Any violation of the attached conditions or deviation from your submitted plans may subject the permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or appropriate legal action. This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case -by -case basis to modify, suspend or revoke the authorization. In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance with the provisions outlined on the most recent version of the attached Compensatory Mitigation Responsibility Transfer Form. The requirements of this form, including any special conditions listed on this form, are hereby incorporated as special conditions of this permit authorization. 2. The 1.58-acre area shown on Sheet EXH WL 3 (Wetland Restoration Plan) must be restored according to the descriptions on this Sheet under the headings "Wetland Restoration Notes and Planting Plan" and "Restoration Construction Sequence." These activities shall be completed within 120 days of receipt of all necessary federal, state and local approvals/permits. 3. The restored area (see Special Condition 2) shall be monitored in March or April and again in August or September (twice per year) annually in accordance with the description on Sheet EXH WL3 (Wetland Restoration Plan) under the heading "Wetland Monitoring Plan." Following submittal of the initial report, an annual report shall be submitted to the U.S. Army Corps of Engineers, Wilmington District, Raleigh Regulatory Field Office (Corps) no later than December 31st of each year. Monitoring shall continue for a minimum of three years or until the Corps determines that monitoring can be discontinued. 4. The existing dam shall be breached and the riser & barrel shall be removed per Sheet EXH WL 4 (Pond Breach Plan), according to the descriptions on this Sheet under the heading "Dam Breach/Pond Drain Notes." This work shall be completed within 60 days of submittal of the initial report (see Special Condition 3) unless otherwise directed in writing by the Corps. 5. Please note that this project is considered cumulative with earlier phases of the McConnell Center commercial/industrial park with respect to compensatory mitigation and Nationwide Permit thresholds. As such, impacts permitted for this project (SAW-2018-02038) are considered cumulative with impacts permitted during earlier phases authorized and documented under Action IDs: SAW-2013-02235 and related Action IDs. Current cumulative impacts to waters of the US for this single and complete project include permanent impacts (loss of waters) to 687 linear feet (0.045 acre) of stream channel (of which 547 linear feet of intermittent stream were waived per NWP General Condition 32) and 0.418 acre of wetlands, and temporary impacts to 82 linear feet (0.01 acre) of stream channel and 0.04 acre of wetlands. Site monitoring for the wetland restoration project will occur upon completion of the restoration project and annually for three (3) years post -construction. The initial report will contain an as -built survey. B. Annual monitoring reports will be completed upon completion of the restoration project and for all three years' post -construction and provided to the Corps of Engineers for review. The annual due date of the report will be established by the Corps of Engineers. C. Monitoring reports will be prepared in accordance with the Monitoring Report Guidelines below. Additionally, each monitoring report will include photos from preceding monitoring years. D. The as -built survey for the restoration project will be completed following the completion of construction to document baseline conditions. The as -built survey will include: (1) photo documentation from a minimum of three (3) locations within the wetland restoration area; and (2) a plan view diagram. The initial as -built report will be submitted to the USACE within 60 days of completion of project construction. Monitoring Report Guidelines A. Monitoring Reports should be concise and effectively provide the information necessary to describe the site conditions. B. The Monitoring Report Narrative will contain the following: 1. Project Overview a. Corps Permit Number. b. Name of party responsible for conducting the monitoring and the dates) the inspection was conducted. c. A brief paragraph describing the purpose of the project, acreage and type restoration performed. d. Written description of the location, any identifiable landmarks of the project including information to locate the project perimeter, and coordinates of the project site. e. Date the restoration project commenced and was completed. f. Short statement the existing site conditions. g. Dates of any recent corrective or maintenance activities conducted since the previous report submission. h. Specific recommendations for any additional corrective or remedial actions, if any are deemed necessary. 2. Summary Data a. Provide photo documentation to support the findings and recommendations referenced in the Monitoring Report. Submitted photos should be formatted to print on a standard 8.5" x 11" piece of paper, dated and clearly labeled with the direction from which the photo was taken. The photo location points should also be identified on the appropriate maps. 3. Maps and Plans a. Maps should be provided to show the location of the project site relative to other landscape features, locations of photographic reference points, and/or other features pertinent to the restoration plan. b. The submitted maps and plans should delineate the site perimeter. c. Each map or diagram should be formatted to print on a standard 8.5" x 11" piece of paper and include a legend and the location of any photos submitted for review. As -built plans may be included. 4. Conclusion a. A general statement should be included that describes the conditions of the project site. Restoration Construction Sequence- 1. Hold Preconstruction meeting with NCDWQ and USACE prior to commencing restoration. 2. Maintain existing skimmer sediment trap in current location. Inspect to determine skimmer placement and operation. 3. Remove non -permitted fill from the wetland area and re-establish pre -disturbance grades, while minimizing the impact of construction equipment, to the extent practicable. 4. Scarify and recondition soil as necessary. Add soil amendments such as topsoil, compost, and/or wood mulch if needed. 5. Seed area with wetland seed mixture provided in the plans. Apply lime and fertilizer at rates indicated in the plans. 6. Apply straw mulch on seeded areas. 7.
