Mitchell 26 Central Avenue North Merrick , NY 11566 DWQ Project # 02-0709 Pamlico County Page 1 of 2 Subject Property: Lot #20, Bayshore Estates, Bayshore Road, Merritt, NC Moore's Creek [03-04-13; 29-150-12; SA HOW (High Quality) NSW (Nutrient Sensitive)] APPROVAL for the use of the "General" MAJOR VARIANCE; From the Tar-Pamlico and Tar-Pamlico Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots within the Coastal Counties as defined by the Coastal Area Management Act with ADDITIONAL CONDITIONS Dear Mr. & Mrs. Mitchell: You have our approval, in accordance with the conditions listed below, to impact approximately 3,203 square feet of the protected riparian buffers for the purpose of constructing a single family home and driveway on the subject property as described within your application and depicted on the attached site plan initialed by DWQ staff on January 10, 2003. This letter shall act as your approval for the use of the "General" Major Variance; From the Tar-Pamlico and Tar-Pamlico Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots within the Coastal Counties as defined by the Coastal Area Management Act with ADDITIONAL CONDITIONS as approved by the Water Quality Committee (WQC) of the Environmental Management Commission (EMC) on May 10, 2001. In addition, you should get any other required federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control and CAMA permits. This approval shall expire when the variance expires on April 11, 2006 unless it is renewed before that time by the EMC. This approval is only valid for the purpose and design that you described in your variance request. If you change your project, you must notify us and you may be required to send us a new request for approval. If the property is sold, the new owner must be given a copy of this approval and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below. Conditions 1. All new stormwater drainage shall be directed to vegetated areas as diffuse flow at non-erosive velocities prior to entering the protected riparian buffers as identified within 15A NCAC 213 .0259(5). No new ditching or piping of stormwater through the protected buffers is allowed. 2. You are required to mitigate for impacts to Zone 1 of the protected riparian buffers. The required area of mitigation to compensate for impacts to Zone 1 of the protected riparian buffers shall be 915 square feet as required under the "General" Major Variance for Coastal Counties. The DWQ has determined that planting additional trees or woody shrubs within the protected buffer on the property will satisfy this mitigation requirement. The preferred number of individual plants shall be such that there are at least 320 trees or shrubs per acre at maturity within Zone 1 and shall not be less than twenty (20) new, individual trees or woody shrubs. These plantings shall occur no longer than one year after construction of the home has been completed. This office shall be notified in writing that the plantings have been installed within one month of the installation of the plantings. You are required to ensure survival of these plants for a period of five (5) years from the date of their installation. You are required to replace any plants that do not survive within this five-year period. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this Certification Approval and Authorization Certificate. If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. This approval and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under the Tar-Pamlico River Riparian Buffer Protection Rules (15A NCAC 2B .0259 (9)(b)). It is unclear from the information that you provided within your request as to what you are asking the variance for. Therefore, unless additional information is provided as described below, we will have to move toward denial of your request per 15A NCAC 2B .0233(9) and will place this project on hold as incomplete until we receive this additional information. Please provide us with information supporting your position that states your project must be constructed as planned and that you have no practical alternative to impacting these protected riparian buffers. Specifically: 1. Please provide the location of the protected buffers on the property. Please note that the buffers apply to from the edge of any coastal wetlands as defined by the NC Division of Coastal Management (DCM) and/or surface waters (e.g., Moore's Creek)(whichever is most landward). Therefore, you will need to have the coastal wetlands identified on your property by DCM. It appears that your proposed home will be greater than 50 feet from the coastal wetlands associated with Moore's Creek. However, your sketch shows a finger of wetlands extending into the property that you propose to cross with a driveway and are within 50 feet of your proposed home location. It is unclear to this office if these wetlands are coastal wetlands or non-coastal wetlands. Please contact the DCM at (252) 946-6481 or http://dcm2.enr.state.nc.us/contact dcm.htm to have the coastal wetlands identified on your property. 2. Please provide the area (in square feet) of any impervious surfaces (i.e., home, deck, etc.) that are proposed within Zone 1 and Zone 2 the protected buffers. Please note that any impacts to the wetlands will also require the use of DWQ General Water Quality Certification No. 3362 (see attached) and it's associated US Army Corps of Engineers (USACE) Nationwide Permit No. 18. Please call this office if you like to discuss the wetland impact issues and possible DWQ and USACE approval. It was stamped received by the WaRO on February 26, 2002 and received by the Wetlands Unit on May 7, 2002. On May 28, 2002 we requested additional information. We requested that he show the buffers on the site plan, which will most likely require that he have CAMA flag the coastal wetlands, and provide the area of buffer impact. There is nothing else in our file. Let me know if the WaRO ever received anything else on this project. We'll need a revised site plan showing the buffers and impacts before we can issue it. Legislation has been passed that may affect the intended use of your property. In a consolidated effort of the Pamlico County Commissioners and the Pamlico County Board of Health, the Commission has established a special provision for you. As a Pamlico County landowner, there is a new window of opportunity to obtain a "General Variance", as approved by the Water Quality Committee of the Environmental Management Commission on 5/09/2001. This variance expires on April 11, 2006. This is your window of opportunity to apply for a variance to plan for future land use. Basically, you must provide written proof to the State that the land was platted and recorded prior to August 1, 2001. Secondly, the State will recognize a lifetime septic permit issued by the Pamlico County Health Department as a substantial outlay if dated prior to August 1,2001. Thirdly, the variance remains with the property just like the septic permit for the life of the land. Our records indicate that you have a valid lifetime permit for your property in our records.
