Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). • If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699- 6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. Permittee shall at all times provide the operation and maintenance necessary to operate the existing facilities at optimum efficiency. 3. No later than 14 calendar days following a date identified in the above schedule of compliance, the permittee shall submit either a report of progress or, in the case of specific actions being required by identified dates, a written'notice of compliance or noncompliance. In the latter case, the notice shall include the cause of noncompliance, any remedial actions taken,and the probability of meeting the next schedule requirements. The analysis show turbidities of 4.0 NTU(upstream) and 25 NTU(downstream). These will place us in non-compliance for turbidity for the month of June. We believe these readings are the result of erroneous lab analysis due to the following: 1) Average upstream and downstream turbidities for the period of May 2003 to May 2004 are :95 NTU and .82 NTU respectively. 2) The highest turbidities recorded during this period were 4.0 NTU and 3.2 NTU respectively. 3) There have been no unusual discharges or upsets of the treatment process. 4) There was no excessive rainfall during the time of sampling. 5) The lab has indicated that their instrument may have been set incorrectly, resulting in misplacement of decimals. Please be reminded that as a requirement of your field parameter certification you must submit an "acceptable" result on a Performance Evaluation Sample for the following parameters if they appear on your certificate: pH, Total Residual Chlorine, Conductivity, and Settleable Solids. While you may obtain guidance and assistance from another laboratory in preparing the samples for analysis you or your personnel must perform the analysis using your instrumentation. The performance sample must be purchased from an approved vendor and the results reported using your EPA lab code. If this office does not receive an acceptable result by December 31,.2004, it will be counted as a first unacceptable result. Due to the short time left until the deadline it is strongly recommended that you order a quick turn around type sample. If you have already submitted results that are pending evaluation please disregard this letter. Therefore,the exclusive authority to operate and discharge from this facility arises under the permit conditions, requirements, terms, and provisions described herein. Town of Waynesville is hereby authorized to: G#160 1. continue to operate an existing potable-water treatment plant(WTP) applying conventional technology [including chlorine, aluminum sulfate, odium hydroxide, hydrofuorosilicic acid, orthophosphate(non-zinc), andicalcium phosphate utilizing a single settling basin. 0 located at the Waynesville WTP, 341 Rocky Branch Road, south of Waynesville, Haywood County, and 2. discharge filter-backwash wastewater from said treatment works via Outfall 001, a location specified on the attached map, into Allen Creek [stream segment 5-16-7-(8.5)] a waterbody currently classified C-Trout within subbasin 04-03-05 of the French Broad River basin. Permit NC0049409 A. (2.) CHRONIC TOXICITY MONITORING- (QUARTERLY) The Permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the"North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure,"Revised February 1998, or subsequent versions.The effluent concentration defined as treatment two in the procedure document is 90%. The permit holder shall perform quarterly monitoring using this procedure to establish compliance with the permit condition.The tests will be performed during the months of March,June,September and December. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form(MR-1) for the month in which it was performed,using the parameter code TGP3B. Additionally,DWQ Form AT-1 (original) is to be sent to the following address: Attention: North Carolina Division of Water Quality Environmental Sciences Section 1621 Mail Service Center Raleigh,N.C. 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the Permittee will complete the information located at the top of the aquatic toxicity(AT)test form indicating the facility name,permit number,pipe number, county,and the month/year of the report with the notation of"No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the Permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream,this permit may be re-opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be Completed no later than the last day of the month following the month of the initial monitoring. The facility measures flow for both of these outfalls and reports this number on their DMRs. The dechoirinated water enters the settling basin and then leaves through permitted outfall 001. There was no discharge at the time of inspection. Sludge was being pumped out of the settling basin by a barge pump. The sludge is put into a tanker truck and discharged to the Town's VVWTP where it is processed into Class A sludge. Should the permittee fail to monitor during a month in which toxicity monitoring is required,monitoring will be required during the following month. Assessment of toxicity compliance is based on the toxicity testing quarter,which is the three month time interval that begins on the first day of the month in which toxicity testing is required by this permit and continues until the final day of the third month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Resources indicate potential impacts to the receiving stream, this permit may be re-opened and modified to include alternate monitoring requirements or limits. We then took additional pH samples after the last filter was washed and they were as follows: Effluent:8.0 Upstream:7.0 Downstream: 7.1 We believe the high effluent sample result stemmed from a ruptured caustic re-circulation line in the yard that was located and repaired last week.This leak may have allowed some caustic to leach into the underdrains in the yard, aided by the recent heavy rains.These drains empty into the waste pond.Although this caused a spike resulting a high compliance sample result, additional follow up samples show a quick return to normal pH levels in the pond, as well as little to no impact on the receiving stream.
