I am enclosing for this project a PCN form with all appropriate attachments and the information that you have previously requested in the above-referenced letters, including a check payable to the Division of Water Quality in the amount of $200.00. It is our intent that this project be included under NWP 39, which is effective through March 18, 2007. As the cumulative amount of wetland and stream impact is low, this is not a project which requires preconstruction notification. We understand, however, that notification to the Department of Environment and Natural Resources ("DENR") for purposes of certification under Section 401 of the Clean Water Act proceeds under state, rather than federal, authority. Summerwind Plantation, LLC ("Summerwind") does not agree that under applicable state rules and WQC #3402 written concurrence is required for 401 Certification, and believes that the Division of Water Quality is mistaken in this regard. However, based in your requests in the above-referenced correspondence, and in the interest of proceeding with the project, we have included all the information and other items requested, including a check in the amount of $200.00. We believe, to the extent one is necessary, that these items constitute a complete application under 15A NCAC 2H .0500. P. O. Since ephemeral drainage way features carry only stormwater (which is regulated similarly to wastewater, see N.C. Gen. Stat. § 143-214.7), we do not believe that they are regulated waters. The definition of "ephemeral (stormwater) stream" is so broad that virtually any project in the Neuse River Basin would be required to obtain written concurrence. If that was the intent, it would have been so stated in WQC #3402. The use of the word "feature" in lieu of "stream" in the definition and the parenthetical inclusion in the term make it clear that these features were not intended as regulated waters. However, Summerwind has taken the position to design the project with no impacts to intermittent or perennial stream channels and to where reasonable avoid and minimize impacts to ephemeral drainage ways. Where streams are proposed to be spanned the work will be consistent to the specifications in WQC #3402. The following is a summary of our new and additional efforts to avoid and minimize impacts to wetlands, perennial channels, intermittent channels, and ephemeral drainage ways. Impact Area # 1 -The plans have been modified to show a pipe arch spanning a length of 99.5 feet (originally shown as 85 feet of ephemeral and 14.5 feet as intermittent channel on November 15, 2006 wetlands map). We have added this pipe arch, because the arch will minimize impacts and can be reasonably constructed in this location. Up slope a stormwater pond and lot grading will impact 0.038 acres of wetlands and two ephemeral stormwater drainage ways. Each of these ephemeral stormwater drainage ways has a drainage area of about two acres. The drainage ways collect surface water runoff from the adjacent agricultural field. The gradient down these drainage areas is about 12% slope and the channels are in constant erosion into the piedmont clays. Impact Area #2 -The plans show a bridge spanning this intermittent stream channel. This stream has a Neuse Basin riparian buffer shown along its length. No stream or wetland impacts will be at this location. DWQ's new level spreader guidance will be used in this area to dissipate the stormwater prior to the NRB. The location and length of level spreader is shown on the plans. Impact Area #3 -The plans have been modified to show a pipe arch spanning for a length of 50 feet (originally shown as ephemeral on November 15, 2006 wetlands map). This impact is located in phase II of the project. While, detailed plans have not been finalized in this area, we believe that we can reasonably limit the length of the pipe arch I to 50 feet. Upslope and downslope the lotting arrangement will be modified so that there is no impact to any portion of this drainage way. Impact Area #4 -This impact is located in phase II of the project. Two ephemeral stormwater drainage ways or gullies will be filled in this area. All grading will be kept to a minimum and will be kept out of the adjacent Neuse Basin riparian buffer. DWQ's new level spreader guidance will be used in this area to dissipate the stormwater prior to the NRB. This impact area is located in phase II of the project. Impact Area #5 - An aerial sewer line will cross a perennial stream just off the edge of the subject property. The drawings show the location and profile of the sewer line. While, not required we decided to use the aerial crossing to avoid impact to this stream. We are anticipating wetland impacts of not more than 0.010 acres associated with the piers for the aerial line. The piers will be located to avoid the stream channel and to avoid the wetlands if at all possible, however there may be some minor impact at this location, therefore we have included this potential impact. Impact Area #6 - An aerial sewer line will cross a perennial stream at this location. The drawings show the location and profile of the sewer line. This crossing can be constructed without any stream impact. Nearby, the aerial sewer will cross over a wetland; this too can be constructed without any impact to the wetland. We believe that the above impacts have been held to a minimum and we believe that we have exceeded the requirements in many aspects. We trust that you will agree that we have minimized impacts and that the project meets within the regulations and intent of the courtesy notification. We have also shown more clearly all Neuse Basin riparian buffers and adjacent lot arrangement and building envelopes. The buffer along Swift Creek is shown as 100-foot on each side of the stream channel pursuant to Johnston County regulations. While the project will have less than 30 percent impervious cover, we will be constructing (although not required) enhanced stormwater infiltration to handle all of the increased runoff from the 1-year storm event. Due to the steep and rolling terrain on the south side of Swift Creek and across much of this site, enhanced infiltration was the best means to minimize stormwater impacts to ephemeral stormwater drainage ways, intermittent stream channels and perennial stream channels on the project. This will substantially reduce the amount of runoff that normally flows into the level spreaders and therefore will provide additional protection to the riparian buffers and downstream channels. Please review the enclosed information carefully, since we have made a number of changes to the plans to better clarify the minimal impact to streams and wetland on this property. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Only one of the road Page 5 of 9 crossings is associated with an intermittent stream and this stream will be bridged; all culverts have been located in areas of limited wetland impacts. One aerial sewer crossing will not impact stream, but has limited wetland impacts due to piers; two other aerial sewer crossing will not impact stream or wetlands. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmgide.html. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Mitigation if required is proposed for impacts to Neuse Riparian Buffer and payment will made into the EEP. Bridge roadway impacts have only limited disturbance in riparian buffer. Sewer aerial crossings are limited to 40 feet in width of disturbance in riparian buffer. Page 6 of 9 • 4 2. Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP).
