The Wilmington Regional Office received your copy of the 401 Application impacts to 0.037
acres of jurisdictional wetlands associated with the construction of a single-family residence on Lot # 18
within the Turtle Creek Subdivision on Loggerhead Court on Oak Island, Brunswick County. After the
404 permit is issued by the Corps of Engineers, you are authorized to proceed under General Water
Quality Certification # 3402 (attached). Written concurrence from DWQ is not required provided that
you can meet all of the conditions of this certification.
If at anytime during construction of your project you determine that you cannot meet these
conditions or if there are any unpermitted impacts to wetlands or water quality, you must contact this

Enclosed is a 401 Water Quality Certification application for your review. This application is submitted
on behalf of Mr. James (Hal) Bolin for a 0.41-acre lot located in the Turtle Creek subdivision in Oak Island,
NC. The applicant is proposing to build a home that will pump wastewater to an existing offsite nitrification
field. Because the lot consists completely of 404 wetlands, impacts could not be avoided. However, he has
minimized impacts by only filling a portion of the house footprint (the rest of the house will be on pilings over
wetlands) and by using retaining walls around the fill area. The proposed project will result in 0.037 acre of
wetland impacts. To mitigate for these impacts, Mr. Bolin proposes to create 0.037 acre of 404 wetlands on a
lot located at 2210 E. Pelican Drive. In addition, all remaining wetlands on both lots that are not located under
proposed structures will be preserved in perpetuity through deed restrictions.
The Pre-Construction Notification form, associated maps, site plan, and mitigation plan are enclosed for
your review. In addition, the $200 application fee has been submitted to Cyndi Karoly. Please contact me ifyou

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should

IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and
certifications were issued or withdrawn. Provide photocopies of previously issued permits,
certifications or other useful information. Describe previously approved wetland, stream and
buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project,
list and describe permits issued for prior segments of the same T.I.P. project, along with
construction schedules.
The subject lot is entirely jurisdictional 404 wetland per Mr. Tom Farrell of the Corps. The
wetland delineation at the mitigation site was reviewed in the field by Mr. Farrell on 3/29/05 and
the wetland survey is enclosed in this permit application for his final sign off.
A CAMA Minor Permit is required to complete the mitigation. This application has been
submitted to Steve Edwards with the Town of Oak Island.

VI. Proposed Impacts to Waters of the United States/Waters of the State

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The lot is entirely 404 wetland, therefore impact avoidance on the nronerty for home
construction is impossible. Applicant has minimized required fill area by placing the house at the
minimum 30' setback from the road and planning a house constructed on pilings with only 1599
square feet of fill for a driveway, parkinsz area and walkway.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors

including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http:/ih2o.enr.state.ne.us/ncwetlands/strmPide.html.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
A wetland creation site was identified by te applicant and examined with the Corps
representative. General mitigation site construction and methodologies were reviewed with
the Corps on site. See the attached mitigation plan narrative and plat. Preservation of the
remaining wetlands on the subject lot as well as the natural and created wetlands on the
mitigation site will be accomplished through Declarations of Conservation for each property
to be recorded at the Brunswick County Register of Deeds. The restrictions within the
Declarations will run with the land. See the attached completed Declarations.
2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP). Please note it is the applicant's responsibility to contact the NCWRP at
(919) 733-5208 to determine availability and to request written approval of mitigation prior
to submittal of a PCN. For additional information regarding the application process for the
NCWRP, check the NCWRP website at http://h2o.enr.state.nc.us/wm/index.litm. If use of
the NCWRP is proposed, please check the appropriate box on page three and provide the

There are currently no impervious surfaces on the subject lot. The total planned impervious
surfaces on the lot will total 3700 square feet. This equals 20.7% of the .41 acre lot area. The
majority of the lot will remain in its vegetated condition and act as a filter for runoff.
XII. Sewage Disposal (required by DWQ)
Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of
wastewater generated from the proposed project, or available capacity of the subject facility.

1.0 Introduction
In order to mitigate for wetland impacts associated with the construction of one home within
Lot 18 in the Turtle Creek Subdivision in Oak Island, the owner of the lot, Mr. Hal Bolin agrees to
create wetlands at 2210 E. Pelican Drive at a one to one impact to creation ratio and to preserve all
non-impacted wetlands within both lots for perpetuity through a deed restriction. Lot 18 is
approximately 0.41 acre in size and is located off of Loggerhead Court, between 66'x' and 67°i Streets in
Oak Island, Brunswick County, NC (Figure 1). The mitigation site is 0.24 acre in size and is located at
2210 E. Pelican Drive, which is adjacent to Davis Creek. Mr. Bolin and his wife own both lots.
The applicant proposes to create wetlands by excavating a designated upland area that is 0.037
acre in size to surrounding wetland grade. A variety of sluubs and trees that are similar to vegetation
growing in adjacent wetlands will be planted in these areas. In addition, 0.35 acre of wetlands will be
preserved in perpetuity.
2.0. Site Description
2.1 Impact Site
The 0.41-acre impact site is located off of Loggerhead Court in the Turtle Creek
Subdivision in Oak Island, North Carolina (Figure 2). It consists entirely of 404 freshwater
wetlands and is vegetated by Acer rubruin, Gordonia lasianthus, Persea borbonia, and Nyssa
aquatica. Soils consist of Leon fine sand (Figure 3).
2.2 Mitigation Site
The 0.24-acre mitigation site is located between East Pelican Drive and Davis Creek.
This lot contains uplands except for a small freshwater and coastal wetland fringe located
along Davis Creek. Existing high ground elevations are 4' to 6.5' above MLW (Figure 4).
Coastal wetlands are vegetated by Spartina alterniflora and freshwater wetlands contain
Myrica cerifera. Uplands contain Juniperus virginiana and flex vorntitoria. One home currently
exists on the site. Soils consist of Newhan fine sand in the uplands, Corolla fine sand in the
freshwater wetlands, and Bohicket silty loam in the coastal wetlands (Figure 5).

3.0 Mitigation
3.1 Wetland Creation
A total of 0.037 acre of existing uplands will be lowered to the approximate grade of
adjacent wetlands (Figure 6). Native shrub species (Table 1) will then be planted in the
creation area on a 10' spacing (approximately 16 plants). It should be noted that existing
trees of significant size will be preserved in order to help to maintain wildlife habitat within
the wetland creation area. No excavation will occur within a 4' radius from the trunk of these
trees. From there, excavation will occur at a 2:1 slope, eventually connecting into the wetland
creation area (Figure 7). This will allow an approximate 8' radius around these trees.
3.2 Wetland Preservation
Approximately 0.35 acre of both created (0.037 ac at E. Pelican Drive) and existing
(0.313 ac at Lot 18) wetlands that are not located under proposed structures will be preserved
through deed restrictions, which will ensure that the wetlands will remain in their natural
state in perpetuity.
4.0 Monitoring
A general site analysis will occur directly after mitigation activities have been completed,
which will consist of taking photographs of the created wetlands and preparing a small narrative to
be submitted to the Corps office. From then on, monitoring will occur annually for up to five years
(if the Corps determines the site to be successful prior to five years, monitoring will discontinue).
During each monitoring event, the vegetation within the created area will be counted and identified.
Success criteria will be the survival of at least 12 stems of planted vegetation (320 stems/acre). A
monitoring report that summarizes these results and includes photographs of the created area will be
submitted to the Corps. Because of the small size of the wetland creation area, hydrological
monitoring will not occur. However, the survivorship of wetland plants within the area will provide a
good indication of hydrology.

5.0 Implementation Schedule
Wetland creation will commence as soon as all necessary permits have been obtained, with
wetland vegetation planting occurring during the first winter season.
6.0 Summary
In order to mitigate wetland impacts associated with the construction of a home within Lot 18
in the Turtle Creek Subdivision on Oak Island, the owner of the lot will create and preserve
wetlands. Approximately 0.037 acre of wetlands will be created at 2210 E. Pelican Drive by
excavating an upland area to adjacent wetland grade. This created wetland will directly connect with
existing wetlands on the site, which will help to facilitate wetland creation success. In addition,
native wetland vegetation will be planted. Finally, all non-impacted wetlands within both Lot 18 and
the mitigation site (0.35 acre) will be preserved in perpetuity through a deed restriction. These
actions will compensate for wetland impacts within the lot and fulfill the requirements of the U.S.
Army Corps of Engineers.

on behalf of Mr. James (Hal) Bolin for a 0.41-acre lot located in the Turtle Creek subdivision in Oak Island,

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,

IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this

The subject lot is entirely jurisdictional 404 wetland per Mr. Tom Farrell of the Corps. The
wetland delineation at the mitigation site was reviewed in the field by Mr. Farrell on 3/29/05 and
the wetland survey is enclosed in this permit application for his final sign off.
A CAMA Minor Permit is required to complete the mitigation. This application has been
submitted to Steve Edwards with the Town of Oak Island.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
\streams.
SACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
ermits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors

including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/strm,,ide.html.

A wetland creation site was identified by the applicant and examined with the Corns
representative. General mitigation site construction and methodologies were reviewed with
the Corps on site. See the attached mitigation plan narrative and plat. Preservation of the
remaining wetlands on the subject lot as well as the natural and created wetlands on the
mitigation site will be accomplished through Declarations of Conservation for each property
to be recorded at the Brunswick County_ Register of Deeds. The restrictions within the
Declarations will run with the land. See the attached completed Declarations.

1.0 Introduction
In order to mitigate for wetland impacts associated with the construction of one home within
Lot 18 in the Turtle Creek Subdivision in Oak Island, the owner of the lot, Mr. Hal Bolin agrees to
create wetlands at 2210 E. Pelican Drive at a one to one impact to creation ratio and to preserve all
non-impacted wetlands within both lots for perpetuity through a deed restriction. Lot 18 is
approximately 0.41 acre in size and is located off of Loggerhead Court, between 0i and 67t' Streets in
Oak Island, Brunswick County, NC (Figure 1). The mitigation site is 0.24 acre in size and is located at
2210 E. Pelican Drive, which is adjacent to Davis Creek. Mr. Bolin and his wife own both lots.
The applicant proposes to create wetlands by excavating a designated upland area that is 0.037
acre in size to surrounding wetland grade. A variety of shrubs and trees that are similar to vegetation
growing in adjacent wetlands will be planted in these areas. In addition, 0.35 acre of wetlands will be
preserved in perpetuity.
2.0. Site Description
2.1 Impact Site
The 0.41-acre impact site is located off of Loggerhead Court in the Turtle Creek
Subdivision in Oak Island, North Carolina (Figure 2). It consists entirely of 404 freshwater
wetlands and is vegetated by Acer rubruni, Gordonia lasianthus, Pei-sea borbonia, and Nyssa
aquatica. Soils consist of Leon fine sand (Figure 3).
2.2 Mitigation Site
The 0.24-acre mitigation site is located between East Pelican Drive and Davis Creek.
This lot contains uplands except for a small freshwater and coastal wetland fringe located
along Davis Creek. Existing high ground elevations are 4' to 6.5' above MLW (Figure 4).
Coastal wetlands are vegetated by Spartina alterniora and freshwater wetlands contain
Myrica cerifera. Uplands contain Juniperus virginiana and flex vomitoria. One home currently
exists on the site. Soils consist of Newhan fine sand in the uplands, Corolla fine sand in the
freshwater wetlands, and Bohicket silty loam in the coastal wetlands (Figure 5).

3.0 Mitigation
3.1 Wetland Creation
A total of 0.037 acre of existing uplands will be lowered to the approximate grade of
adjacent wetlands (Figure 6). Native shrub species (Table 1) will then be planted in the
creation area on a 10' spacing (approximately 16 plants). It should be noted that existing
trees of significant size will be preserved in order to help to maintain wildlife habitat within
the wetland creation area. No excavation will occur within a 4' radius from the trunk of these
trees. From there, excavation will occur at a 2:1 slope, eventually connecting into the wetland
creation area (Figure 7). This will allow an approximate 8' radius around these trees.
3.2 Wetland Preservation
Approximately 0.35 acre of both created (0.037 ac at E. Pelican Drive) and existing
(0.313 ac at Lot 18) wetlands that are not located under proposed structures will be preserved
through deed restrictions, which will ensure that the wetlands will remain in their natural
state in perpetuity.
4.0 Monitoring
A general site analysis will occur directly after mitigation activities have been completed,
which will consist of taking photographs of the created wetlands and preparing a small narrative to
be submitted to the Corps office. From then on, monitoring will occur annually for up to five years
(if the Corps determines the site to be successful prior to five years, monitoring will discontinue).
During each monitoring event, the vegetation within the created area will be counted and identified.
Success criteria will be the survival of at least 12 stems of planted vegetation (320 stems/acre). A
monitoring report that summarizes these results and includes photographs of the created area will be
submitted to the Corps. Because of the small size of the wetland creation area, hydrological
monitoring will not occur. However, the survivorship of wetland plants within the area will provide a
good indication of hydrology.

5.0 Implementation Schedule
Wetland creation will commence as soon as all necessary permits have been obtained, with
wetland vegetation planting occurring during the first winter season.
6.0 Summary
In order to mitigate wetland impacts associated with the construction of a home within Lot 18
in the Turtle Creek Subdivision on Oak Island, the owner of the lot will create and preserve
wetlands. Approximately 0.037 acre of wetlands will be created at 2210 E. Pelican Drive by
excavating an upland area to adjacent wetland grade. This created wetland will directly connect with
existing wetlands on the site, which will help to facilitate wetland creation success. In addition,
native wetland vegetation will be planted. Finally, all non-impacted wetlands within both Lot 18 and
the mitigation site (0.35 acre) will be preserved in perpetuity through a deed restriction. These
actions will compensate for wetland impacts within the lot and fulfill the requirements of the U.S.
Army Corps of Engineers.

This Deed of Easement made and entered Into this the ?t?L day of
August, 2W-L by and between ONE-A LONG BEACH PROPERTIES, a South
Carolina General Partnership (hereinafter called Grantor) and FREDERICK T.
WALLACE AND WIFE, VICKI A. WALLACE, 1402 Knightwood Drive,
Greensboro, NC 27410 (hereinafter called Grantee).
WHEREAS, by deed recorded on July 23, 1993 in Book 939, Page 689,
Grantor conveyed Grantee all of Lot 18, Block 1A, Turtle Creek Subdivision, as
shown on a map recorded in Map Cabinet X, Page 187-189, Brunswick County
Registry; and
WHEREAS, that lot is not suitable for a conventional septic tank system;
and
WHEREAS, Grantor holds title to a nearby tract of property which has
been approved by the Brunswick County Health Department as an off site drain
field to service the waste water discharge of several lots in Block 1A Turtle Creek
Subdivision, including Lot 18; and
WHEREAS, Grantor also holds a 10 foot wide utility easement over
various lots in Block 1A as shown on the plat recorded in Map Cabinet X, Page
188 and Grantor has installed a waste water discharge system within the
easement area; and
WHEREAS, it is Grantors intent that Grantee be allowed to connect to the
existing sewage treatment line and connect to the wastewater treatment system
until such time that a public wastewater disposal system becomes available to
service Lot 18.
NOW, THEREFORE, in consideration of the mutual promises, covenants
and conditions herein and for good and other valuable consideration, the receipt
of which is hereby acknowledged, Grantor does hereby give, grant and convey
unto Grantee, a determinable non-exclusive easement appurtenant more
particularly described in Exhibit A attached hereto and incorporated herein for
greater certainty of description.
TO HAVE AND TO HOLD the easement as to the Grantee, their heirs and
assigns, in such form and manner as set forth hereinabove.

A determinable non-exclusive easement aR urtenant (1) to connect to and utilize the
underground sewage lines lying within the 10 foot wide easement reserved by One-A
Long. Beach Properties, a South Carolina Partnership and shown on the plat recorded in
Map Book X, Page 188 and also reserved in the Restrictive Covenants recorded in
Book 910, Page 1075 and Amendments recorded in Book 939, Page 687 and Book
1164, Page 1139; and (2) connect to and utilize the existing septic areas 1 and 2 and
repair areas 1 and 2 and all equipment thereon comprising cluster systems approved
under permits BCHD 93-30725D and BCHD 96-45797 located on the following tract:
BEGINNING at the northeast comer of Lot 16, Block 1-A as shown on a plat recorded in
Map Book X. Page 188 thence north 15 degrees 28 minutes east 202.05 feet and along

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to tho. aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project, establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.

for USACE or DWQ to consider the application complete for processing. Any application

Reference is made to your request for Nationwide Permit 18 (NWP 18) to deposit 4,214 sq. ft.
(0.097 acres) of fill in wetlands on Oak Island, North Carolina. Your request is associated with the
construction of a single-family residence on lot 18 of Turtle Creek Subdivision, located at 6704
Loggerhead Court, Oak Island. Your pre-construction notification for nationwide permit verification has
been assigned file No. 200300253.
Lot 18 is a 0.41-acre parcel located entirely within a jurisdictional wetland adjacent to a freshwater
coastal lagoon and a sandy beach-dune complex. The wetland and lagoon are adjacent to the Atlantic
Ocean and are classified as waters of the United States. The site is composed of a mixed community of
wetland trees, shrubs, grasses, and herbs. Typical canopy and subcanopy species on site include sweet bay,
red bay, loblolly bay, American holly, and wax myrtle. Ground cover consists of assorted wetland and
transitional grasses, sedges, and herbs.
On January 9, 2003, we received additional information from you that we had requested about the
scope and design of your project. We have evaluated your proposal and the additional information to
determine whether the proposed activity qualifies for Nationwide Permit 18, which can authorize the loss
of up to 0.1 acre of jurisdictional wetlands and waters.
Based on our review of your plans, we have determined that your proposed fill does not comply with
NWP 18 because it does not avoid and minimize impacts to wetlands and waters to the maximum extent
practicable. In addition, we believe that the project as proposed would have a greater than minimal impact
on the aquatic environment and cannot be authorized by nationwide permit.
This determination is based on the following observations: (1) the size and orientation of the
proposed driveway could be modified to result in fewer wetland impacts. The driveway could be
reoriented on the site to be much closer to the road, which would reduce wetland impacts. (2) Your plan
shows that 958 square feet of "undisturbed ground level areas" will be surrounded on three sides by fill,
which will leave only narrow connections to the ambient wetland. This design will impair the natural
wetland functions of those "undisturbed" areas, resulting in further adverse impacts to the aquatic system.
The wetlands within your proposed filled area are contiguous to a freshwater marsh and lagoon
along the southern side of Oak Island. The wetlands on your site provide significant benefits to the
receiving coastal waters including the attenuation of storm surges, attenuation of stormwater runoff,
sediment and pollutant removal, nutrient uptake and transformation, groundwater discharge, improvements
to water quality, and habitat for various species of birds, mammals, and other wildlife. Impacts associated
with your project as proposed will have greater than minimal impact to the aquatic environment.
For these reasons, we find that your project as proposed will result in greater impacts to the aquatic
environment than can be authorized through Nationwide Permit 18. Additional design and scope
modifications, as well as compensatory mitigation for impacts that cannot be avoided or minimized, may
make it possible for you to further reduce project impacts and allow you to qualify for NWP 18. We are
willing to review any modifications that you propose for additional consideration of your project under
NWP 18.
Alternatively, you may seek approval for your project through our individual permit process
(application enclosed). Please realize, however, that our rules regarding avoidance and minimization of
wetland impacts as well as the requirement for mitigation to offset unavoidable wetland losses apply
equally to the individual permit process.
Additionally, on April 2, 2002, you received Nationwide Permit 18 verification from this office,
action ID No. 199901251, to fill 1,751 square feet of wetlands on lot 17, which is adjacent to your current
proposed project. That project resulted in the filling of more than 7,000 square feet of wetlands and
remains a continuing violation of the Clean Water Act. Your current proposal is essentially the same kind
of project as that which resulted in the violation on lot 17. Before we allow you to fill additional
jurisdictional wetlands in this area, we will need to resolve the violation or to receive written evidence
from you that you are not responsible for the unauthorized impacts.

A determinable non-exclusive easement appurtenant (1) to connect to and utilize the
underground sewage lines lying within the 10 foot wide easement reserved by One-A
Long Beach Properties, a South Carolina Partnership and shown on the plat recorded in
Map Book X, Page 188 and also reserved in the Restrictive Covenants recorded in
Book 910, Page 1075 and Amendments recorded in Book 939, Page 687 and Book
1164, Page 1139; and (2) connect to and utilize the existing septic areas 1 and 2 and
repair areas 1 and 2 and all equipment thereon comprising cluster systems approved
under permits BCHD 93-30725D and BCHD 96-45797 located on the following tract:
BEGINNING at the northeast corner of Lot 16, Block 1-A as shown on a plat recorded in
Map Book X, Page 188 thence north 15 degrees 28 minutes east 202.05 feet and along
the western right of way line of S.E. 67`h Street to the intersection of the southern right
of way line of Oak Island Drive and the western right of way line of S.E. 67th Street,
thence along the southern right of way line of Oak Island Drive north 66 degrees 22
minutes west 202.05 feet to a point, thence south 15 degrees 28 minutes west 202.05
feet to a point, being the northwest corner of Lot 16 thence along the northern line of Lot
16 south 66 degrees 22 minutes east 202.05 feet to the place and point of beginning.
It being the intent of grantors to grant these determinable non-exclusive easements
appurtenant in order to comply with the Brunswick County Health Department permit
requirements for operating the cluster wastewater disposal system servicing Lot 18 and
various other lots in Block 1A. Grantor warrants that it shall be the responsible party for
maintaining and operating the cluster system until such time as responsibility for the
system is assumed by the Property Owners of Turtle Creek, Inc. These easements
shall run with the land but shall terminate automatically 60 days after a public
wastewater disposal system becomes available to service Lot 18 which is the dominant
estate. "Available" shall mean that a public wastewater treatment plant is operating and
the collection line servicing Lot 18 is installed and ready to be tapped onto for
transporting wastewater to the public treatment plant with all the necessary permit
approvals.
