for Aurora Packing, Inc.
Beaufort County
The Division of Water Quality (the Division) hereby issues the attached NPDES permit for the
subject facility. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated October 15, 2007, or as subsequently amended.
The Division understands from your renewal application that you have not altered your facilities, but
your production of blue crab has significantly decreased since last renewal. The Division has
correspondingly adjusted your permit limits in accord with federal categorical regulations governing
blue crab processing [40CFR 408.2.2(b), Subpart B).
In order to better protect the receiving stream, the Division has added Settleable Solids to your
permit, consistent with similar seafood facilities statewide. Monitoring requirements include limits
of 5 m1/L Monthly Average and 10 ml/L Daily Maximum. We have also increased your
monitoring frequency for all parameters from annually to 1/Month. We realize that your episodic
discharge is seasonal, therefore during months when you generate no wastewater, please submit a
monthly Discharge Monitoring Report, (DMR) indicating "No discharge." This is mandatory for
permit compliance.
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within
thirty (30) days after receiving this letter. Your request must take the form of a written petition
conforming to Chapter 150B of the North Carolina General Statutes, and you must file it with the
office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-
6714. Unless such a demand is made, this permit shall be final and binding.

This permit is not transferable except after notifying the Division of Water Quality. The Division
may require permit modification, or revocation and re -issuance. Please note that this permit does
not affect your legal obligation to obtain other permits required by the Division of Water Quality,
the -Division of Land Resources, the Coastal Area Management Act, or other federal or local
governments.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.

A. (3.) Permit Special Condition - Total Suspended Solids and Oil & Grease Reporting Requirement
Outfalls 001 and 002 shall both be independently sampled and monitored monthly for oil & grease and
Total Suspended Solids (TSS).
The value reported on the discharge monitoring report for Outfall 001 shall be the sum of mass loading
from both Outfalls 001 and 002.

A. (4.) Permit Special Condition -Best Management Practices (BMPs)
BMPs must be employed to ensure that excessive pollutants are not discharged to the surface water of the
state. These practices should include as a minimum the following:
i. No discharge of fish or crab parts, floating solids, foam visible in other than trace amount.
2. The permittee shall direct employees and provide resources to follow, at a minimum, the
following practices such that wastewater volume and wastewater constituents are reduced:
a. All hoses used to provide on demand water delivery shall be
equipped with automatic shut-off nozzles.
b. Personnel shall be instructed to eliminate flows through idle equipment.
c. All process and washdown equipment shall be fitted with high pressure/low
volume nozzles.
d. Dry cleanup shall be preformed prior to washdown of the facility
A. (S.) Permit Special Condition = Dry Cleanup Requirements - Dry Cleanup shall emphasize
the following techniques, as applicable:
a. Seafood process solids shall be squeegeed off the floor prior to wet cleanup.
b. Cooking or plucking residuals shall be containerized for proper disposal.
c. Discharge to surface waters of cooking or plucking residuals shall not be allowed.
d. Trays shall be placed under machines and conveyor belts, where practical, to catch
cooking or plucking residuals; breading of other process food products.
A. (6.) Permit Special Condition - Temperature Condition
The temperature of the effluent shall not cause the temperature of the receiving stream to increase by more
than 0.8 °C above the natural water temperature during the months of June, July, and August nor more than
2.2°C during any other month and in no case to exceed a maximum of 32°C.
A (7.) Permit Special Condition - Biocide Condition
There shall be no chromium, zinc or copper added to the treatment system except as pre -approved
additives to biocidal compounds. The Permittee shall obtain approval from the Division of Water Quality's
Aquatic Toxicology Unit (ATU) prior to the addition of any biocidal compound to the water discharged
from outfall(s) 001. Approval for use of new compounds (not previously approved) must be submitted to
the ATU at least 90 days in advance of any planned use of those compounds.

Receiving -Stream Environment - The Permittee discharges to an unnamed tributary of South Creek,
a waterbody classified SC -NSW. This facility is exempt from the Tar -Pamlico River Basin Nutrient
Strategy (2010) because of its relatively low discharge volume (episodic flow limited to maximum
12,000 gallons per day — sum of two outfalls).
The Permittee generates wastewaters from two sources:
1. crab cooking via Outfall 001, and
2. crab processing via Outfall 002.
Blue Crab Production — According to the renewal application, waste -generating facilities and waste -
treatment processes have not changed from the previous permit cycle. Production is described as:

• Maximum for a single day = 15,000 lbs/day;
• Average of daily values for 30 consecutive days = 6,0001bs/day.
Outfall 002
• Maximum for a single day = 15,000 lbslday;
• Average of daily values for 30 consecutive days = 6,000 lbs/day.
Permittee monitors these outfalls separately, but reports the total effluent together under Outfall 001.
Therefore the Division developed limits by combining the production of the two outfalls.
Effluent Limit Development
Permitting Guidance. According to current NPDES Program guidance (Coleen Sullins' memo to Permit
Writers, 1993), federally regulated seafood -processing industries should adhere to the following limits
and monitoring requirements:
1. Flow — estimate Monthly, concurrent with monitoring of limited parameters
2. Temperature to WQ standard -- No monitoring
3. pH — 6.0 to 9.0 standard units for fresh waters; 6.8 to 8.5 for tidal waters
4. Biocide Special Condition
5. TSS — Limit per guidelines with monthly monitoring
6. O&G — Limit per guidelines with monthly monitoring
7. BMP/dry cleanup requirements
Effluent is subject to federal categorical regulations 40CFR 408.22(b), Subpart B, Conventional [Non -
Mechanical] Blue Crab Processing for production > 1000 lbs/day, defined as "blue crab gross weight
prior to processing." The Division calculated permit limits based on the degree of pollutant reduction
established by Best Practicable Technology (BPT) and production submitted in the application to renew.
Table 2 compares renewal limits to previous permit -cycle limits (2005), and presents equivalent
concentrations (assumes flow daily maximum of 1,200 gallons per day — the sum of both outfalls).

Monitoring Frequency and Additional Parameters of Concern: To better protect the receiving stream,
the Division has also included 1/Month monitoring of Settleable Solids (SS) with limits of 5.0 ml/L
(Monthly Average) and 10.0 ml/L (Daily Maximum). Based on NPDES permitting guidance for seafood
production, the Division has increased the monitoring frequency from Annually to Monthly. For months
when there is no production or discharge, the Permittee is instructed to submit a monthly Discharge
Monitoring Report (DMR) indicating "No discharge."
