The attached electronically signed form is the best we could do recently for a signed agent authorization form. All are
trying to keep from meeting in person when possible due to current events. If a hand signed form is required please let
me know. You can contact Mr. Sluder by phone at (828)230-5706 if it would help get authorization.
Regarding Condition 11.9., equipment will only be allowed to work from the top of the bank. The stream is too deep to
be able to reasonably use sandbags, rock berms, or cofferdams without increasing sedimentation through installation
and removal of such measures.

Jake,
On March 25, 2020, the Division received your application requesting a 401 Water Quality Certification for the subject
project. The Division has determined that your application is incomplete and cannot be processes. The application is on
hold until all of the following information is received:
1. Please provide a signed agent authorization form. The form provided with the PCN is not signed by the property
owner/applicant. [15A NCAC 02H .0502(a)(11)]
2. Please provide additional details regarding how Condition 11.9. of 401 General Water Quality Certification 4134
will be met for the installation of the boulder toe. [15A NCAC 02H .0506 (b)(2)]
Pursuant to Title 15A NCAC 02H .0502(c) and 15A NCAC 01C .0107, the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information is not received, the
Division will be unable to approve the application and it will be denied as incomplete.
