This letter shall act as your Minor Variance approval as described within 15A NCAC 2B .0259(9)(b). This approval shall replace the approval issued to "The Estate of Dorothy Mae Garrish" on February 12, 2003 and September 26, 2003. In addition, you have our approval, in accordance with the attached conditions and those listed below, to place fill within or otherwise impact 0.02 acres of wetlands for the purpose of constructing the commercial/residential building, as described within your application dated January 22, 2003. After reviewing your application, we have decided that the impacts are covered by the N.C. Division of Water Quality (DWQ) General Water Quality Certification Number(s) 3362 (GC3362). The Certification(s) allows you to use Nationwide Permit 18 when issued by the US Army Corps of Engineers (USACE). In addition to these approvals, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge and CAMA. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and variance approval letter and is thereby responsible for complying with all conditions. The subject property is located at the intersection of NC 12 and West End Road. Dwight Wheless is in the process of purchasing the property from the Estate of Dorothy Mae Garrish and a condition of the transaction is for the permit be transferred to his name prior to closing. Enclosed with this correspondence is a copy of a new site plan for the subject property and the proposed impacts associated with the design. The proposed site plan impacts 1,061 sf in Zone 2 of the Tar-Pamlico Buffer which is considerably less than the original impact of 2,600 sf. It is the intent of the new property owner to remain with the proposed site plan, however the plans are in the initial stages, and impacts may increase or decrease depending on various design issues. We therefore request that the transfer be granted under the same conditions of 2,600 sf impact within Zone 2 of the Tar-Pamlico Buffer and a final site plan will be forwarded to your office upon completion of design and closing of the property transaction. These facilities must be designed to treat the runoff from the entire project, unless otherwise explicitly approved by the DWQ. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality, (Additional stormwater management regulations may apply for the site as per 15A NCAC 02H .1000.) 4, Deed Notifications - Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective puffers in order to assure compliance for future wetland, water and buffer impact These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this Certification and variance approval. 5. Buffer Mitigation / Additional Plantings - You are required to mitigatq for impacts to the protected riparian buffers. The required area of mitigation to compensate for Impacts to the protected riparian buffers is 3,900 square feet as required under this variance approval and 15A NCAC 26.0260. The DWQ has determined that you may satisfy this mitigation requirement by planting at least twenty-elght (28) native woody trees and shrubs within the retained portions of the protected buffers. You must ensure their survival for a period of a least five (5) years. You are required to replace any of these trees or shrubs that die within this five (5) year period. You are required to provide proof in writing that the trees have been planted within one year of the date of this letter. The proof of plantings shall be submitted to the Wetlands/401 Unit and copied to the Washington Regional Office. Requests for appeals of this decision shall be made to the Office of Administrative Hearings, If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 1BOB of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699.6714. This approval and its conditions are final and binding unless you ask for a hearing.
