That may be accomplished via diversions; however, it appears you are proposing up to 13 log veins. At that number, it may be more advantageous to employ a pump around. Typically, we've found pump arounds are feasible in watersheds approximately 5 square miles are less, particularly if they are highly forested watersheds. You may use diversions to adhere to the noted condition, but given the wording used in the PCN, I wanted to ensure the noted condition was abided. Thanks, Andrew W. Our mitigation of that condition has been to divert flow from the activity as much as possible and complete the work in the shortest amount of time while adhering to the standard to not exceed 10 NTUs at a given point downstream. I can plan to do a pump around, but I was thinking that the flow in Corner Rock would be too much for a successful operation. The Division has determined that your application is incomplete and cannot be processed. The application is on hold until all of the following information is received: There are references in the Pre -Construction Notification to construction occurring in the presence of streamflow and flow being diverted away from the work activity where feasible. The project must comply with Condition 11.9. of 401 General Water Quality Certification, which requires that all work in or adjacent to streams be conducted so that the flowing stream does not come in contact with the disturbed area. Typically, on streams of size similar to Corner Rock Creek, this condition is adhered to via a pump around system. Please describe how this condition will be met for the subject project. [15A NCAC 02H .0506(b)(3)] Pursuant to Title 15A NCAC 02H .0502(c) the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. Feel free to contact me if you have any questions.
