The revised plan is consistent with the EFH Conservation Recommendations provided by the National Marinc Fisheries Service. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the revised permit plans dated March 18, 2003, which are a part of this permit. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. The riprap will not be positioned farther waterward than 5 feet from the normal water level elevation contour at any point along its alignment. -2- 4. No vegetated wetlands will be excavated or filled. 5. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands are not authorized. 6. The riprap material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 7. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 8. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Conditions 1. Buffer Impacts Any impacts to the protected buffers shall comply with 15A NCAC 02B .0259. No impacts shall occur to Zone 1 of the protected riparian buffers (except for uses and activities designated as "exempt" within 15A NCAC 02B .0259), unless otherwise approved by this the DWQ. 2. Pedestrian Access Paths Any proposed access paths to the piers through the protected buffers shall be limited to six (6) feet wide and elevated at least three (3) feet above any wetlands. 3. Diffuse Flow An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re-concentrate before discharging into the stream as identified within 15A NCAC 213 .0259(5). Ocracoke Holdings, LLC Hyde County Project Setting The project area is located off SR 1335 on the southwest side of Ocracoke Island at Springers Point adjacent Teaches Hole on the Pamlico Sound near Ocracoke Inlet in Hyde County, North Carolina. The site is an undeveloped 33.28 acre tract characterized by extensive salt marsh and maritime forest. Man made influences on the property include a rudimentary gravel road that leaves SR 1335 and bisects the property toward the water ending at the shoreline on the southwest side of the tract. There is also a gravesite for a previous landowner and his horse located on the southwest side of the tract. The tract was recently the subject of a conservation easement with a two lot waterfront out holding. The conservation easement is held by the Coastal Land Trust with funds to purchase the easement provided by the North Carolina Clean Water Trust Fund. The two waterfront out holdings are located on the southwest side of the property between Springers Point and Old Slough Creek. Uplands on the property are vegetated primarily with live oaks, yaupon and wax myrtle. There exist on the north and south sides of the property extensive coastal wetlands marsh vegetated primarily with Juncus roemarianus, Distichlis s ip cata, Spartina patens and Spartina alterniflora. The shoreline is a sandy shifting estuarine beach with an overwash sand berm transitioning to coastal wetlands marsh or uplands. Located at Springers Point is a relic stone jetty/groin. There is an existing stone revetment stabilizing the shoreline between Springers Point and Old Slough Creek. It appears that the existing stone revetment was constructed with a break in it some ± 175' wide in the area where the rudimentary road reaches the shoreline. Erosion has occurred in this area forming a shallow half mooned shaped area along the shoreline between the two areas of stone revetment. The remmenents of a wooden boat are located within the eroded area. A viable stand of Spartina alterniflora marsh exist within and landward of the existing stone revetment. Water depths in the project area are generally shallow (<3'). There is submerged aquatic vegetation (SAV) including eel grass Zostera marina) and shoal grass Halodule wri hth in the nearshore areas, visible from the shoreline. There are marketable shellfish in the area around Old Slough Creek. The Pamlico Sound in this area is classified as SB by the Environmental Management Commission and is open to shellfishing. Project Description The applicant is proposing to construct 1,020' of stone sill offshore the existing stone revetment between Springers Point and Old Slough Creels. The sill will be constructed 5' offshore the existing rock revetment with the exception of two areas along the shoreline where the shoreline curves landward. The sill will be constructed in a straight line across these areas. The shoreline in the smaller of these two areas is already stabilized with the existing stone revetment while the other is the location of the break in the existing stone revetment that appears to have experienced some erosion. The applicant proposes to plant coastal wetland marsh landward of the proposed stone sill in these two curved areas encompassed by the proposed stone sill. These areas are 1,127 ft2 and 5,675 ft2 respectively. Drop downs in the proposed stone sill are proposed every 100'. The drop downs will have 1.5' to V side slopes with a base width of 5'. The drop downs will be constructed to the height of mean high water. The sill will have 1.5' to l' side slopes with a base width of 13.5'. The sill will have a top width of 3' with a height of 1.5' above mean high water level. One pier system is plaiuied for each waterfront lot out holding. A 6' x 125' pier and a 6' x 135' pier are planned each with a 6' x 46' t-head platform and two slips. Anticipated Impacts The project as proposed will result in the filling of 13,770 ft' of a sandy estuarine substrate in the Pamlico Sound including areas of SAVs. Approximately 10,202 ft 2 of shallow water habitat will be encompassed by the stone revetment. SAV's are within and/or along the entire alignment of the proposed sill as well as within the 10,202 ft 2 of shallow water habitat to be sectioned off by the sill. If successful the marsh planting will create ±6,802 ft2 of coastal wetlands marsh resulting in some loss of shallow water habitat proportional to and dependent upon the success and density of the created coastal wetland marsh. The pier will shade 2,040 ft' of Pamlico Sound bottom. The project is a precursor to further development of two waterfront out holdings located on the tract. The subject property is a 33.28 parcel of land located adjacent to the Pamlico Sound in Ocracoke, Hyde County, North Carolina. The southwestern facing shoreline of the subject property currently has some areas of rip-rap along the shoreline and an existing rock groin that extends perpendicular from the shoreline on the southwest corner of the property. The existing rip-rap is currently in disrepair and is providing minimal shoreline protection at this time. The project proposes to provide additional shoreline stabilization by constructing a stone sill that will extendl,020 linear feet parallel with the southwest facing shoreline. Fish and Wildlife Service on the Public Notice (PN) for the subject project. Ocracoke Holdings, LLC, the applicant, has submitted an application for processing under the Coastal Area Management Act (CAMA)-Corps permit processing agreement. These comments are submitted in accordance with the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543). They are to be used in your determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest review (33 CFR 320.4) as they relate to protection of fish and wildlife resources. According to the Field Investigation Report (FIR) by the North Carolina Division of Coastal Management (DCM), the applicant proposes to construct a 1,020-foot-long stone sill revetment between an existing rock groin at Springers Point and Old Slough Creek. The sill would be constructed five feet waterward of an old, existing rock revetment except in two locations where the shoreline curves landward. At these two locations the sill would be constructed in a straight line across these areas. Overall, the sill would be aligned from five to 45 feet waterward of mean high water (MHW). The sill would enclose 10,202 ft2 (0.234 acre) of shallow, estuarine habitat. Project plans prepared by Quible and Associates show that the top of the sill would be 1.5 feet above MHW with a top width of three feet and a base width of 13.5 feet. Starting 100 feet south of the existing groin, the sill would have drop-downs, or partial gaps, spaced every 100 feet to allow water flow between the sound and the shallow water enclosed by the sill. The height of gap over which the water would flow is not given. Two areas (total of 6,802 ft2, or 0.156 acre) between the proposed sill and existing vegetation would be planted with marsh vegetation. Two piers would be constructed into Pamlico Sound. The tract that would be fronted by the sill has a conservation easement held by the Coastal Land Trust. There are two waterfront lots (out holdings) within the tract. There are extensive coastal marshes vegetated primarily with black needlerush (Juncus roemerianus), salt/spike grass 2 (Distichlis spicata), smooth cordgrass (Spartina alterniflora), and salt meadow cordgrass (S. patens) on the north and south sides of the tract. Water depths in the project area are generally less than three feet, and project blueprints show that the sill would be constructed in water less that two feet deep at MHW. The FIR notes that the nearshore of the project area contains submerged aquatic vegetation (SAV) such as eel grass (Zostera marina) and shoal grass (Halodule wrightii). The SAV is "within and/or along the entire alignment of the proposed sill as well as within the 10,202 ftz of shallow water habitat to be sectioned off by the sill." The FIR indicates that the stone fill for the sill would impact 0.316 acre and the two piers would shade 0.047 acre. Despite indications in the "Anticipated Impacts" section of the FIR that the sill could be placed in areas of SAV, Section 7 of the FIR states that all impacts would be to non- vegetated bottoms of Pamlico Sound. This issue should be clarified. The Service has reviewed available information on Federally threatened or endangered species known to occur in Hyde County. We have also reviewed information from the North Carolina Natural Heritage Program (NCNHP) database on the reported occurrence of these species in the County and U. S. Geologic Survey quadrangle maps. Our review indicates that the only federally listed species likely to occur near the project area is the West Indian manatee (Trichechus manatus). The NCNHP database shows that manatees have been reported within Silver Lake and in Pamlico Sound northeast of Ocracoke Township. The primary habitat requirements for the species are access to vascular aquatic plants, freshwater sources, and proximity to channels 1-2 meters deep (3.3 -6.6 feet). However, project plans indicate that sill construction would occur in water approximately two feet deep and that water depths are generally less than three feet deep. Therefore, we believe that the project is not likely to adversely affect the manatee. All five Atlantic sea turtles are protected by the ESA and may occur in the coastal waters of North Carolina (Epperly et al. 1995). These species are the loggerhead sea turtle (Caretta caretta), green sea turtle (Chelonia mydas), Kemp's ridley sea turtle (Lepidochelys kempi), hawksbill sea turtle (Eretmochelys imbricata), and leatherback sea turtle (Dermochelys coriacea). Loggerhead, green, and hawksbill turtles feed, to various degrees, on plant material. Southeastern estuaries, such as Pamlico Sound, are important habitat for sea turtles, especially immature turtles (Epperly et al. 1995). When in the water, sea turtles are under the jurisdiction of the National Marine Fisheries Service (NMFS). That agency should be contacted regarding conservation measures for sea turtles in the project area. Based on information in the FIR, Public Notice, and the NCNHP database, the Service believes that this project is not likely to adversely affect any federally listed species under Service jurisdiction, their formally designated critical habitat, or species currently proposed for federal listing under the ESA, as amended. We believe that the Corps' requirements under section 7(a)(2) of the ESA have been satisfied. We remind you that obligations under section 7 consultation must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. The Service believes that the stone sill combined with marsh grass planting is preferable to a vertical wall bulkhead as a means of erosion control. We suggest that certain design features and construction techniques could be used to benefit fish and wildlife resources. The following should be considered: 1. Project blueprints indicate that the sill would be placed on top of the existing rip rap. However, the FIR states that the sill would be five feet waterward of the existing rock revetment. Recent construction of a similar sill at Hammock Beach State Park on Bogue Sound near Swansboro (Onslow County) involved the removal of an existing bulkhead. For the proposed construction all existing rip rap should be either covered by the proposed sill or removed; 2. The drop downs in the sill are to ensure adequate water transfer. To facilitate this goal the level for water passage should be as low as possible and certainly below MHW; and, 3. All SAV within the sill footprint should be transplanted to suitable habitat within the immediate project area. With due consideration of these issues by the applicant and the Corps, the Service would not oppose a permit for this project.
