Chris -We will get started on responses, but I may end up requesting an extension until I see if Sue has any
comments. We had a hiccup with DWR submittal, so the permit will be received by them in next couple of days to start
their review. I will send a formal request for extension as it is needed, but wanted to give you a heads up as Sue's first
review may take longer than normal. Please send me anything on Item 1 as you receive it from SHPO.

We have completed review of your application to use Nationwide Permit # 39 for work within potential waters of the
United States associated with the construction of the proposed Industrial Facility— NC HWY 119 project, received on
March 13, 2019, in Alamance County, NC. Thank you for the application, but we require additional information to verify
the application is complete.
1) Because of this project's location within the Henderson Scott Farm District, an environmental review through
the NC Department of Cultural Resources has been initiated (email sent April 2, 2020). We cannot verify your
project's use of Nationwide Permit 39 without their concurrence.
2) The road crossing that would impact the stream on -site is proposed with 3:1 side slopes. Please discuss why
steeper slopes (e.g. 2:1) and the use of retaining walls are not feasible to further reduce impacts.
3) As shown on sheet C-101, proposed grading on the upstream side of the crossing appears to be designed to key
into existing grades. Would the upper limits of this feature be preserved?
4) If the answer to # 3, above, is no, there appears to be 60 or more feet between the proposed road crossing and
facility's footprint. Please discuss why moving the road closer to the facility is not feasible.
5) Please provide stormwater control plans for our review of potential dewatering impacts to receiving streams.
Mitigation for dewatered stream length may be required.
Review of this application cannot be completed at this time. We will review and determine whether the application is
complete, or if additional information is required after you respond to the above requests. Please provide the requested
information within 30 days, or your application will be withdrawn. Feel free to contact me with any questions or
concerns.
