A review of your application received April 10, 2003, for Department of the Army (DA) authorization to place fill material within freshwater wetlands and construct a bridge and an access road, on property located off NC Highway 12, adjacent to the North Drain and the Pamlico Sound, in Rodanthe, Dare County, North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be withdrawn from this general permit process for any reason, you will be informed regarding its further management. If there are no unresolved differences in State-Federal positions or policies, the final action taken on your application by the State will result in your receiving written notice from us that your application is consistent with the general permit and you may commence your activity. Only after receiving such confirmation should you begin work. On February 6, 1990, the DA and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to comply with the Clean Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to minimize -2- impacts on waters and wetlands; and finally, compensating for any remaining unavoidable impacts to the extent appropriate and practical. To enable us to process your application in full compliance with this MOA, we request that you provide the following additional information: a. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives, including upland alternatives, to the work for which you have applied and provide justification that your selected plan is the least damaging to water or wetland areas. b. It is necessary for you to have taken all appropriate and practical steps to minimize wetland losses. Please indicate all that you have done, especially regarding development and modification of plans and proposed construction techniques, to minimize adverse impacts. c. The MOA requires that appropriate and practical mitigation will be required for all unavoidable adverse impacts remaining after all appropriate and practical minimization has been employed. Please indicate your plan to mitigate for the projected, unavoidable loss of waters or wetlands or provide information as to the absence of any such appropriate and practical measures. This information is essential to our expeditious processing of your application and it should be forwarded to us by April 28, 2003. Also, a copy of this information must be sent to the North Carolina Division of Environmental Management to enable them to adequately evaluate your application for a Water Quality Certification pursuant to Section 401 of the Clean Water Act. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3400, which can be downloaded from our web site at htto:Hh2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed and U.S. Coast Guard regulations. PROJECT SUMMARY: This project involves the construction of approximately 0.2 mile of 2-lane, asphalt roadway, including a 30-ft wide, two lane wooden, pile supported, elevated bridge over an existing ditch to provide access to the proposed upland development on the property. Hatteras Island Resort, LLC, Dare County FIELD INVESTIGATION REPORT Page 2 Project Setting The application site is located east of NC 12 in the Village of Rodanthe, between Holiday Blvd. and Atlantic Drive in Dare County. The applicant's property extends from NC 12, east to the Atlantic Ocean and includes Villas of Hatteras Island Resort. This property consists of over 21- acres, and the western portion of the property includes 18-separate lots. Currently, there is no road frontage to access these lots. According to the North Carolina General Warranty Deed provided with the CAMA application, the lots are owned by the Hatteras Island Resort, LLC. According to the prepared platwork and permit application, the adjacent riparian property owners are Holiday Shores Partnership, LTD, c/o Phalen Realty, P.W. Trueblood, Jr., and the NC Department of Transportation. The site elevation is approximately 4-ft above the NWL of the adjacent waters of a man-made ditch, often referred to as `the North Drain'. The applicant's property is vegetated in predominately upland coastal and seaside type grasses, including Spartina patens. The property is bisected by the North Drain waterway. The North Drain flow is subject to tidal influences from the Pamlico Sound. A 5-ft wide coastal wetland fringe, of predominately Juncus roemerianus, is located along both shorelines of this waterway, as well as other wetland vegetation including Scirpus spp., Distichlis spicata, Borrichia frutescens, Myrica cerifera, Iva frutescens, Baccharis halimifolia, and Magnolia virginiana. This waterway, although crossed by several small residential roadways, connects to the Pamlico Sound, and does exhibit estuarine and coastal resource type fish and wildlife. The water depth averages 1.5-ft below the NWL, and the ditch is approximately 30-ft wide at the proposed development site. A 1.25-acre `pond' connects to the North Drain immediately south of the applicant's property. The shoreline of this `pond' area is vegetated with the same, or similar plant species as referenced above. Although this waterway is large enough in some areas to provide some navigation by canoe or kayak, navigation is limited by the series of culvert crossings between the site and the Sound, and watercraft navigation has not been observed east of NC 12. During previous site visits, juvenile fish, as well as crustaceans have been present along the shoreline, and the water bottom. No significant areas of submerged aquatic vegetation, or shellfish were observed during the application site visit. The waters of this portion of the North Drain carry the same water classification as the Pamlico Sound. The North Carolina Environmental Management Commission has designated these waters as `SA' waters (suitable for shellfish propagation and harvesting); however, the waters in this vicinity are closed to the commercial harvest of shellfish. The North Carolina Marine Fisheries and Wildlife Resources Commissions classify the waters of the Pamlico Sound as Coastal Waters. 4 { Hatteras Island Resort, LLC, Dare County FIELD INVESTIGATION REPORT Page 3 The Coastal Resources Commission (CRC) has designated these waters as Estuarine Water Areas of Environmental Concern (AEC). Also under the designation of the CRC, a Coastal Shoreline AEC extends in a contour of 75-ft landward of the NWL of this waterway. The CRC has also designated coastal wetland vegetated areas, like those described above, as a Coastal Wetland AEC. The site is unusual, in that portions of the site are located within the Estuarine Shoreline and Coastal Wetland AEC's, while a portion of the eastern most part of the property is also located within the Ocean Hazard Area, which has also been designated by the CRC as an AEC. The erosion rate for this portion of Hatteras Island is 9-ft per year. The Ocean Erodible AEC is 580-ft landward and west of the existing First Line of Stable Natural Vegetation. The large structure setback for this location is 375-ft. A preliminary review of archaeological-cultural site data for this portion of Hatteras Island indicates that there are at least four archaeological- cultural resource sites within 2,000-ft of the applicant's property. Project Description This project involves the construction of an asphalt roadway, and also the construction of a 30-ft wide two lane wooden elevated bridge over the North Drain to provide access to the 18 individual lots located on the applicant's property. The proposed roadway, referred to as "Caribbean Way', will connect to NC 12, and will extend approximately 1,100-ft east, to connect to an existing roadway located in The Villas of Hatteras Island Resort. The proposed bridge will be used to cross the existing coastal ditch to access these residential lots. The proposal will avoid the filling of the coastal resources found along, and within this bridged waterway. The roadway will be 20-ft in width, and the bridge will be 30-ft in width, and the alignment will run in an east-west direction. The bridge structure will be 40-ft in length. The bridge structure will include wood decking and guardrails. Bridge abutment retaining wall structures will also be used to support the bridge expanse at both ends of the structure. The roadway will be constructed of asphalt, supported with packed fill sand and gravel material. The bridge will be elevated at least 3-ft above the existing wetland marsh fringes on both sides of the waterway, and will be supported by wood pilings. The bridge decking will also be elevated 3-ft above the NWL of the waterway. The entire road grade will avoid the placement of fill in any coastal wetland, or estuarine water areas. The proposed roadway will result in approximately 4,245-sf of U. S. Army Corps of Engineers (USACE) jurisdictional wetland fill north of lots 13 through 17 along the north side of the property, from west to east. Approximately 500-ft of the roadway alignment is 10-ft south of the adjacent Holiday Shores Partnership property. According to this application, no other state or federal permits have been issued for this project. This proposal does not include any utility installation, or other development within any Estuarine or Ocean System Areas. f Hatteras Island Resort, LLC, Dare County FIELD INVESTIGATION REPORT Page 4 Anticipated Impacts The anticipated impacts of this project are associated with the proposed 1,100-ft, long roadway, and the 40-ft long bridge structure. The bridge structure will result in the shading of approximately 300-sf of coastal wetland fringe, and 900-sf of Estuarine Waters, respectively. The roadway will result in the filling and associated roadway construction over 2,800-sf of upland, Estuarine Shoreline area. The roadway construction will result in the filling of approximately 4,245-sf of US ACE jurisdictional wetlands. Approximately 2,000-sf of these wetlands are located within the Ocean Erodible AEC. The roadway will provide an access to 18 individual lots on the applicant's property and home site development may also result in approximately 27,000-sf of upland development, and associated land disturbance within the Estuarine Shoreline located along the North Drain system. This development will result in an undetermined increase in impervious surfaces beyond that which can be anticipated from the 21,000=sf road surface that will be constructed on the property. Site development will also result in increased turbidity of the waters of the North Drain, as it receives runoff from the adjacent and nearby residential development area. This may also result in sedimentation within these waters, and this may impact the existing coastal resources that inhabit this waterway and the adjacent wetlands. The most significant impacts that can be anticipated will result from the cumulative impacts associated with the future subdivision development, associated with both the possible additional filling of adjacent USACE jurisdictional wetlands, as well as the upland development. Increased stormwater runoff can also be anticipated, and may impact coastal resources. Although the application indicates that the proposed development of the subdivision, bridge and roadway will not exceed over an acre of land disturbance, it is anticipated that the roadway and bridge construction, as well as the residential development will in fact, result in greater than one acre of impacts, and stormwater concerns should be addressed prior to any actual subdivision development, including bridge construction. Because this development will result in the land disturbance of over 21-acres with 18-separate residential home sites located in the vicinity of known cultural or archeological resources, there exists potential for the discovery of cultural resources. Hatteras Island is known to be rich in archaeological and cultural resources. An inspection of cultural resources mapping data indicated that archaeological, or cultural resource findings have been recorded on these maps in the Avon area. This review indicates that a site has been identified within 2,000-ft of this project. It is important to reiterate that Hatteras Island has a rich heritage in cultural resources, and these maps have not been updated in at least 10 years.
