Klimek, PE, Director Division of Water Quality January 29, 2003 DWQ Project # 02-0867 Craven County Page 1 of 2 Mr. Al Alkoff 10 Mohawk Drive Wallingford, CT 06492 Subject Property: Lot 130 & 131, Mariner's Court, River Bend, NC 27562 "Plantation Canal" / Trent River [03-04-11; 27-101-(31); SB Sw NSW (Nutrient Sensitive)] APPROVAL for the use of the "General" MAJOR VARIANCE; From the Tar-Pamlico and Tar-Pamlico Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots within the Coastal Counties as defined by the Coastal Area Management Act with ADDITIONAL CONDITIONS Dear Mr. Alkoff: You have our approval, in accordance with the conditions listed below, to impact approximately 368 square feet (ft) of Zone 1 and 7,500 ft2 of Zone 2 of the protected riparian buffers for the purpose of constructing a home, driveway and garage on the subject property as depicted on the "Alkoff Residence Site Plan" prepared by Maune Belangia Gaulkenberry Architects, PA submitted to the Division of Water Quality (DWQ) along with the letter from Trent River Realty dated October 29, 2002. This letter shall act as your approval for the use of the "General" Major Variance; From the Tar-Pamlico and Tar-Pamlico Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots within the Coastal Counties as defined by the Coastal Area Management Actwith ADDITIONAL CONDITIONS as approved by the Water Quality Committee (WQC) of the Environmental Management Commission (EMC) on May 10, 2001. In addition, you should get any other required federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control and CAMA permits. This approval shall expire when the variance expires on April 11, 2006 unless it is renewed before that time by the EMC. This approval is only valid for the purpose and design that you described in your variance request. If you change your project, you must notify us and you may be required to send us a new request for approval. If the property is sold, the new owner must be given a copy of this approval and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below. Conditions: Zone 1 Impacts No impacts to Zone 1 of the protected buffers shall occur except for those approved under this variance and activities/uses classified as "exempt" within 15A NCAC 02B .0233(6), unless otherwise approved by the DWQ. Areas outside those approved for impact under this variance and within Zone 1 shall remain as "natural", "undisturbed wooded areas" as proposed within your variance request. 2. Diffuse Flow All new stormwater drainage shall be directed to vegetated areas as diffuse flow at non-erosive velocities prior to entering the protected riparian buffers as identified within 15A NCAC 26 .0259(5). No new ditching or piping of stormwater through the protected buffers is allowed. 3. Buffer Mitigation (WRP) You are required to mitigate for impacts to Zone 1 of the protected riparian buffers. We understand that you wish to make a payment into the Riparian Buffer Restoration Fund administered by the NC Wetlands Restoration Program (WRP) to meet this mitigation requirement. This has been determined by the DWQ to be a suitable method to meet the mitigation requirement. In accordance with 15A NCAC 213 .0242(7), this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2B .0233(9)(C). Until the WRP receives and clears your check (made payable to: DENR - Wetlands Restoration Program Office), no impacts specified in this variance approval shall occur. For accounting purposes, this variance approval authorizes payment into the Riparian Buffer Restoration Fund to compensate for 368 ft2 of required riparian buffer mitigation for impacts to 368 ft2 of protected riparian buffers; 03-04-11; 27-101-(31) river and subbasin. 4. Deed Notifications Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this variance approval. If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. This approval and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under the Neuse River Riparian Buffer Protection Rules (15A NCAC 2B .0233 (9)(b)). The entire building area of both lots will remain natural with as few trees removed as is possible. 3. The driveway has been repositioned to limit impact into Zone 1 as much as possible. Specifically, Mr. Dorney's letter stated: 'Please provide additional justification as to why the impacts to Zone I associated with the construction of the proposed garage can not be avoided. Specifically, it appears that the garage is 25 feet, from the water. Why can't the garage be reduced in size or otherwise redesigned such that it does not impact Zone I (i. e., 30 feet. from the water) ? " In an effort to comply with the above requested information, Mr. Alkoff contacted the Architectural Firm of Maune, Belangia, and Faulkenberry of New Bern. As you can see from the attached plans, the garage issue has been resolved per the specific request of your agency's letter. The plan does not depict a buffer around the boat slip on the southwest side of the property. The original plan had the buffer applied to this area. The scale appears not to be standard (1" = approx. 15') which makes it difficult to measure exactly how close the driveway and garage will be to the canal and slip. The buffer applies to the normal high water level of the canal or any coastal wetlands. Therefore, it applies around the boat slip as depicted on your original plans. We are preparing to send you another letter requesting that you revise your plans to avoid the Zone 1 (first 30 feet) impacts. This includes impacts associated with the driveway and garage. The variance request involves the construction of a home and garage within the buffers. The DWQ has not approved the variance at this time. We are requesting additional justification as to why the impacts to Zone 1 of the protected buffers associated with the proposed garage can not be avoided. The proposed garage is currently located 25 feet from the water. If it is redesigned or reduced in size to be 30 feet from the water, then the DWQ will most likely issue the variance approval. - Bob Jana Hill wrote: Dear Bob: I am a Realtor in New Bern representing a seller on a lot in Riverbend (New Bern )NC on Mariner's Court. I understand that you have been involved in the process of approving a variance. Mr. Alkoff is the buyer of the lot and the one making the request for a variance. I have been told that the DWQ rejected his variance request based on too much of an impact on zone A. First, I would like to confirm that this info is correct. And Secondly, I hope you can help educate on how the process works. At the time we received the offer from Mr. Alkoff, I contacted several local DWQ employess that said that since the lot was subdivided before July 1999 (1 think that is the correset month and year) that the lot would be grandfathered and a general variance would be issued. With the understanding that the construction make as little of an impact as possible. I am wondering if the variance was denied because Mr. Alkoff has chosen to build a structure that could easily be revised to have less of an impact. I was told that Mr. Alkoff intends to build a garage on this lot. He has already purchased the lot next to this one and a variance was issued on that lot. Why was the variance available for that lot and not this one. And, if Mr. Alkoff does not buy this lot and we put it back on the market, will anyone be able to build on it'? I conducted the initial "triage" review on June 3, 2002. I recommended sending it back for additional information. The additional information requested was; (1) provide area of impact (in square feet) for both Zone 1 and 2, (2) please note that zone 1 impacts will require mitigation if approved, (3) please provide additional justification as to why the Zone 1 impacts can not be avoided, specifically why can't the garage and home be realigned such that no impacts occur to Zone 1. My recommendation was seconded and the letter should go out today. Also, the applicant requested a Minor Variance, but had impacts proposed for both Zone 1 and 2. Minor Variances can not be used to impact Zone 1 and require mitigation for all impacts. However, I believe that we can issue this under a Coastal General Variance and had planned to do so. We can approve Zone 1 impacts under this variance but it requires proof of minimization/avoidance and mitigation. The original construction plans which followed CAMA's pre-1997, 25 ft riparian buffer have been revised to limit as much as practical intrusion into Zones 1 and 2. All proposed construction has been moved to the furthest limits from the Plantation Canal. Description of any best management practices to be used to control impacts associated with the proposed activity (i.e., control of runoff from impervious surfaces to provide diffuse flow, re-planting vegetation or enhancement of existing vegetation, etc.): Recognizing the need to control runoff, the proposed building placement takes Into account proper discharge of collected water away from the riparian buffer, planting; and replanting. Builder has been directed to disturb as few trees as possible; to replant where possible; and to use storm water pavers for driveways. Please provide an explanation of the following: (1) The practical difficulties or hardships that would result from the strict application of this Rule: Strict application of this rule would severely limit the size of the dwelling to be placed on Lot 130 and would practically eliminate any building on Lot 131. The current configuration of the proposed dwelling (as shown on the resurvey) makes maximum use of current vegetation. The proposed configuration also limits any further intrusion into the riparian buffer through placement of storm water pavers outside of the buffer zone for entry into both the dwelling and the garage. (2) How these difficulties or hardships result from conditions that are unique to the property involved. As seen on the attached site plat, these lots were plotted in 1977 without consideration for a 50' riparian buffer. For Lot 131, a 40' boat slip had been cut into the property which makes the 50' buffer even more restrictive for building purposes. Further, placement of the proposed dwelling, facing in its current direction, makes maximum usage of an already restricted area in which to build. (3) If economic hardship is the major consideration, then include a specific explanation of the economic hardships and the proportion of the hardship to the entire value of the project. -Although economic hardship is not a major consideration, the property has been marketed to the buyer as .73 acres with 25 ft riparian setbacks for $165,500. Doubling the setbacks has a substantial impact in the amount of usable acreage purchased. More importantly, however, is the impact that the setbacks will have on the design of the '`dream home" currently shown on the resurvey.
