SUBJECT: Review of'404 Permit Application, North Toe River Stabilization Project, Town
of Newland, Avery County
The applicant is requesting a letter of concurrence from the North Carolina Wildlife
Resources Commission (NCWRC) to obtain a 404 permit from the U.S. Army Corps of
Engineers. The NCWRC has reviewed information provided by the applicant, and field
biologists on our staff are familiar with habitat values of the project area. These comments are
provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.)
and the Fish and Wildlife Coordination Act (48 Stat, 401, as amended; 16 U.S.C. 661-6674).
The applicant proposes to stabilize 300 feet of bank along a ball field in Newland. The
project will provide stabilization by the installation of root wads, boulders and the establishment:
of native riparian plants. Improvements should help water quality and aquatic habitat values
through sediment: reduction. In the Newland area, Kentucky Creek is a designated wild trout
stream and the North Toe is a Designated Public Mountain Trout Water that supports wild
rainbow and brown trout. The North "Toe River also supports federal and state listed aquatic
species.
Based on the information provided by the applicant and our information on the range of
trout in the project area, we do not believe this project will cause significant effects to wagers
supporting trout providing the following conditions are implemented:
I . Instream work and land disturbance within the 25-foot wide buffer zone are
prohibited during the trout spawning season of October 15 through April 15 to
protect the egg and fry stages of trout from off-site sedimentation during
construction.
2. Stringent erosion control measures should be installed where soil is disturbed and
maintained until project completion. Sediment: and erosion control measures
shall adhere to the design standards for sensitive watersheds ( i SA NCAC 411
.0024).

3. 'temporary or permanent herbaceous vegetation should be planted on all bare soil
within 10 days (preferably sooner) of ground disturbing activities to provide
long-term erosion control.
4. Native trees, herbs and warm season grasses should be incorporated into the
project to the extent practicable. Disturbed banks may be vegetated with silky
dogwood (Cornus amonum), silky willow (Salix sericea), tag alder (Alrtrrs
serrul(acr), black willow (Salix nigra), and sycamore (Platanus occiclentalis) or
other native riparian species to provide long term bank stability, stream shading
and improved riparian buffer habitats. Note that silky dogwood, silky willow
and black willow can be planted as live stakes collected during the dormant
growing season. Cuttings should be randomly planted and done on 4 foot centers
from the waters edge to the top of the bank. Trees should be planted on 10-12
foot centers. Stream banks in these areas may also be seeded with an approved
wetland seed mix or temporary crop of wheat or rye.
5. Conservation easements or deed restrictions are recommended that permanently
preserve undisturbed trout water buffers. These buffers should extend at least
twenty-five feet from the top of each streambank. Fencing should be considered
by the Town of Newland to protect restored buffer areas.
6. Prior to final 404 permit approvals and 401 certification approvals, plan view
sketches and planting schedules should be provided to resource and regulatory
agencies for further comments if appropriate and necessary.

application regarding your plan to fill waters for the purpose of streambank stabilization and
enhancement on the North Toe River in Avery County. Approval from DWQ is required to disturb
these waters. Please provide 7 copies of the following information and refer to the DWQ # listed above
in your reply. Please show these on maps of suitable scale (for instance 1" = 100 feet) so we can begin
to determine your projects' compliance with 15A NCAC 2H .0500.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size constriction

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The project will enhance stream stability by protecting the streambanks and reducin
sediment concentrations in the stream. Stream impacts during construction will be minimized
by working from the streambank when possible, and limiting ground disturbance to those areas
where boulders and rootwads will be placed.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetiands/strmgide.html.
