Sullins Dee Freeman Governor Director Secretary December 11, 2009 DWQ Project # 07-14410 Mecklenburg County Mr. Jim Holman Charter Properties, Inc. 1520 South Boulevard, Suite 215 Charlotte, NC 28203 Subject Property: Prosperity Village Development STORMWATER MANAGEMENT PLAN APPROVAL Dear Mr. Holman: - On April 29, 2009, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to impact 0.231 acre of wetland and 386 linear feet of unnamed tributary to Stony Creek in order to construct the subject development in Mecklenburg County. In order to meet Condition 8 of the 401 Certification for this project, a stormwater management plan (dated June 30, 2009) was received by the DWQ on July 1, 2008. A revised stormwater management plan (dated November 11, 2009) was received by the DWQ on November 12, 2009. Additional revisions to the stormwater management plan (dated November 16, 2009) were received on November 18, 2009. This revised stormwater management plan for RG#1 and RG#2 has been reviewed and satisfies the - stormwater management conditions of the 401 Water Quality Certification for those two portions of the development. The DWQ also approves the conceptual stormwater management plan associated with future apartment sites UR-2 and R-22MF for the present. A final stormwater management plan will need to be submitted to the DWO for future apartment sites UR-2 and R 22MF prior to any land disturbance associated with those phases The stormwater treatment system for RG# 1 and RG#2, which includes two bioretention basins, two dry detention ponds and the signed and notarized Operation and Maintenance Agreements dated December 10, 2008, as approved by this Office, and the drainage patterns depicted on the plan sheets, must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. All stormwater management conveyances, detention and treatment structures shall have maintenance access and at least. 10-foot drainage easement on each side to allow for the ability to maintain the structures, to perform corrective actions and shall provide protection of the structures from potential alterations by future property owners. This letter completes the review of the DWQ under Section 401 of the Clean Water Act.
