I've taken another look at this. Given the location and the fact that the revised work is on smaller tribs, I still
concur with the May Affect, Not Likely to Adversely Affection biological conclusions. Hopefully this email
will be sufficient documentation.

Hi Gary,
I've recently learned that one of the assumptions upon which I made the biological conclusions for aquatic species for
Phase 2 of the Smith Creek Greenway project is incorrect. The revised design now calls for two tributary streams to Smith
Creek to be piped under the greenway crossing rather than boardwalked/bridged, and may call for a temporary
construction access across another stream (design pending). I'm told by the designers that boardwalk in the two areas to
be piped is not feasible due to scour concerns and constructability. Given the impacts to the tributary streams, I still
believe a MA-NLAA call is appropriate for the Neuse River waterdog, Carolina madtom, Atlantic pigtoe, and dwarf
wedgemussel, but I will need additional concurrence from USFWS due to the design change. Stream impacts will have
typical pump -around operations, work will be conducted "in the dry', E&S measures will be in place, etc. One of the
affected streams is intermittent and the other is perennial.
As a refresher on this project, a link to the original concurrence request is below. Everywhere in the document that states
"tributaries to Smith Creek will be crossed with boardwalk and bridge structures" is now incorrect for a couple of the
tributaries. Please let me know your thoughts on this matter at your convenience.

I am working on another greenway project — this will be Phases 2 and 3 of the Town of Wake Forest's Smith Creek
Greenway, connecting existing trails from south of Burlington Mills Rd. to Heritage High School. The project is seeking
federal LAP funding, but does not yet have the funding secured. I spoke with Heather Smith in our office recently, who
mentioned you would prefer for greenway projects to be sent directly to you for review instead of going through the
Raleigh RRO's automated self -certification process. May I submit this project which does not yet have, but is seeking
federal funding to you for review, or should I go through the automated process?
