Moore 1125 Burnside Road Manteo, NC, 27954 APPROVAL of 401 Water Quality Certification with Additional Condition Dear Mr. Moore: You have our approval, in accordance with the attached conditions, to place fill in 0.0138 acre of vegetated wetlands in order to construct a residence at 6983 Old Manns Harbor Road in Dare County, as described in your application received by the Division of Water Quality on January 24, 2003. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded from our web site at http:Hh2o.enr.state.nc.us/ncwetiands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be givers a copy of the Certification and approval letter and is thereby responsible for complying with all .conditions. If total wetland fills for this project (now or in the future) exceed one. acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). PROJECT SUMMARY: The applicant proposes to fill an isolated fresh water wetland area located within the Estuarine Shoreline Area of Environmental Concern. Robert F. Moore Field Investigation Report Page Two NARRATIVE DESCRIPTION AM" The proposed project is for a 26,549 square foot residential building lot located at 6983 Old Manns Harbor Road (SR1107), Manns Harbor community, mainland Dare County and adjacent to the Croatan Sound. The lot has an elevation of approximately 5 feet above normal water level near the Manns Harbor Road and slopes downward toward the sound where there is an elevation of approximately 2 feet. The lot has sandy soils and is vegetated with pine trees, scrub bushes and indigenous grasses. The shoreline is protected by an existing riprap structure, which is approximately 101 feet long. A fringe of Spartina patens exists along the riprap. Approximately 40 feet landward of the normal water line is an existing isolated freshwater wetland, irregularly shaped, with an area of approximately 600 square feet. The wetland area was determined on December 23, 2002 by representatives of the USACOE in preparation, for this permit application. The site visit was conducted after the area had received several inches of rain and the wetland area was flooded. The applicant is currently constructing a single family dwelling on the site. The property to the north is an undeveloped lot with riprap along the shoreline and the property to the south is a developed lot with a mobile home and riprap long the shoreline. The waters of the Croatan Sound in this area are classified as SA by the Division of Environmental Management and are open to shellfish taking. DEVELOPMENT PROPOSAL In order to level his yard and facilitate landscaping, the applicant proposes to fill the identified wetland area. The fill material will be brought in from an upland site. The area will be leveled and vegetated with grass to prevent erosion. Approximately 45 cubic yards of fill material will be required to fill the wetland area. ANTICIPATED IMPACTS The proposed project will result in the filling of approximately 600 square feet of isolated fresh water wetlands. Approximately 400 square feet of the proposed wetland fill are located within the Estuarine Shoreline Area of Environmental Concern.
