wetland Permit
from the Division of Water Quality.
Qualifications
The field investigation and preparation of this report was conducted by Leslie K. Bilbrey of Fish
and Wildlife Associates, Inc. Ms. Bilbrey holds an M.S. from Central Missouri State University
in Biology with an emphasis in herpetology. As a research assistant at CMSU, she performed
herpetofaunal surveys in riparian and wetland habitats, researching habitat preferences and
species associations. She has avian survey experience in Great Smoky Mountains National Park,
including monitoring a protected species, the Peregrine Falcon. As a Wildlife Biologist with
FWA, Ms. Bilbrey performs surveys and habitat assessments for sensitive, threatened, and
endangered species. She performs environmental assessments, habitat evaluations, wetland
delineations, stream determinations, and faunal surveys.
