North Carolina Isolated Wetland Permit Number 11
This Permit is issued in conformity with the requirements of the North Carolina Division of Water Quality
(DWQ) Regulations in 15 NCAC 2H, Section 0.1300. It is issued to Carteret County resulting in
0.44acres of impact to isolated wetlands in Carteret County pursuant to an application filled January 7,
2003 and revised on May 21, 2003 (received on May 22, 2003) to construct the Eastern Park in
Carteret County at SR 1352 near Smyrna, NC.
The application provides adequate assurance that the discharge of fill material into wetlands in the
watershed of Core Sound in conjunction with the proposed development will not result in a violation of
applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina
certifies that this activity will not violate the applicable proportions of Section 301, 302, 303, 306, 307 of
PL 92-500 and PL 95-214 if conducted with the applicable and conditions hereinafter set forth.
This approval is only valid for the purpose and design that you submitted in your application, as
described in application dated January 7, 2003 and revised on May 21, 2003 (received on May 22,
2003). If you change your project, you must notify us and send a new application for a new Permit. If
the property is sold, the new owner must be given a copy of this Permit and approval letter and is
thereby responsible for complying with all conditions..lf total wetland fills for this project (now and in the
future) exceed one acre or total perennial stream impact exceeds 150 feet, compensatory mitigation
may be required as described in 15A NCAC 2H.1300. For this approval to be valid, you must follow the
conditions listed below. In addition, you should get any other federal, state or local permits before you
go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-discharge and Water Supply watershed regulations.
Condition(s) of Permit
1. Appropriate sediment and erosion control practices must be utilized, which equal or exceed those
outlined in the most recent version of two manuals, either "North Carolina Sediment and Erosion
Control. Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available
from the Division of Land Resources in the DEHNR Regional or Central Offices). The control
practices shall be utilized to prevent exceedances of the appropriate turbidity water quality
standards (50 NTUs in all.fresh water streams and rivers not designated as trout waters; 25
NTUs in all lakes and reservoirs, all saltwater classes; and 10 NTUs in trout waters). The
applicant shall Sedimentation and Erosion Control measures for Sensitive Waters (15A NCAC 2B
.0124) in order to protect the downstream Outstanding Resource Waters.
2. All temporary sediment and erosion control measures placed in wetlands or waters shall be
removed and natural grade restored after the Division of Land Resources has released the project;
2. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of
the state until the concrete had hardened;
3. An additional condition is that a final written stormwater management plan shall be approved by the
Division of Water Quality, Wilmington Regional Office before the impacts specified in this Permit
occur. As described in the letter of April 23, 2003 from C.T. Clayton to Noelle Lutheran, Wilmington
Regional Office, stormwater shall be directed to flow into the remaining wetlands on site to the
maximum extent practical in order to avoid an off-site discharge of the stormwater. Also, before any
permanent building is occupied at the subject site, the facilities, as approved by this Office shall
constructed and operational, and the stormwater management plan, as approved by this Office
shall be implemented

4. The applicant is hereby advised that issues raised in the Notice of Violation sent to the applicant by
DWQ's Wilmington Regional Office will need to be adequately addressed.
5. Upon completion of this project, the applicant shall complete and return the enclosed "Permit of
Completion Form" to notify DWQ that all work included in the Wetland Permit has been completed.
The responsible parry shall complete the attached form and return it to the 401/Wetland Unit of the
Division of Water Quality.
Violations of any condition herein set forth may result in revocation of this Permit or Certification and
may result in criminal and/or civil penalties. This Permit and Certification shall become null and void
unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management
Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit.
If this Permit and Certification is unacceptable to you have the right to an adjudicatory hearing upon
written request within sixty (60) days following receipt of this Certification. This request must be in the
form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed
with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. If modifications
are made to an original Certification, you have the right to an adjudicatory hearing on the modifications
upon written request within sixty (60) days following receipt of the Certification. Unless such demands
are made, this Permit and Certification shall be final and binding.

Thank you for returning my telephone call today to discuss the referenced project. As
requested, I am forwarding to you a copy of my letter to Ms. Noelle Lutheran concerning our
meeting with her on April 22, 2003. Also enclosed is a copy of the map that was attached to the

I am writing concerning the project to expand Eastern Park, near Smyrna, NC. I
live at the end of East City Road, which borders the park project. I am a commercial
fisherman and I operated a soft-shell crab operation and clam mariculture facility at the
end of East City Road. I am very concerned about sediment-laden runoff from the park
project.
As part of this project, there seems to be a drainage system constructed to drain
water into Midden's Creek during large rainfall events. I pump water into shore based
holding tanks for soft crabs and seed clams and clean water is very important to the
success of my operation.
The park project is very large and there should be ample room to hold water on
the property during any rainfall event. I will draw a rough map of a portion of the site
and I would appreciate your attention to this matter. I would love to see a creative
solution to this problem. There have been instances during rainfall events when the water
quality was greatly diminished due to the construction at the park site.

Army (DA) authorization to mechanize land clear and discharge fill material into 1.69 acres of
Section 404 wetlands for the purpose of constructing additions to the existing eastern park
recreational facility on the east side of US 70, on hills Road (SR 1353), in the headwaters

Based on the August letter, your proposal to impact 1.69 acres has been significant)
reduced to 0.44 acres of impacts to wetlands. We commend the County on modifying their laps
to accommodate the concerns of the commenting resource agencies and our office. p
On November 13, 2002, I conducted an onsite inspection to determine the jurisdictional
status`of the two proposed wetland impacted areas. My findings identified the wetland pocket,
located on the west side of the property and in the 0A0 irtrpact area, as isolated and interstate commerce. With this determination, no Department of the Arm authorization containing no
required to construct the proposed little league baseball field within this isolated wetland

from the North Carolina Division of Water Quality, who exerts jurisdictional authorit in iso

As noted in the attached letter from Mr. Mickey Sugg to Mr. John Whitehurst dated November 26, 2002,
Mr. Sugg conducted an on site inspection concerning impacted wetlands. He found one of the
impacted areas (0.40 acre pocket) to be isolated and containing no interstate commerce. The other
impacted area (0.04 acre area) was adjacent and was found to be jurisdictional under the USACE
Regulatory Authority.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity neap
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property

Division of Water Quality for projects involving greater than or equal to one acre of impacts to

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are inininaal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
