After your site visit, you now understand that this is an existing facility with walkways, decks and other structures already built. The modification calls for the removal of the existing 2200sgft walkway located with in the 50ft buffer. At your suggestion the forklift pad can be reduced to 15ft wide, it is however a Duke Power requirement. The original plan called for the forklift pad(1200sgft) to exit the rear of the building and discharge straight into the lake. This plan was changed at the direction of Duke Power Lake Manager Joe Hall in order to meet Duke's buffering guidelines. Since the pool amenity area has already been constructed, the proposed forklift pad is the only configuration that will work. With the removal of the old walkway and the installation of at least ten 3"dia or larger hardwoods and new shrubbery plantings, every effort has been made to minimize the impact to the lake and replant the buffer. At your request, I have enclosed 7 copies of the revised site plan showing the existing walkway removed, the forklift pad reduced to 15ft and all new plantings. Director Division of Water Quality January 21, 2003 DWQ# 02-1532 Mecklenburg County Crown Harbor Dry Boat Storage, LLC C/O Mr. Dean Fisher 19810-C West Catawba Ave. Cornelius, NC, 28031 APPROVAL of 401 Water Quality Certification and Catawba River Buffer Rules with Additional Conditions Dear Mr. Fisher: You have our approval, in accordance with the attached conditions, to dredge 0.28 acre of waters at Lake Norman and to remove ten trees from the protected Catawba Buffers in Mecklenburg County, as you described in your application received by the Division of Water Quality on September 18, 2002, and in your revised site plan received November 25, 2002. After reviewing your application, we have decided that this work is covered by General Water Quality Certification Number 3373, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetiands. This Certification allows you to use Regional Permit Number 198200030 when the Corps of Engineers issues it. This approval is also valid for the Catawba River Mainstem and Lake Buffer Protection Rule (15A NCAC 2B .0243). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed. one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. This project is for the installation of a treated wood and rip-rap bulkhead to prevent further erosion of the property due to wave action. The use of mechanical equipment on the beach must be minimized; 2. Equipment and materials may be offloaded to the beach at the bulkhead site, but steps must be taken to keep all equipment out of the reservoir, 3. The width of the travel pad shall be limited to fifteen (15) feet. Trees shall be re-planted within the path of the removed sidewalk, and from the construction access path, at a rate of 320 trees per acre. 4. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed. An as-built site plan including tree plantings shall be included with the Certification of Completion. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The applicant is constructing a dry storage fa ili for boats at the Crown Harbor Pier/Boat Slips. It has been requested that rip rap be installed along the shoreline on Lake Norman. Also the construction of the boat storage facility _calls for a fork lift travel pad (20 ft wide) that runs parallel with the lake and encroaches approximately 10 ft. into Zone 1 of the Catawba Buffer. The removal of 10 trees is required for the construction of the facility. Staff discussed with the applicant the possibility of reducing the travel pad width to 15 ft. This, however, will not prevent the removal of the trees. The applicant stated that new trees (5 - 7gal., 3" diameter) will be replanted along with other landscape vegetation. Revisions are forthcoming. Staff recommends approval upon receipt of the revisions. The dry storage facility is approximately 27,000 sgft with a capacity to store 200 boats and PWC's combined. The dry storage boats and PWC's will be transferred from the building to the concrete bulkhead along Lake Norman using low noise/emission forklifts. The dry storage boat slips and existing wet slips will be leased by Crown Harbor residents. The existing 39 slips and PWC floats will be reduced to 34 wet slips and 1 dry storage loading area per the original FERC order, approving 35 slips/facility. After approximately 1900 cu yd of dredging and 400ft of shoreline stabilization, the reconfigured wet slips will be inside new permitted area and extend no further than 120ft from the 760ft elevation. We believe this plan is the best use for the existing vacant land and surrounding lake area. Several other plans were discussed, with this facility representing the most minimal impact to the lake and environment. Your comments are required as part of the F.E.R.C. Permit application.
