S. Fish and Wildlife Service on the Public Notice (PN), dated February 19, 2003, for the subject. project. Mr. John Geewax, the applicant, has submitted an application for processing under the Coastal Area Management Act (CAMA)-Corps permit processing agreement. These comments are submitted in accordance with the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and section 7 of the Endangered Species Act (ESA) of 1973, as amended (16 U.S.C. 1531-1543). They are to be used in your determination of compliance with 404(b)(1) guidelines (40 CFR 230) and in your public interest review (33 CFR 320.4) as they relate to protection of fish and wildlife resources. According to the Field Investigation Report (FIR) by the North Carolina Division of Coastal Management (DCM), the applicant proposes to modify an active CAMA/Dredge and Fill Permit (No. 78- 01) that was issued to the previous landowner. This permit authorized dredging a 55-foot by 450-foot channel, constructing a four-slip pier, bulkheading 246 feet of shoreline, and constructing 377 feet of retaining wall. The applicant now proposes to enlarge the dredging to create a 30 foot by 750 foot channel, add a new pier and boathouse, add 403 feet of bulkhead, and place 107 feet of rip rap around an area of Spartina alterniflora marsh. According to. project drawings, current depths in the area to be dredged range from 2.5 to 5.0 feet, but the water condition (high, low, or mean) is not specified. There are some scattered area of submerged aquatic vegetation (SAV), shoal grass (Halodule wrightii), in the project vicinity. The proposed bulkhead would extend a total of 649 feet And the 107 feet of rip rap would create over 750 feet of hard, shoreline structures. Such hard structures reflect a portion of the wave energy that would be directed back into the sound. The reflected wave energy would erode the base of the revetment and lead to deeper water in front of the revetment. In turn, the deeper water would allow stronger waves to strike the bulkhead, further increasing erosion, and lead to deeper, less productive water waterward of the hardened shoreline. The Service believes that a stone sill backed by a natural marsh or shallow unvegetated bottoms is preferable to a vertical wall bulkhead as a means of erosion control. The concept is similar to that developed by Quible and Associates for Ocracoke Holdings (Action ID No. 200310328) not far from the project area. The low sill would allow water to flow behind the sill and create areas that could be . v colonized by estuarine marsh and serve as fish nursery areas. Natural vegetation is often the most effective protection from erosion. A vegetative buffer effectively absorbs wave energy during high water events. Such buffers slow down the rate of shoreline recession and act as a natural trap for sand. We suggest that certain design features and construction techniques for such a sill could be used to benefit fish and wildlife resources and have included these recommendations as an attachment. The Service has reviewed available information on Federally threatened or endangered species known to occur in Hyde County. We have also reviewed information from the North Carolina Natural Heritage Program (NCNHP) database on the reported occurrence of these species in the project area. Our review indicates that the only federally listed species likely to occur near the project area. is the West Indian manatee (Trichechus manatus). The NCNHP database shows that manatees have been reported within Silver Lake and in Pamlico Sound northeast of Ocracoke Township. The primary habitat requirements for the species are access to vascular aquatic plants, freshwater sources, and water 1-2 meters deep (3.3 - 6.6 feet). Federal laws do not authorize any take (death, injury, or harassment) of the manatee. For this project we believe that precautions are warranted for the manatee due to: (1) past sightings of manatees near the project site; (2) SAV near the project site; and, (3) construction in water deeper than 3.3 feet. To address the issue of construction activities in water that could be used by the manatee, the Service developed guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West Indian Manatee in North Carolina," for activities that do not include the use of explosives. A copy of these precautions is attached. With the inclusion of these guidelines or seasonal work restrictions, we believe that the Corps' requirements under section 7(a)(2) of the ESA would be satisfied.. We remind you that obligations under section 7 consultation must be reconsidered if. (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. With due consideration of these issues by the applicant and the Corps, the Service would not oppose a permit for this project. After reviewing your application, we have determined that the water impacts are covered by the Division of Water Quality (DWQ) General Water Quality Certification Number 3351. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers per 15A NCAC 213 .0259. In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Conditions: 1. I checked the status of the Geewax property. We recieved the modifications on April 24, 2003. The modifications included changing the proposed bulkhead to ripap to reflect comments from the FWS and NUTS. They also reflect comments made by the DWQ. The modifications where sent to the Washington Regional Office for review. They are in the process of reviewing the information. As a result of these comments the proposed bulkhead on the Pamlico Sound shoreline has been changed to rip-rap. The rip-rap shoreline will allow water movement behind the rip-rap and create areas that could support estuarine marsh and serve as fish nursery areas as well as provide a stabile shoreline for the property owner. The CAMA Major Modification that has been requested, is for the maintenance dredging of the existing Cochran Channel. The additional dredge area shown on the enclosed plat has been permitted under CAMA Major Permit # 78-01, therefore there is no new dredging being proposed at this time. Quible & Associates staff have inspected the existing Cochran Channel and have found that there is no SAV in the maintenance dredge area. However, during the dredging process if any SAV is encountered alterations of the dredge alignment will be made in order to avoid disturbance and minimize impacts to the SAV. John Geewax Ocracoke/Pamlico Sound Hyde County Project Setting The project site is located off SR 1357 (Gastrin Drive) on Ocracoke Island near Horse Pen Point adjacent the Pamlico Sound in Hyde County North Carolina. The site is a sandy berm bordered on the north side by the Pamlico Sound and to the south by a coastal wetland marsh vegetated primarily with Juncus roemeranus (Black Needlerush). The east side of the property is bordered by coastal wetland marsh and Southward Creek. The sandy berm ranges in width fiom t 70' to ±200' (in the vicinity of an earlier spoil area) and has an elevation of approximately 44' above the normal water level. Access to the sandy berm is by a t20' wide x ±250' long filled road across the coastal marsh. Vegetation on the north side of the berm consist of Spartina patens (Salt Meadow Grass), Ammophila breviligulata (American beach grass), Hydrocotyle bonariensis (Pennywort) and Uniola paniculata (Sea oats). There are intermittent stands of Spartina alterniflora marsh located along the shoreline. The south side of the berm is vegetated with Myrica cerifera (Wax myrtle) and Juniperus virginiana (Red cedar). Vegetation is sparse in the center of the property as a result of it serving as a dredge spoillborrow area during a previous dredging project. The elevation in the center of the property is ±3' lower than the surrounding uplands due to the removal of the previously dredged sand material. The aquatic nearshore area is part of a shallow sandy shoal that extends some ±700' offshore. Water depths are between l' to 3' deep. There are some scattered beds of Halodule wri htii (shoal grass) in the project vicinity. There are some opportunistic oyster clusters along the shoreline and an active clam lease located immediate vicinity. The project area was the site of a previous dredging project that included a dredged access channel and basin authorized by Major CAMA/Dredge and Fill pen-nit No. 132-87. The existing access channel has filled in along the dredged aligiunent. The existing basin has experienced some shoaling as well. Water depths in the channel alignment are between 2 to 3'. This channel has not been maintained since 1995. The pier structure authorized by Major CAMA/Dredge and Fill permit No. 132-87 was never built. The Pamlico Sound in this area is classified as SA by the Environmental Management Commission and is open to shellfishing. Project Description The applicant and current owner of the project area currently posses an active CAMA/Dredge and Fill Permit No. 78-01. CAMA/Dredge and Fill Permit No. 78-01 was originally issued to the previous property owner, Claudia Touhey, on 22 June 2001 and was transferred to the current property owner, John Geewax on 12 December 2001. The permit currently authorizes an 55' x 450'access channel off the existing basin and access channel to a new basin with a proposed pier structure with 4 boat slips as well as 246' of bulkhead and 377' of retaining wall. Due to shoaling in the existing access channel the applicant has requested to modify CAMA/Dredge and Fill permit no. 78-01 to include excavation of a 30' wide x 750' long channel along the original dredged alignment to the existing dredged basin authorized by Major CAMA/Dredge and Fill permit No. 132-87 . Excavation of this access channel will result in 1, 670 cubic yards of sand spoil to be placed in the spoil area permitted by CAMA/Dredge and Fill Permit No. 78-01. A hydraulic dredge will pump the sand to the diked spoil retention area. The spoil area capacity will be exceeded so the applicant proposes to remove some of the spoil material during the dredging work. The applicant has reported the spoil area capacity to be 2,020 cubic yards. The project proposal would result in a total of :3,367 cubic yards of spoil material(amount of spoil reported in previous and current permit application). The applicant has also requested to modify CAMA/Dredge and Fill permit no. 78-01 to include the construction of an additional 403' of bulkhead aligned at the normal water level for a total of 699'. The applicant also proposes to place 107' of riprap around an area of Spartina alterniflora marsh. The applicant has also requested an additional pier system, 6' wide 196' long with a 40' long breakwater built underneath the pier adjacent the two proposed slips and a proposed 13' x 30' boathouse. Anticipated Impacts The proposed project modification will increase the excavation of shallow water habitat from ±24,750 ft2 to ±47,250 ft2. The proposed modification will increase the removal of sand from the estuarine system from 1,697 to 3,367 cubic yards.
