Protective Fencing The outside buffer boundary and along the construction corridor within these boundaries approved under this authorization shall be clearly marked with orange fabric fencing (or other easily identifiable material)`for the areas that have been approved to infringe within the buffer prior to any land disturbing activities to ensure compliance with 15A NCAC 2B.0243. % Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. Dear Mr. Bob Zarcecki: I am sending the enclosed application and support information to seek a letter of approval for building a house on my lakefront property on Lake Hickory. I own a small lot (0.38 acres) that is an extreme pie-shape with a small front yard, which greatly limits what I can build. In addition, the slope is steep and the soil is not the most ideal for percolation (rock and clay). The Alexander County Environmental Health Dept. requires that the house be positioned in the rear portion of the lot to allow space for the septic system. Alexander County Zoning Dept. requires that the house be oriented such that the rear of the house be at least 40 feet from the water (Rule prior to the new Buffer Zone Law) and the side of the house be at least 20 feet from Lake Hickory, which they considered a major thoroughfare. Additionally, the restrictive covenants of the subdivision require a minimum size of 2200 sq ft. Both Bert Gibson from Environmental Health Dept. and Sylvia Seturnmire from Zoning Dept. have explained that the enclosed permits are the only option for building on this property. I also feel inclined to mention that this lot is in an established neighborhood that was recorded prior to June 30, 2001. Please note that I met with Pete Colwell from DWQ prior to June 30, 2001 and provided all of the necessary information to allow your department to come to the conclusion that a similar site plan was acceptable (see previous Zoning Permit # 01-134/ Improvement permit #4069) and was provided a letter stating that "the property is exempt from the requirements of Zone 2 of the buffer rule, and uses in Zone 1 are allowable..." (please see letter written by Rex Gleason dated July 9, 2001). After planning this project with a grader and builder, I discovered that I did not have adequate turn-around space for backing out of a side entrance garage, so I made a decision to change the house plan and was, therefore, required to obtain new Zoning and Improvement permits. As you can see by comparing the previous permits to the new permits, there is a similar area of impact to the buffer zone. Please note that I will make every effort to minimize this impact and will stabilize and re-vegetate the disturbed area and also enhance the existing vegetation in undisturbed areas. I spoke with Alan Johnson on 1-9-03 and both Alan Johnson and Rex Gleason on 1-10-03 and was advised to submit a PCN because this is a "new" project (different r permit #). I have enclosed this application along with other supporting documents. Alan Johnson mentioned that he spoke to you on 1-10-03 about my request and plans to forward documents for your review. Please also note that I have just applied for permit GP30 for shoreline stabilization, FILE # 030021, and your receptionist mentioned that this PCN may be considered a modification to the application you are currently processing, and it did not appear that additional money was required of me for you to process this PCN. I am now requesting an updated approval letter from your agency naming the new site plan as acceptable. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed.
