You have our approval, in accordance with the conditions listed below, to impact approximately 2,600 fe of Zone 2 of the
protected buffers to construct commercial and residential buildings at the subject property as described within your
modified variance request received by the Division of Water Quality (DWQ) Wetlands/401 Unit on August 19, 2003 and
dated August 15, 2003. This letter shall act as your Minor Variance approval as described within 15A NCAC 2B
.0259(9)(b). This approval shall replace the approval issued to "The Estate of Dorothy Mae Garrish" on February
12, 2003 and September 26, 2003.
In addition, you have our approval, in accordance with the attached conditions and those listed below, to place fill within or
otherwise impact 0.02 acres of wetlands for the purpose of constructing the commercial/residential building, as described
within your application dated January 22, 2003. After reviewing your application, we have decided that the impacts are
covered by the N.C. Division of Water Quality (DWQ) General Water Quality Certification Number(s) 3362 (GC3362). The
Certification(s) allows you to use Nationwide Permit 18 when issued by the US Army Corps of Engineers (USACE).
In addition to these approvals, you should obtain or otherwise comply with any other required federal, state or local
permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge
and CAMA. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be
given a copy of this Certification and variance approval letter and is thereby responsible for complying with all conditions.
For this approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.

Dear Mr. Zarzecki:
On behalf of Dwight Wheless, Quible & Associates, P.C. is submitting for your review and approval a
transfer of a Minor Variance for the a property known as a portion of lots 4 & 5, Block C, Wahab Village
Annex in, Ocracoke, Hyde County, North Carolina. The subject property is located at the intersection of
NC 12 and West End Road.
Dwight Wheless is in the process of purchasing the property from the Estate of Dorothy Mae Garrish and
a condition of the transaction is for the permit be transferred to his name prior to closing. Enclosed with
this correspondence is a copy of a new site plan for the subject property and the proposed impacts
associated with the design. The proposed site plan impacts 1,061 sf in Zone 2 of the Tar-Pamlico Buffer
which is considerably less than the original impact of 2,600 sf.
It is the intent of the new property owner to remain with the proposed site plan, however the plans are in
the initial stages, and impacts may increase or decrease depending on various design issues. We
therefore request that the transfer be granted under the same conditions of 2,600 sf impact within Zone 2
of the Tar-Pamlico Buffer and a final site plan will be forwarded to your office upon completion of
design and closing of the property transaction.

management plan must Include plans and specifications for stormwater management facilities that are
designed according to the most recent version of the NC DENR Stormwater Best Management Practices
Manual unless otherwise approved by the DWO. These facilities must be designed to treat the runoff from
the entire project, unless otherwise explicitly approved by the DWQ. These facilities must be designed to

Quality. Also, before any permanent building is occupied at the subject site, the facilities (as approved by
this Office) shall be constructed and operational, and the stormwater management plan (as approved by
this Office) shall be implemented. The structural stormwater practices as approved by this Office as well
as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices
shall be made without written authorization from the Division of Water Quality, (Additional stormwater
management regulations may apply for the site as per 15A NCAC 02H .1000.)
4, Deed Notifications - Deed notifications or similar mechanisms shall be placed on all retained jurisdictional
wetlands, waters and protective puffers in order to assure compliance for future wetland, water and buffer
impact These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers
approved for impact under this Certification and variance approval.
5. Buffer Mitigation / Additional Plantings - You are required to mitigatq for impacts to the protected riparian
buffers. The required area of mitigation to compensate for Impacts to the protected riparian buffers is
3,900 square feet as required under this variance approval and 15A NCAC 26.0260. The DWQ has
determined that you may satisfy this mitigation requirement by planting at least twenty-elght (28) native
woody trees and shrubs within the retained portions of the protected buffers. You must ensure their
survival for a period of a least five (5) years. You are required to replace any of these trees or shrubs that
die within this five (5) year period. You are required to provide proof in writing that the trees have been
planted within one year of the date of this letter. The proof of plantings shall be submitted to the
Wetlands/401 Unit and copied to the Washington Regional Office.
Requests for appeals of this decision shall be made to the Office of Administrative Hearings, If you do not accept any of
the conditions of this approval, you may ask for and adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 1BOB of the North Carolina
General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699.6714. This
approval and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Tar-Pamlico River Riparian Buffer Protection

buffers. The required area of mitigation to compensate for Impacts to the protected riparian buffers is
3,900 square feet as required under this variance approval and 15A NCAC 213.0260. The DWQ has
determined that you may satisfy this mitigation requirement by planting at least twenty-elght (28) native .
woody trees and shrubs within the retained portions of the protected buffers. You must ensure their
survival for a period of a least five (5) years. You are required to replace any of these trees or shrubs that
die within this five (5) year period. You are required to provide proof in writing that the trees have been
planted within one year of the date of this letter, The proof of plantings shall be submitted to the
Wetlands/401 Unit and copied to the Washington Regional Office.
Requests for appeals of this decision shall be made to the Office of Administrative Hearings, If you do not accept any of
the conditions of this approval, you may ask for and adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. This
approval and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Tar-Pamlico River Riparian Buffer Protection

Dear Ms. Oelschlegel:
You have our approval, in accordance with the conditions listed below, to impact approximately 2,600 ft2 of Zone 2 of the
protected buffers to construct a commercial/residential building at the subject property as described within your variance
request received by the Division of Water Quality (DWQ) Wetlands/401 Unit on January 31, 2003. This letter shall act as
your Minor Variance approval as described within 15A NCAC 2B .0259(9)(b).
In addition, you have our approval, in accordance with the attached conditions and those listed below, to place fill within or
otherwise impact 0.02 acres of wetlands for the purpose of constructing the commercial/residential building, as described
within your application dated January 22, 2003. After reviewing your application, we have decided that the impacts are
covered by the N.C. Division of Water Quality (DWQ) General Water Quality Certification Number(s) 3362, (GC3362). The
Certification(s) allows you to use Nationwide Permit 18 when issued by the US Army Corps of Engineers (USACE).
In addition to these approvals, you should obtain or otherwise comply with any other required federal, state or local
permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge
and CAMA. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be
given a copy of this Certification and variance approval letter and is thereby responsible for complying with all conditions.
For this approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.
Conditions:
1. No Zone 1 Impacts - No impacts (except for "exempt" uses as identified within 15A NCAC 2B .0259) shall
occur to Zone 1 of the protected riparian buffers unless otherwise approved by the DWQ.
2. Protective Fencing - The outside Zone 1 buffer boundary approved under this authorization shall be
clearly marked by orange fabric fencing for the areas that have been approved to infringe within the buffer
prior to any land disturbing activities to ensure compliance with 15A NCAC 2B .0259.
3. Stormwater Management - A final, written stormwater management plan will be required to be approved
in writing by this Office before the impacts specified in the minor variance and certification approval
occurs per Condition No. 3 in GC No. 3362 and as a condition of the variance approval. The stormwater

Dear Mr. Oelschlegal:
On January 31, 2003, the Division of Water Quality (DWQ) Wetlands/401 Unit received your request for a. Minor Variance
from the Tar-Pamlico Buffer Rules (15A NCAC 2B .0259) for the subject property. The Division'of Water Quality (DWQ) is
required to prepare a "preliminary finding" P'finding of fact" as to whether the variance request meets the. requirements of
15A NCAC 02B .0259(9)(a). The DWQ may attach conditions to a variance approval that tupport'the purpose, spirit and
intent of the riparian buffer protection program. Conditions usually include stormwater management and buffer mitigation.
Additional information will be required before we can proceed with the review of your variance request. Therefore, unless
additional information is provided as described below, we will have to move toward denial of your request per 15A NCAC 2B
.0259 and will place this project on hold as incomplete until we receive this additional information.
Additional Information Requested:
1. Wetland Impacts
The proposed placement of fill within the existing wetlands on the site requires the use of at least a Nationwide Permit
(NWP) or Regional General Permit (GP) from the U.S. Army Corps of Engineers (USACE). When using a Nationwide
or Regional General Permit you must also comply with the associated required General Water Quality Certification (GC)
from the DWQ. The USACE will most likely require the use of Nationwide Permit No. 18 for the proposed fill. This will
require the use of the DWQ General Water Quality Certification No. 3362. GC3362 requires written concurrence from
the DWQ for impacts to wetlands adjacent to waters classified as SA. Please submit two (2) copies of the attached Pre-
Construction Notification (PCN) application form to this office so that we may continue to process your minor variance
request and GC3362 approval. You may obtain information on Water Quality Certifications and the process to obtain
written concurrence from our web site at http://h2o.enr.state.nc.us/ncwetlands/basic401.html. Please be sure to identify
the project no. above (DWQ 03-0104) on your PCN application. We recommend that you contact the USACE at the
Washington Regulatory Field Office, [phone] for more information on Nationwide and Regional General Permits
and to obtain any required approval. You should also contact the Division of Coastal Management (DCM) Washington
District Office at [phone] to determined compliance with Coastal Area Management Act (CAMA) regulations.
The proposed project may require a CAMA Major Permit, which may change the Nationwide or Regional Permit
