Project No. 5410 UT to Crabtree Creek [03-04-02, 27-33-(10), C NSW (nutrient sensitive)] APPROVAL of 401 Water Quality Certification and AUTHORIZATION CERTIFICATE per the Neuse River Buffer Protection Rules (15A NCAC 2B.0233) with ADDITIONAL CONDITIONS To Whom It May Concern: You have our approval, in accordance with the attached conditions and those listed below, to place fill within or otherwise impact 0.01 acres of wetlands, 105 feet of streams and 10,561 square feet (ft2) of protected riparian buffers for the purpose of constructing the proposed road, as described within your application dated April 9, 2003. After reviewing your application, we have decided that the impacts are covered by the N.C. Division of Water Quality (DWQ) General Water Quality Certification Number(s) 3404 (GC3404). The Certification(s) allows you to use Nationwide Permit(s) 14 when issued by the US Army Corps of Engineers (USAGE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 213 .0233. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control and Non-discharge regulations. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Conditions: 1. Diffuse Flow An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 2B.0233(5). 2. Certificate of Completion Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. 3. Water Quality Certification The proposed project must comply with all of the conditions of General Water Quality Certification (GC) 3404. Michael F. Easley Governor William G. Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 1508. We also request written concurrence from the North Carolina Division of Water Quality (NC-DWQ) that the project complies with the 401 Water.Quality Certification associated with Nationwide Permit 14 and the Neuse River Basin Riparian Buffer Rules (for crossing #2 only). A Pre-construction Notification Application (PCN) is attached, as well as an agent authorization form. The proposed project consists of the construction of Corporation Parkway, a proposed road that is included in the US 64 East Corridor Plan - Thoroughfare Plan (see attached). The proposed portion of Corporation Parkway is approximately 1800 linear feet in length and will extend New Hope Road (SR 2036) to Hedingham Boulevard. The location of the proposed corridor is depicted on the attached USGS map (Fig. 1) and Soil Survey map (Fig. 2). S&EC conducted a delineation of the proposed corridor for Corporation Parkway in May 2002. On May 21, 2002, Mr. Steve Mitchell of NC-DWQ determined that the stream channel at crossing #1 becomes perennial at the location depicted on the plan labeled "WET 1". Mr. Mitchell also determined that the channel impacted at crossing #2 is also perennial. However, because Corporation Parkway is passing through the proposed Raleigh International Business Park, the City of Raleigh is requiring 64 Associates, LLC (applicant and developer of the Raleigh International Business Park) to, build the road. Please note that the Environmental Division of the North Carolina Department of Justice issued a vested rights opinion for the Raleigh International Business Park, and the Raleigh Regional Office of NCDWQ determined that the Neuse River Riparian Buffer Rules will not be imposed on the stream impacted at crossing #1 (see attached letter, dated 2/14/03). However, the stream channel at crossing #2 will still be considered subject to the rules. No jurisdictional determination or permits have been issued for this project at this time. The proposed impacts for Corporation Parkway consist of 105 feet of perennial stream channel, 0.242 acre of riparian buffer, and 0.01 acre of wetland. The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and may require compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the requirements for notification (0.10 acre). The applicant requested a delineation of wetlands in the proposed Corporation Parkway corridor in order to ,minimize impact to jurisdictional features to the maximum extent practical. Corporation Parkway is a proposed road shown on the US 64 East Corridor Plan - Thoroughfare Plan. Due to design constraints, which include minimum curve radius requirements and set tie- in points with New Hope Road and Hedingham Boulevard, the proposed alignment of Corporation Parkway will result in road crossings at two locations (see plans WET .1 & WET.2). The project engineer has aligned the road to cross the two stream channels at an approximately perpendicular angle. In a further attempt to minimize impacts, the project engineer also designed a bottomless arch at crossing #2. According to the project engineer, this crossing will be constructed with a Con Span arch that will totally span the bed and bank of both sides of the stream channel and contain no mitered joints. Because the proposed collector street will cross the channels at a perpendicular angle, and because the applicant is planning to use a bottomless arch at crossing #2, S&EC believes further compensatory mitigation should not be required by the USACE. However, if the USACE determines that mitigation will be required, the applicant plans to pay into the NC Wetlands Restoration Program. NC-DWQ's current policy requires mitigation for wetland impacts greater than 1 acre and perennial stream channel impacts greater than 150 linear feet per project. Because the project impacts are below these thresholds (0.01 acre of wetland, 105 linear feet of channel), S&EC believes that neither wetland nor stream mitigation should be required by NC-DWQ for this project. NC-DWQ's current policy does not require riparian buffer mitigation for road crossings that impact less than 150 linear feet or 1/3 acre of riparian buffer per crossing. Because the proposed impact at Crossing #2 is below this threshold, and because the stream at crossing #1 is not subject to the buffers due to vested rights of the applicant, S&EC believes NC-DWQ should not require buffer mitigation for this impact. Please note that the storm drainage system for Corporation Parkway has been shown on the attached plans. Level spreaders will be used at crossing #2 to provide diffuse flow into the buffer. Please contact the project engineer, Mr. David Lasley, of Piedmont Land Design (845- 7600), if further information regarding stormwater management is required. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. The applicant must also provide justification for these impacts in Section VII below. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a delineation map, whether or not impacts are proposed to these systems. If this proposed impact is strictly for wetland or stream mitigation, list and describe the impact in Section VIII below. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at httj2://h2o.enr.state.nc.us/ncwctlands/strmgide.html. 1. House Bill 1402 specifically exempted property with existing vested rights from the application of the Neese Buffer Rules. The determination of whether vested rights exist depends on the application of the common law vested rights criteria which are as follows; , 1. Substantial expenditures and contractual obligations which occurred prior to the enactment of the law; 2, Expenditures and obligations incurred in good faith; 3. Expenditures and obligations were made in reasonable reliance upon governt=tal permits and/or approvals; and, 4. Detriment would result with application of the law. Based on the AG's opinion, it appears that the Raleigh faternational Business Park meets the requirements for common law vested rights. First, according to the materials submitted, the developers made substantial expenditures on the infrastructure of the project prior to the imposition of the Neuse Buffer Rules. Second, the developers acted in good faith as the received approval of the project from the City of Raleigh prior to the effective date of the Neuse Buffer Rules. Third, the developers relied upon governmental permission as the -project was exempt from 401" Water Quality Certification since the project was under the threshold requirements for impacts. Fourth and finally, imposition of the Neese Buffer Rules will cause the developers to suffer a detriment as they will incur substantial costs.
