Dear Mr. Baker:
Division personnel have reviewed and approved your application for renewal of the subject
• permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated May 9, 1994 (or as subsequently amended).

If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-
6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division
may require modification or revocation and reissuance of the permit. This permit does not affect
the legal requirements to obtain other permits which may be required by the Division of Water
Quality or permits required by the Division of Land Resources, the Coastal Area Management
Act or any other Federal or Local governmental permit that may be required.

1. The permittee shall comply with Final Effluent Limitations specified for discharges in accordance with
the following schedule:. -
Permittee shall comply with Final Effluent Limitations by the effective date of the permit unless
specified below.
2. Permittee shall at all times provide the operation and maintenance necessary to operate the existing
facilities at optimum efficiency.
3. No later than 14 calendar days following a date identified in the above schedule of compliance, the
permittee shall submit either a report of progress or, in the case of specific actions being required by
identified dates, a written'notice of compliance or noncompliance. In the latter case, the notice shall
include the cause of noncompliance, any remedial actions taken,and the probability of meeting the next
schedule requirements. '

Dear Keith:
We have received the lab analysis for upstream and downstream turbidity samples taken on 06/14/04.
The analysis show turbidities of 4.0 NTU(upstream) and 25 NTU(downstream). These will place
us in non-compliance for turbidity for the month of June. We believe these readings are the result of
erroneous lab analysis due to the following:
1) Average upstream and downstream turbidities for the period of May 2003 to May 2004 are
:95 NTU and .82 NTU respectively.
2) The highest turbidities recorded during this period were 4.0 NTU and 3.2 NTU respectively.
3) There have been no unusual discharges or upsets of the treatment process.
4) There was no excessive rainfall during the time of sampling.
5) The lab has indicated that their instrument may have been set incorrectly, resulting in
misplacement of decimals.

Dear Mr. Cook: .
Please be reminded that as a requirement of your field parameter certification you must submit an
"acceptable" result on a Performance Evaluation Sample for the following parameters if they appear on your
certificate: pH, Total Residual Chlorine, Conductivity, and Settleable Solids.
While you may obtain guidance and assistance from another laboratory in preparing the samples for
analysis you or your personnel must perform the analysis using your instrumentation.
The performance sample must be purchased from an approved vendor and the results reported using
your EPA lab code. If this office does not receive an acceptable result by December 31,.2004, it will be counted
as a first unacceptable result. Due to the short time left until the deadline it is strongly recommended that you
order a quick turn around type sample.
If you have already submitted results that are pending evaluation please disregard this letter. If you
have received results from the vendor, and this has not been acknowledged by this office, please contact me.

Monitoring Report(DMR)from your facility. As you may know,the data recorded on your DMR is keyed

submittal. Until these problems have been corrected,your DMR•will be considered incomplete. Please
see the attached form along with a copy of the problem DMR for details regarding the DMR's deficiency.
Incomplete or illegible DMRs affect our staff's ability to provide a timely and effective evaluation of DMR

Narrative Description of Sludge Management Plan
Filter backwash and sedimentation basin sludges are discharged to a lagoon for settling.
Approximately quarterly for several days a dredge pumps the consolidated material from the lagoon
bottom to tanker trucks which transport the sludge to the municipal sewer system. The sludge is
ultimately processed at the Town of Waynesville Wastewater Treatment Plant.

Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached final NPDES discharge permit. This permit is issued pursuant to
the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the .U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently
amended). The following changes have been incorporated into this final permit:
> Your expiration date for this permit has been changed to January 31,2011.
> A daily maximum TRC limit of 28 µg/L will take effect June 1,2008. This time period is
allowed in order for the facility to budget and design/construct a dechlorination unit or
alternative disinfection system.
Limits/monitoring for Turbidity and Settleable Solids have been deleted based on revised
conventional WTP permitting.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you,you have the right to an adjudicatory hearing upon written request within thirty (30) days
following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter
150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail
Service Center, Raleigh, North Carolina 27699-6714)..Unless such demand is made, this permit shall be final
and binding.
Please take notice that this permit is not transferable. This permit does not affect the legal
requirements to obtain other permits. which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, Coastal Area Management Act, or any other Federal or Local

A fast track application for Authorization to Construct dechlorination facilities was
received on March 19, 2007, by the Division. Authorization is hereby granted for the
construction of modifications to the existing Waynesville WTP, with discharge of filter
backwash water into Allen Creek in the French Broad River Basin.
This authorization results in no increase in design or permitted capacity and is awarded
for the construction of the following specific modifications:
Installation of a dechlorination system utilizing calcium thiosulfate pursuant to the
fast track application received on March 19, 2007, and in conformity with the
Minimum Design Criteria for Dechlorination Facilities.
This Authorization to Construct is issued in accordance with Part III, Paragraph A of
NPDES Permit No. NC0049409 issued October 20, 2006, and shall be subject to revocation
unless the wastewater treatment facilities are constructed in accordance with the conditions and
limitations specified in Permit No. NC0049409.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as may
be required by this Division, such as the construction of additional or replacement wastewater
treatment or disposal facilities.
The Asheville Regional Office, telephone number(828) 296-4500 shall be notified at

Narrative Description of Sludge Management Plan
Filter backwash and sedimentation basin sludges are discharged to a lagoon for settling. For several
days monthly during warm weather a dredge pumps the consolidated material from the lagoon
bottom to tanker trucks which transport the sludge to the municipal sewer system. The sludge is
ultimately processed at the Town of Waynesville's Wastewater Treatment Plant.

Dear Mr.Baker:
The Division of Water Quality(the Division) hereby issues the attached NPDES permit for the
subject facility. We issue this permit pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated October 15, 2007, or as subsequently amended.
Parameters of Concern—Changes to Your Permit. The Division acknowledges your comments
of May 9, in which you questioned the need for DWQ's permit Parameters of Concern and your
request to remove parameters from the permit. We offer the following summary explanation and
concessions:
• The parameters Total Residual Chlorine (TRC), Ammonia Nitrogen, and Total Fluoride
remain in the permit, but conditionally-monitoring required only if certain site conditions
exist [see permit Part I, section A. (1.) and related footnotes].
• The parameters Total Calcium and Total Magnesium have been removed from this permit.
• The Division has relaxed the monitoring frequency for the remaining metals and toxicants in
your permit from 2/Monthly to Quarterly. However, continued monitoring of these
parameters is required by yours and all WTP permits statewide (see WTP Policy Sep2009
for facilities applying Conventional Technology).
• Please note that all samples are to be collected at your final outfall to the environment.
Future Reporting of Flow. Waynesville WTP is required under this permit to monitor flow, i.e.,
final wastewater discharge to Waters of the State consistent with NPDES permits statewide.
Moreover, the Division requires Continuous, Recording of flow for all WTP discharging greater than
0.0500 MGD. We understand from your application that your WTP processes generate intermittent

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility,whether for operation or discharge are hereby
revoked, and as of this issuance, any previously issued permit bearing this number is no longer effective.
Therefore,the exclusive authority to operate and discharge from this facility arises under the permit
conditions, requirements, terms, and provisions described herein.

1. continue to operate an existing potable-water treatment plant(WTP) applying conventional
technology [including chlorine, aluminum sulfate, odium hydroxide, hydrofuorosilicic acid,
orthophosphate(non-zinc), andicalcium phosphate utilizing a single settling basin.

located at the Waynesville WTP, 341 Rocky Branch Road, south of Waynesville, Haywood County,
and
2. discharge filter-backwash wastewater from said treatment works via Outfall 001, a location specified
on the attached map, into Allen Creek [stream segment 5-16-7-(8.5)] a waterbody currently classified
C-Trout within subbasin 04-03-05 of the French Broad River basin.

A. (2.) CHRONIC TOXICITY MONITORING- (QUARTERLY)
The Permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the"North Carolina
Ceriodaphnia Chronic Effluent Bioassay Procedure,"Revised February 1998, or subsequent versions.The
effluent concentration defined as treatment two in the procedure document is 90%. The permit holder shall
perform quarterly monitoring using this procedure to establish compliance with the permit condition.The tests
will be performed during the months of March,June,September and December. Effluent sampling for this
testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form(MR-1) for the month in which it was performed,using the parameter code TGP3B.

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30
days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements performed
in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent
toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required,
the Permittee will complete the information located at the top of the aquatic toxicity(AT)test form indicating the
facility name,permit number,pipe number, county,and the month/year of the report with the notation of"No
Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at
the address cited above.
Should the Permittee fail to monitor during a month in which toxicity monitoring is required, then monthly
monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will revert to
quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of
Water Quality indicate potential impacts to the receiving stream,this permit may be re-opened and modified to
include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an
invalid test and will require immediate follow-up testing to be Completed no later than the last day of the month
following the month of the initial monitoring.

subject facility. We issue this permit pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated October 15, 2007, or as subsequently amended.
Parameters of Concern—Changes to Your Permit. The Division acknowledges your comments
of May 9,in which you questioned the need for DWQ's permit Parameters of Concern and your
request to remove parameters from the permit. We offer the following summary explanation and
concessions:
• The parameters Total Residual Chlorine (TRC),Ammonia Nitrogen, and Total Fluoride
remain in the permit,but conditionally-monitoring required only if certain_site conditions •
exist[see permit Part I, Section A. (1.) and related footnotes].
•• The parameters Total Calcium and Total Magnesium have been removed from this permit.
• The Division has relaxed the monitoring frequency for the remaining metals and toxicants in
your permit from 2/Monthly to Quarterly. However, continued monitoring of these
parameters is required by yours and all WTP permits statewide(see WTP Policy Sep2009
for facilities applying Conventional Technology).
• Please note that all samples are to be collected at your final outfall to the environment.

Comment: The facility has two outfalls directed into the settling pond. One is an 18"
pipe from the filter back wash and the other is a 12" pipe from the four separate
sedimentation basins which are drained and cleaned individually at a rate of one per
month. The facility measures flow for both of these outfalls and reports this number on
their DMRs. The dechoirinated water enters the settling basin and then leaves through
permitted outfall 001. There was no discharge at the time of inspection. Sludge was
being pumped out of the settling basin by a barge pump. The sludge is put into a tanker
truck and discharged to the Town's VVWTP where it is processed into Class A sludge.

The Division of Water Quality(the Division)has decided to revisit the subject NPDES permit and
revise the permit monitoring conditions. We issue this permit modification pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
• between North Carolina and the U.S. Environmental Protection Agency dated October 15,2007, or
as subsequently amended.
The Division understands that you wish to continue to monitor wasteflow rate and duration
upstream of the sludge pond while collecting compliance samples for analysis downstream of the
pond. You have argued that upstream monitoring is more accurate because a), you combine and
sum two intermittent wasteflows, and b),the pond is both subject to stormwater surge along Allen
Creek and influenced by inflow/infiltration WI). Moreover, you wish to continue your current
regimen in order to save the expense of installing new/additional flow-metering equipment •
downstream of the pond.
Your currently practiced flow-measurement protocol appears consistent with other NPDES
wasteflow measurements statewide. Considering this, and your assessment of existing site
conditions, the Division finds no reason to deny your request,provided that you continue to record
and report the sum of all wasteflows in compliance with the permit. Therefore,we have modified
this permit as follows:
1. Flow-monitoring has been modified from Continuous to Instantaneous, at a
frequency of 2/Month consistent with the current parameters most frequently
monitored (per WTP Policy 2009).
2. The Flow footnote requiring compliance with"Continuous"monitoring and implied
equipment installation has been revised.

Narrative Description of Sludge Management Plan
Filter backwash and sedimentation basin sludges are discharged to a lagoon for settling. For several days
monthly during warm weather, a dredge pumps the consolidated material from the lagoon bottom to tanker .
trucks which transport the sludge to the municipal sewer system. The sludge is ultimately processed at the
Town of Waynesville's Wastewater Treatment Plant.

Division personnel have reviewed and approved your application for renewal of the subject
permit. Accordingly,we are forwarding the attached final NPDES discharge permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum
of Agreement between North Carolina and the U.S! Environmental Protection Agency dated October
15, 2007 (or as subsequently amended).
The fmal permit includes the following significant changes from the existing permit:
> Section A. (3)has been added to require electronic submission of effluent data. Federal
regulations require electronic submittal of all discharge monitoring reports (DMRs).
> Regulatory citations have been added to the permit.
> Total hardness,total zinc, and turbidity monitoring have been added to the permit.
> Footnotes have been updated for fluoride and ammonia nitrogen.
> The HUC code has been updated on the map.
> Flow sample type changed from Grab to Instantaneous (per 2012 modification).
> Measurement frequency changed from Continuous to 2/month (per 2012 modification).
It is the recommendation of the Division that alternatives to discharging wastewaters be explored.
As Allen Creek is classified as C-Trout waters, alternative disposal options could benefit both the
permittee and the environment. Please contact the Division for any assistance that may be needed in
researching alternatives.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of

Completed Aquatic Toxicity Test Forms shall be filed with the Water Sciences Section no later than 30
days after the end of the reporting period for which the report is made.
•
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate
signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if
chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity(AT)test
form indicating the facility name,permit number,pipe number, county, and the month/year of the report
with the notation of"No Flow"in the comment area of the form. The report shall be submitted to the
Water Sciences Section at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required,monitoring
will be required during the following month. Assessment of toxicity compliance is based on the toxicity
testing quarter,which is the three month time interval that begins on the first day of the month in which
toxicity testing is required by this permit and continues until the final day of the third month.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division
of Water Resources indicate potential impacts to the receiving stream, this permit may be re-opened and
modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival,minimum control organism reproduction, and appropriate environmental controls,
shall constitute an invalid test and will require immediate follow-up testing to be completed no later
than the last day of the month following the month of the initial monitoring.
A. (3.) ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS
[G.S. 143-215.1(b)]
Federal regulations require electronic submittal of all discharge monitoring reports(DMRs)and program reports.
The final NPDES Electronic Reporting Rule was adopted and became effective on December 21,2015.

EPA plans to establish a website that will also link to the appropriate electronic reporting tool for each type
of electronic submission and for each state. Instructions on how to access and use the appropriate electronic

Electronic submissions must start by the dates listed in.the"Reporting Requirements"section above.
3. How to Request a Waiver from Electronic Reporting
The permittee may seek a temporary electronic reporting waiver from the Division. To obtain an electronic
reporting waiver, a permittee must first submit an electronic reporting waiver request to the Division.
Requests for temporary electronic reporting waivers must be submitted in writing to the Division for written
approval at least sixty(60)days prior to the date the facility would be required under this permit to begin
submitting monitoring data and reports. The duration of a temporary waiver shall not exceed 5 years and
shall thereupon expire. At such time,monitoring data and reports shall be submitted electronically to the
Division unless the permittee re-applies for and is granted a new temporary electronic reporting waiver by the
Division. Approved electronic reporting waivers are not transferrable. Only permittees with an approved
reporting waiver request may submit monitoring data and reports on paper to the Division for the period that
the approved reporting waiver request is effective.

All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part II, Section
B. (11.)(a) or by a duly authorized representative of that person as described in Part II, Section B. (11.)(b). A'
person,and not a position,must be delegated signatory authority for eDMR reporting purposes.
For eDMR submissions,the person signing and submitting the DMR must obtain an eDMR user account and

During routine compliance monitoring of our effluent,we recorded a higher than normal result for pH.The effluent pH
after the second bed wash was 9.3,which is slightly above our permit range of 6.0-9.0. We then took additional pH
samples after the last filter was washed and they were as follows:
Effluent:8.0
Upstream:7.0
Downstream: 7.1
We believe the high effluent sample result stemmed from a ruptured caustic re-circulation line in the yard that was
located and repaired last week.This leak may have allowed some caustic to leach into the underdrains in the yard, aided
by the recent heavy rains.These drains empty into the waste pond.Although this caused a spike resulting a high
compliance sample result, additional follow up samples show a quick return to normal pH levels in the pond, as well as
little to no impact on the receiving stream. If you have any questions or need further information, please contact me at
